The consumer remains in collections On January 8, it was confirmed with our client that they had record that a payment had been scheduled to process on 1/20/for $but that was not an agreement they made with the consumer nor does this change the status of the consumer's collection account The consumer is incorrect that her account has been removed from collections

Consistent with our business practice and A+ rating with the Revdex.com, we have maintained professionalism in trying to resolve the consumer's complaint There were only two parties that had any control over the second payment issued by the consumer The parties were the consumer and the medical provider The check was not sent to our office and was never in our possession The consumer made payment to our office and always had the ability to stop her previous payment It is not uncommon for a consumer to tell our collection representative that the "check is in the mail." The consumer elected to make her payment to our office knowing that she had her other payment outstanding and uncashed When a consumer issues a payment with our office and we later find out that there has been an overpayment, we do our best to make sure that the refund is issued promptly Here, we have done just that We do not pay personal bank fees for consumers We maintain a separate location from our clients and we do our best to provide timely and accurate information to our clients so they may make informed decisions Here we advised our client that payment had been received in our office and that a check may be in route It is unfortunate that there were pending checks that caused the consumer numerous overdrafts It is also unfortunate that she wants to place the blame on our company for her failing to put a stop on her second payment The consumer is making statements and remarks about our company that may be actionable We are forwarding to counsel for review At this time, we consider the matter to be closed with the refund issued

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below[redacted] assured me that he was in contact with the other company and they were going to be destroying my check once they received it because the account was paid in fullOnce Midwest received confirmation that the company processed my payment, they should have done due diligence to notify me that the payment would be coming through and that they would be issuing a refund They never contacted me to tell me this Had I been made aware that the check was going to be processed I would have made sure I moved funds into that account to cover it This is negligence on Midwest's part! So I do not accept that they are not taking responsibility for their lack of effort I expect at least half of the overdraft fees returned to me They lied and cheated their way to taking my moneyAlso, I have yet to receive a refund check they claim was processed on June 20thThis is leaving me without funds longer than I should beThey should be trying to make this situation right and make me whole, however they have shown absolutely no effort to do soI am not accepting this.?Regards, [redacted]

The consumer had two account(s) placed with our office on 10/9/17. A notice was sent to the consumer for each account on 10/11/17. The consumer provided telephone numbers to reach her at home and at her place of employment to our client. The client in this case has designated our
Agency to collect the past due balance on the account and provided the contact information provided by the consumer to do so. Our office works at the discretion of our client. To date, there has been no change in the status of the consumer's collection account with our officeIf the consumer has paid the account as she stated in the complaint, our client will notify us and we will update the status of the account as paid and there will not be an additional collection action by our office. This seems to be consistent with the consumer's desired resolution

Midwest Diversified Recovery Services, LLC is a third-party debt collection agency with an A+ Revdex.com rating at the time of this reply.  The consumer in this complaint, [redacted] (hereinafter “the consumer”) resolved a past due balance from services provided on December 28, 2014 with our...

office by paying the past due balance in full by credit card over the telephone.  After that payment, our client/customer (the medical provider) received a second payment and posted what amounted to a duplicate payment on the account.  Our client later became aware of the duplicate payment and requested that we issue a refund for the earlier payment that we received.  The refund has been made and the file is closed in our office as paid in full.  Although the payment generated by our office was received and processed before the payment made directly to our client, we elected to refund the payment we received as a matter of courtesy and convenience to our client.  Therefore, the refund is in no way an admission of wrong-doing or liability on the part of MDRS, LLC.                 The consumer’s desired outcome of a refund of the amount she overpaid on the balance has been satisfied.  Given the fact that the consumer made payment and received confirmation from our office that the account was paid in full a week prior to the negotiation of the additional check she issued, any additional fees or expenses from failing to account for an outstanding check are not the responsibility of our agency.  We believe the additional accusations and statements by the consumer are without merit.                   Thank you for your courtesy.                   [redacted]                 President
