Our project file has detailed documentation of all activities and correspondence relating to this project.  In response to the customers statement, our project manager made it clear at the outset that if the [redacted] flooring that was selected was handled through us, then product warranty would be in our name through us.  The customer was given the option to deal with [redacted] directly at the outset but chose to have it handled through us.  Yes, we acknowledge that there was a problem with both the flooring material and the installation, and we have been trying to get this worked out satisfactorily for months with the customers.  We have had difficulty with communication and getting on the same page with both Mr. and Mrs. [redacted] throughout the project and in resolving the flooring issues.  As this is a remote rental property, we communicated frequently by email and we would often have significant lapses in time before receiving a response from the customers on questions relating to the project.

On 9/10/14 our I and our project manager met with Mr. and Mrs. [redacted] at the subject property. The Pergo product report was presented to and reviewed by the customers.   The kitchen counter top was replaced and cabinet drawers were adjusted as needed.  We did a complete walk through and a punch list of touch up items was created and agreed upon, and all the items on this list have all been completed.  We discussed the options and reached an agreement regarding the flooring replacement.  The contract amount for the project and final invoice has been reduced by an amount equal to the amount needed for the customers to contract directly with [redacted] to have the flooring removed and replaced.  Additionally, charges for contract change order upgrades totaling approximately $2,400.00 have been waived by Midwest Remediation and the customers will not be invoiced for this additional work.

The customers have signed a Certificate of Completion/Satisfaction for the project, a copy of which is attached to this email.

Midwest Remediation considers the project to be complete and the complaint to have been resolved.

If you would, please confirm receipt of this email response.

Sincerely,
