Customer’s Statement of the Problem: My spouse and I had worked with Midwest Homes for over years prior to making a commitment to buying a new homeWe had nothing but problems from the day we signed a purchase agreementCommunication is poor within their office and out Their employees have had a major turnaround causing even more chaosWe have even had employees doing work for us from the manufacture and contracted through Midwest that would apologize to us "for having to deal with Midwest"One contractor even would say "I'm sorry for your troubles I love what I do but I hate who I work for" Another said once, "Its bad that you have to put up with all of this but that's what keeps me in business" (as he was a repair guy) We initially signed a contract to purchase from Midwest in August We had been miss-guided multiple timesOne person would tell us we needed to do one thing and another person would tell us differentlyThis led to multiple issues and delaysOne big issue was funding that got hampered from misleading by MidwestKen C [redacted] had told us that he would cover everything to get us in our home until our construction loan was finalized and it would "be ok.....I'll take care of you", he would sayI assumed this was his way of making things right FACT: Mrs [redacted] fails to mention that although she had received an original approval on her loan, that approval was subsequently removed The reason was Mrs [redacted] had gone into default on her current mortgage due to failure to make their payments! Obviously a lender would be concerned when a customer does not make payments on their mortgage for over two months October 2014, forms for basement walls were up and everything halted as Ken denied ever saying that he would help us FACT: Untrue In spite of their serious delinquency, we did offer to assist her with financing after her original loan approval was removed In addition, we spent countless hours, on her behalf, talking to her lender and helping to acquire a new approval; plus we personally drove to and met with the lender at their office on three occasions; December 18th, January 16th and February 25th This does not include nine telephone calls between her lender and Midwest Homes plus e-mailing and faxing countless documents back and forth over a five month span This is in addition to the prior four months we worked with the original lender that had approved the loan until we received the call stating they have cancelled the approval Ground work was began and stopped just before pouring of basement wallsOur home was built and completed in November of as our banking issues continuedBasement work ended up getting completedHome was delivered to Midwest and sat outside with plastic over ends from November til it was delivered to us in April FACT: We did stop approval of any payment on this project until Mrs [redacted] was able, with our assistance, to get a new approval Mrs***’s contractor placed a lien against the property for non-payment since her loan was denied The home obviously sat outside because we had ordered the home to be built based on their original loan approval When it was subsequently turned down we refused to deliver the home to the site Midwest Homes was forced to pay for two deliveries of the home; once to our office and the second to the ***’s property This added over $2,in expenses that we’ve never been reimbursed for Contractor for Midwest was contracted to oversee entire project but never knew what was going on, never contacting other contractors to schedule work or spoke with them regarding what we neededWe ended up having issues with basement work not being completed as needed Basement windows, doors, and walls not correct height as well as placement of openings were not correctLike pulling teeth, Midwest did finally agree to remove themselves as general contractor/overseer FACT: Correct We stopped all work on the project since Mrs [redacted] credit had deteriorated to the point they could not get a new loan approval The contractor she references is the one Mrs [redacted] insisted do her work and also the one who subsequently put a lien against her property for non-payment After Mrs [redacted] personally came to our office and asked for our help, we did calls with the contractor and the lender to facilitate payment and release of the mechanics lien he had placed Once the house was set we had a whole new set of problems that came with it and MidwestThe carpet was soaking wet and there was mold noted to marriage lineWe were not allowed in house but were told that it was "being taken care of", of course house was joined together that dayWe noticed openings for appliances were not provided as requested(Initially we were purchasing appliances from Midwest but decided to go with different set elsewhere and asked Ken to leave openings for the same....."No Problem" we were told) FACT: Due to obvious insurance issues, no customer is allowed in the home during the construction and / or installation process Mrs [redacted] not only knew this, but had agreed to it in writing Again, Mrs [redacted] fails to mention everything they had agreed to in writing In addition, during the walk-thru they never noted anything wrong with the carpet During our walk through we had many areas of poor quality work and issues with things not being what they should have beenFor example, we asked for all wood cabinets yet they were notThese issues got pushed asideKen said "the wood stiles are what you ordered"...no we just asked for all wood cabinets and were told "we can do that" FACT: Mrs [redacted] had asked for a detailed listing of not only the standard features of her home, but all of the optional features they had purchased They also reviewed and signed for both of these items In addition, we asked the ***’s to sign a document that states they had reviewed every item purchased, all colors, all options etc which they did During the walk through we would mention something and Ken kept saying, "We need only make note of cosmetic defects at this time!" Once again, we moved on and that's exactly what we had done FACT: This is absolutely correct The walk-thru is for the purposes of noting “cosmetic issues” with the home This avoids finger pointing of possible damage to walls, flooring, trim, doors etc when the customer moves in Not only had this been discussed with Mrs***, she had agreed in writing and received a copy of their walk-thru Money had to be paid to Midwest IN FULL prior to keys being handed over to us, regardless of repairs that were needed FACT: Mrs [redacted] had agreed on three occasions, in writing, the keys would be turned over to them and they could occupy the home when “they” decided to move in At that point, payment in full is required They were also given a detailed listing of the items they had noted needing repair along with items they we’re questioning at the time of walk-thru so there would be no misunderstanding They would not except partial payment based on amount of work that had yet to be repaired FACT: Again, payment in full was due at the time “they” wished to take occupancy The ***’s were informed if they wanted to wait for all punch list / walk-thru items to be completed and make payment in full at that time, we would agree to do so Thus Midwest would not be paid until the work was done; although they could not take occupancy They chose to move in with a written list of what both parties agreed needed attention When I report ‘repaired’ I'm speaking of major issues such as bowed walls and suchNeedless to say we had already been out of our home for months with our children and our pets, so we paid FACT: The majority of this time was due to Mrs ***’s failure to make her previous mortgage payments on time which subsequently cancelled her loan approval In addition, and under the circumstances, both the ***’s and Midwest Homes agreed “in writing” that no dates of delivery, installation or occupancy would be made We’ll be happy to supply any signed documentation to support this Spanning from May 2015-September we have taken days off of work to be here for repairs of which they have not showed up, canceled last minute, or came but did nothing of what was supposed to be completed FACT: Every scheduled service visit has been done in conjunction with Mrs***’s scheduled days off from her work There has only been one occasion where we cancelled due to illness We have (5) actual work orders that Mrs [redacted] review the work that was done and actually signed off indicating her satisfaction Repairs that needed completed according to our Walk Through of "cosmetic defects” has been done poorly/covered upI still have bowed walls but am fed up with working my schedule around for them to continue to screw it up FACT: We have, in our possession, signed Work Orders from Mrs [redacted] that states the cosmetic items she references were completed to her satisfaction My damaged window has yet to be replaced I'm told "it still hasn't come in" but was ordered from factory months ago FACT: The window Mrs [redacted] references is, indeed, on back order from the manufacturer of the window We’ve been assured that as soon as the manufacturer contacts our plant the window is ready, they will inform us Mrs [redacted] has been told this as well satisfaction Soffit has yet to be fixed FACT: We have a signed off work order from Mrs [redacted] that it’s fixed If there is still an issue, we’ll be happy to address it We even ended up with a leaking shower that caused mold to a wall, floor and damaged a cabinetThe leak was stopped and the a Wholes were left in the wall and never fixed FACT: Mrs***, again, signed off on the water leak repair and the installation of an access panel should any future leaks occur It is our policy is that customers must notify us, in writing, of any warranty / service issues We have never received anything from Mrs [redacted] indicating there was mold, floor or cabinet damage A Light fixture was rusted, so they sent me a box with new fixture but no one to repair it FACT: We have never mailed Mrs [redacted] a light fixture; although the factory may have If this is the case, she never asked us to install it while we we’re at her home All items that we mentioned during walk through that was considered “cosmetic” never got fixedAnything and everything that was "repaired" has been basically COVERED UP FACT: It’s impossible to imagine this Mrs [redacted] was at the home at all times we did warranty work on the home and inspected it while the work was being completed She then signed, and accepted, the work The only items remaining from her walk-thru that are open include: Damaged window that she’s been made aware of is on back order Possible issue with the soffit that we will be happy to re-address We were given basic kitchen faucet, regardless of what we ordered FACT: I would like Mrs [redacted] to re-read her statement above, “regardless of what we ordered.” They saw the model home with the faucet they received, approved the order, approved the specifications, approved the options and received exactly what they paid for Should there be a defective faucet, it’s covered under her warranty If they would like an upgraded faucet, we will be happy to sell them one The sink keeps giving away at faucet every time I wash it; there are spots on sink that will not come offTrim to cabinets remain poorly placedOne guy even used hot glue gun to fix a loose piece of trim, which left it hanging out even fartherCabinets continue to not be joined togetherAppliance openings are not even square with walls FACT: Mrs [redacted] has never notified us in writing of any of these items She’s still under warranty and can do so; although they must be in writing for the manufacturer to comply with their service / warranty We have so many drywall issues that they marked "drywall repairs as needed throughout"The beam at the marriage line was far from straight, it actually looked twistedThey just finish "repairing" this last week, again covered it up FACT: Mrand Mrs [redacted] have both signed off on the drywall repairs All awhile getting paint/primer on my furnitureIt is now two different colors FACT: The paint is a primer only and Mrs [redacted] fails to mention this She was informed it was primer only and signed a statement to that effect It’s also noted, and signed for by Mrs ***, that any drywall repairs would be finished with a primer coat only Every time we have called regarding our issues we would either have to leave a message, that would not get returned, or we would get the run around of he said she said or I haven't heard back for so and soMost contractors would walk in and out of my house and across the carpet without removing their shoesNothing else is being fixed/covered up because "it was not in our purchase agreement"Well, nor was receiving a poor quality home, nor was poor customer service! Apparently one's word is not something that one can trust anymoreAll in all I feel that I could have just moved my old home onto a basement and saved ourselves the hassle and the moneyThis home, its quality of work and the work received on it is worth far less than it ever should be consideredAs a nurse I feel that I am a very understanding and forgiving personHowever, this experience has ruined my faith in this company making things rightThis was supposed to be our dream home and it has done nothing but turn into a nightmare for us SUMMARY: We have contacted our attorney on this matter due to the slanderous remarks made by Mrs*** Midwest Homes will not tolerate her actions any longer Per our agreement, will likely demand binding arbitration towards reimbursement of all additional expenses we’ve incurred; plus interest and attorney fees We will, however, continue to abide by the terms and conditions of not only our contract but all of the subsequent signed agreements with the ***’s Should they fail to do so, in any way, additional action will commence on our behalf

This has reached the point of absurdity, you send me a single page from an appraisal with an arbitrary statement that has absolutely no bearing on reality Appraisals are done with contracts, specs and plans, not assumptions, and not having received anything from your bank, or the appraiser that contradicts or provides any tangible documents to support your statements is puzzling to say the least The pictures are proof that you did in fact get the frame that you paid for, as described on your confirmations and I thank you for those, as it just reaffirms what I’ve stated This will be my final attempt to obtain signed contracts or signed specifications that would in any way substantiate anything that you have attempted to claim and it’s very curious that I still have not been contacted directly by either the lender, or the appraiser with regards to any of this I have decades of contracts where customers have ordered manufactured homes with residential frames because they wanted to install them on a basement, but you are the only customer I’ve ever had that did that and then conjured up a narrative to try and justify why you didn’t get something that you didn’t pay for You never ordered an industrialized unit (modular built to the state residential building code), you also, never paid for one and to date, haven’t paid for what you did purchase which is, was, and always has been, a HUD code manufactured home with a frame specifically designed to go on a basement or submerged crawl space Both codes are even listed on the web site, one as a HUD code (like you purchased) and one as a modular (built to the state code) and currently those different base prices for the same plan, coming from the same manufacturer are priced at a 20,+ difference which you in no way shape of form, paid, now did you?I see that you didn’t copy the Revdex.com on this but rest assured, I will make sure that they have a copy If you truly believe that after you viewed, walked through, priced out, and signed off (on multiple occasions) to purchase a HUD code, manufactured home and somehow expected for the home to be constructed to a completely different set of codes and you didn’t have to pay for that, well then, I’m at a complete loss as to how that got twisted around in your thoughts If, you would like to purchase and pay for the construction of an “Industrialized Unit or Modular”, we would be more than happy to do that starting with a base price in the 90’s and factoring in the removal and replacement of your existing “HUD code manufacture” home This part is completely speculation on my part and should be read as such, but here’s what I believe happened, you and your husband didn’t want to spend 90+ on a mod and decided to purchase a HUD home (double wide with a steel frame and a title), communicated something different to your lender that may not have done their due diligence, along with the appraiser, in obtaining accurate plans and specs, which blew up, when the inspection was done and they discovered that it was a HUD code manufactured home, although, the appraised sq.’ amount, indicates that the appraiser was aware None of this is my problem, we delivered what we sold and physically represented and now, everyone needs to put their adult hats on and deal with it Midwest is not a charity or not for profit business, and I will not take any responsibility for things that we did not do Last time, before I just turn this over to our attorney, if you have signed contracts or signed documentation that contradicts my statements or conclusions, why haven’t you sent them already? We have continued to be in communication with the customer and the current status is as follows:1.  They have refused to take occupancy of the home until all follow up warranty work is completed.2.  Midwest Homes has not been any commitment made regarding a "ready" date.  In fact, in...

three distinct areas our closing agreements state there is no promise of occupancy and the customer has signed those acknowledgments 3.  Mr. [redacted] has made not only unacceptable but defamatory comments regarding the female staff of Midwest Homes on more than one occasion.  This has been now addressed two times with Mrs. [redacted] as it's made it difficult for our female staff to communicate with him.4.  We have offered to come back and do a final walk-thru on Monday; June 1st; although they are now requesting cash settlements and have stated they may be seeking legal advise.I wrote back Mrs. [redacted] on Wednesday; May 20th with the following response:[redacted],
Amber and I personally spoke to the General Manager of
[redacted] this morning and they called back with the update.  I'll ask to e-mail you the name of the person
who called back.  They are actually going
out of their way to deliver the panels to us by the end of next week. 
Regarding the other parts of your e-mail:
1. The matching of the down payments was for new
customers who came in during our Open House Event.  Your home, should you have purchased it
during the promotion, has already gone up over $8,000 due to the large amounts
of recent pricing increases on materials. 
It had absolutely nothing to do with our offer. 
2. I'll be more than happy to personally come out and do
your walk-thru after the inspector comes out and have the bank documents
signed.  At the same time I'll not do
this should your husband become verbally abusive.
3. Let me know if you will be seeking legal advice prior
to coming to the home.  We obviously
would not want to occur as we would also need to do the same.  I have -0- legal issues today and wouldn't
want this to be the first one in years.
4. I can't control what you or your husband says to people
in your community.  Nor can I control
what is written to sources like the Revdex.com or on Social Media
sites.
5. In addition, to repeat what your husband has said
regarding my wife and the female employees or our company is not only unacceptable
but slanderous at a minimum.  I wouldn't
never use that language on any woman under any situation.
5. We are a company that lives by the motto of "our
lives work only to the extent we are willing to keep our agreements" and
we have every intent of adhering to the contracts and agreements signed.

FACT:  We have never mailed Mrs. [redacted] a light
fixture; although the factory may have. 
If this is the case, she never asked us to install it while we we’re at
her home.
All items that we mentioned during walk
through that was considered “cosmetic” never got fixed. Anything and everything
that was "repaired" has been basically COVERED UP.
FACT:  It’s impossible to
imagine this.  Mrs. [redacted] was at the home
at all times we did warranty work on the home and inspected it while the work
was being completed.   She then signed,
and accepted, the work.  The only items
remaining from her walk-thru that are open include:

Damaged window that she’s
been made aware of is on back order
2.    
Possible issue with the
soffit that we will be happy to re-address
 
We were given basic kitchen faucet,
regardless of what we ordered.
FACT:  I would like Mrs. [redacted] to re-read her
statement above, “regardless of what we ordered.”  They saw the model home with the faucet they
received, approved the order, approved the specifications, approved the options
and received exactly what they paid for. 
Should there be a defective faucet, it’s covered under her
warranty.  If they would like an upgraded
faucet, we will be happy to sell them one.
The sink keeps giving away at faucet every
time I wash it; there are spots on sink that will not come off. Trim to
cabinets remain poorly placed. One guy even used hot glue gun to fix a loose
piece of trim, which left it hanging out even farther. Cabinets continue to not
be joined together. Appliance openings are not even square with walls.
FACT:  Mrs. [redacted] has never notified us in writing
of any of these items.  She’s still under
warranty and can do so; although they must be in writing for the manufacturer
to comply with their service / warranty.
We have so many drywall issues that they
marked "drywall repairs as needed throughout". The beam at the
marriage line was far from straight, it actually looked twisted. They just
finish "repairing" this last week, again covered it up.
FACT:  Mr. and Mrs. [redacted] have both signed off on
the drywall repairs.
All awhile getting paint/primer on my
furniture. It is now two different colors.
FACT:  The paint is a primer only and Mrs. [redacted]
fails to mention this.  She was informed
it was primer only and signed a statement to that effect.  It’s also noted, and signed for by Mrs.
[redacted], that any drywall repairs would be finished with a primer coat only.
Every time we have called regarding our
issues we would either have to leave a message, that would not get returned, or
we would get the run around of he said she said or I haven't heard back for so
and so. Most contractors would walk in and out of my house and across the
carpet without removing their shoes. Nothing else is being fixed/covered up
because "it was not in our purchase agreement". Well, nor was
receiving a poor quality home, nor was poor customer service! Apparently one's
word is not something that one can trust anymore. All in all I feel that I
could have just moved my old home onto a basement and saved ourselves the
hassle and the money. This home, its quality of work and the work received on
it is worth far less than it ever should be considered. As a nurse I feel that
I am a very understanding and forgiving person. However, this experience has ruined
my faith in this company making things right. This was supposed to be our dream
home and it has done nothing but turn into a nightmare for us.
SUMMARY:  We have contacted our attorney on this matter
due to the slanderous remarks made by Mrs. [redacted].  Midwest Homes will not tolerate her actions
any longer.  Per our agreement, will
likely demand binding arbitration towards reimbursement of all additional
expenses we’ve incurred; plus interest and attorney fees.  We will, however, continue to abide by the
terms and conditions of not only our contract but all of the subsequent signed
agreements with the [redacted]’s.  Should they
fail to do so, in any way, additional action will commence on our behalf.

I JUST GOT OFF THE PHONE WITH MY BANK , AND SHE DID FACT TRY TO CALL YOU, BUT YOU ARE “OUT OF THE OFFICE TODAY”? SHE ALSO SENT YOU AN EMAIL AND TRIED TO CONTACT YOU DAY BEFORE. Now, let me tell you what I think happen. Your sales department messed up and now you are back peddling to save yourself, that your sales department was very misleading.If you would have look at the email the Revdex.com was on the email, that I  sent you. You must not have looked at the  incorrectly. And the paperwork that I sent you was from the appraiser, before the construction of the home, so they knew what we were telling them was the truth. Please explain to me why your sale rep would tell them we were getting the wooden undercarriage, as we thought that was what we were getting and paid the almost 3000 grand for.. Please do not assume that my husband and I are charity case, and the fact of the some of the words you choose to write in your email shows the lack of professionalism that we have been complaining about form the beginning. 1.  Amber M[redacted] (our [redacted]) was advised by Ms. [redacted], the weekend prior to delivery, the site would be ready for the home.2.  Midwest Homes scheduled the delivery of the home with a contractor, paid for all of the required permits, had the delivery company drive to our office...

and hooked onto the home3.  Our Service Manager called Ms. [redacted] to advise her the home was on the way and she stated the site was not ready4.  Since the home was already in transit, the hauling company continued to the site and placed it on the property5.  Mrs. [redacted]'s contractor had not built the foundation according to the plans and specifications supplied by Midwest Homes6.  Another contractor was hired to complete the foundation7.  Subsequently, the weather conditions prohibited us from installed the home until the grounds would permit us to do so8.  During this period we did make tentative dates for the home installation; although the weather was not cooperating.
