Review: April 2015 we purchased a new construction home. There have been numerous problems since this time.

First, the home has a major foundation issue we have had inspected by a licensed 3rd party. There was either improper backfill or damage during compacting to the foundation wall.

Second, there is an arch over the garage door that was completed to the builder's specification against the advice of the installer using pieced together materials that are showing shrinking and caulking problems.

Third, the builder sent a landscaper to my home to install a yard without my consent or authorization and forwarded me the landscapers bill for an excessive amount. The builder is now demanding I pay their subcontractor with whom I have no agreement.

Fourth, there is a gap between the window lineals and the roof line due to improper sequencing by the builder

Fifth, standard practice is egress windows are installed no less than 3 feet off the corner of the foundation to prevent structural issues while our egress is only 6" off the corner.Desired Settlement: 1) Foundation repaired per an engineers recommendations and specifications paid for in full by Midwest Design Homes

2) Have the arch above the garage door installed properly using materials specified by the carpenter of my choosing paid for by Midwest Design Homes.

3) Midwest Design homes pays in full the landscaper they hired to install my lawn.

4) Properly install the window lineals so there is no gap by a carpenter of my choosing paid for by Midwest Design Homes.

5) Egress moved, repaired or reinforced as recommended by engineer to be paid for by Midwest Design Homes.

In regards to the complaint filed by [redacted] & [redacted] ID #[redacted]. Their complaint #1 – The home does not have a major foundation issue but there is an “excessive dry out crack” which happens with concrete. I have attached the actual email sent from the “3rdparty” from ABT whose job is to access issues such as this. When he was there to address this along with the owner of our company and Mr. [redacted], [redacted] agreed to let it go through a winter and address this come spring time to make sure there are no more cracks from the home going thru its first year of winter and having more settling. Second complaint the arch over their garage is what they wanted done per the “approved plan” by both homeowners. Again movement happens when new home construction start to dry out and settle. VERY common and cannot be helped!Third complaint we arraigned the landscaper per conversation myself and the Project Manager had with homeowners at his home to help assist in lining up someone. Now they don’t want to pay. This is their bill they have to pay it. We have made several attempts and left several days and times to meet in person with them and they said there was only one day they could meet and the Project Manager is out of town on that day I asked them to choose another day and [redacted] emailed me this comment (taken from her email): Yes [redacted]. That is what I am saying. We are not leaving work to deal with this anymore. We have given you ample opportunities to make this right. As I stated earlier [redacted] and I both work a lot. I travel for work frequently and we have 3 children in various activities. We have many prior commitments. If [redacted] would like to call me and discuss I would be more than happy to speak with him.Thanks,[redacted]We do not feel this is something that can be resolved over the phone and does require in person meeting. But again they are not leaving it possible for us to do this. We also need to meet in person to go over issue #4 – We have never heard of this issue until they made the Revdex.com complaint. This was never brought to our attention so we would like to also meet in person to access this to see if it’s for sure an issue, and lastly #5 Again first time we are hearing this, the egress windows would NEVER of passed the inspection if they were incorrect. The inspectors are meticulous about conducting their inspections and egress windows are thoroughly checked inside and out. The egress windows place per standard building practices that the state sets forth. We have 100’s of homes this way with zero problems.
