We have not heard from this individual for over a year, until he wanted another copy of his paid invoice, which we sent again;

I do not accept this response as I have paid invoice and bank statement stating that I paid to SVP Auto Shipping. I hired SVP Auto Shipping.
I have nothing to do with who SVP Auto sub-contracts to. It is SVP's responsibility to deal take the responsibility. They should be dealing with their sub-contractors. I never dealt with the said transporter not I paid them. I know the one who I hired and paid.
So, SVP should pay me and then charge that amount to their sub-contractor/transporter who I have nothing to do with.

Also, I asked him to keep me up to date, so we could put pressure on [redacted] to take care of the problem. [redacted] said he would have the situation taken care of, and the client never contacted use over a year later.

As stated to the vehicle several times over the phone and email (plus stated in the Terms and Conditions the owner signed),...

vehicles are placed in the first available load, we do not guarantee a delivery date, and the policy FIRST COME-FIRST SERVED is used. his vehicle was scheduled to be picked up, the car carrier had mechanical problems, could not get is. Dispatch saved a spot for it on the nxt available load, the owner was contacted to let him know, as he was not happy he wanted to cancel his order. as he was not happy we waivered the cancelation fee of $[redacted] (stated in contract that the owner signed), and sent him a full refund. As per the car renal claim it states in the contract (a legal documents he signed) " 8. SVP Auto Shipping agrees to transport your vehicle in a quick, timely manner as per your instructions. However, due to circumstances beyond our control, we cannot guarantee an exact delivery time, and we do not pay for vehicle rentals, nor shall SVP Auto Shipping be liable for any non-use of your vehicle. All vehicles are shipped in the first available load (first come first served), and all rough time lines are Transit Times (while your vehicle is actually moving).
9. Payment can be prepaid by direct deposit, money order, internet money transfer, by certified cheque, or by credit. All vehicles will not be shipped until the total amount of shipment has been paid in full. If any shipment is cancelled there will be a $[redacted] cancelation fee charged, along with the 5% Administration Fee (if applicable). NOTE: there will be a *% Administration Fee for all credit transactions (please call our office)." As the owner received a full refund, the cancellation Fee was waived, and Terms and Conditions (contract) he signed, he was aware that we do not cover car rentals. Therefore, we consider this matter closed, and we were trying to be nice to the owner of the vehicle not charging him the cancellation fee, and giving him a full refund since he was not happy with the service, which was removed (as per our bank records) from our account.

quickly after picking up his vehicle, and paid for the repairs himself, we were still trying to help him out. However, he is not cooperating.
Here is the Terms & Conditions that [redacted] signed, and tried to modify by scratching things out, and writing things in.
Following the investigation of what you are claim, due to the design of the car carrier your vehicle was not damaged when it was being loaded and off loaded. Also, it is very difficult for a car carrier driver to crawl under the car carrier trailer (low clearance) to reach underneath a vehicle, or climb up on another vehicle to reach underneath a vehicle on the top row (which would cause damage to the vehicle they climbed up on).
As you stated you went over a speed bump after picking up your vehicle;
Some bad news I'm afraid. One of the drivers damaged the [redacted] in transit. The undercarriage was slid on somehow, and caused a problem with the muffler. As you can read in the report from the muffler repair company, the driver tried to reattach the muffler (so as to not get caught?). I only noticed when I went over a speed bump at a parking lot - the muffler was dangling quite low, and the manifold was stretched such that it was un-repairable. This was the most economical solution to have a drivable vehicle.
Also, as per the Terms & Conditions you signed (see attachment) it states;
NOTE: SVP Auto Shipping does not cover the under carriage, interior, mechanical / electrical items, and all glass (windshield/windows) while your vehicle is being shipped. We disclaim any liability for normal road hazards, acts of God or any mechanical or structural defects. Your vehicle must be in good running condition, and cannot be over 7 ft in height. Snow covered or excessively dirty vehicles will not be insured for scratches or dents that could be hidden at the time of shipment. All vehicles are subject to random searches by security/police. SVP Auto Shipping and it's agents are not responsible for the condition of your vehicle after being searched.
5. The owner agrees that SVP Auto Shipping and its agents are not responsible for any vehicle that has been modified from the original manufacture's specifications. Also, we are not responsible for environmental pollution, exhaust systems, antennas, wheel alignments, tires, emergency brakes, stone chips, windshield chips, windows/windshields (glass), wiring, mechanical or manufacturers' defects, corroded parts, loose or broken parts, after-market accessories, roof racks and storage containers, and items mounted on/under the dash. Personal and household items (including tires) are not permitted in the trunk or interior of your vehicle while it is being shipped due to strict security and safety shipping regulations, unless permission is given.
6. Any claim for damage to your vehicle must be noted at the time of its release, and SVP Auto Shipping must be notified by fax at [redacted] within 12 hours of release if any claim for damage is pending. The owner of the vehicle will be sent the Claim Filing Procedure, which must be followed in order to receive any compensation. Items attached to the vehicle (other than authorized installed dealer items, aftermarket accessories, or equipment, which are damaged or stolen, will not be covered under any claim. SVP Auto Shipping imposes a $[redacted] deductible on any claim that is submitted.
Therefore your claim will not be processed.
