Upon review of the complaint we have found some major inaccuracies with [redacted] ’s description of our business as well as his complaint Please see below for our responses to each specific part of the claim: - To begin with, we are an entertainment company that provides the Thoroughbred Ownership Experience to our Members We are not, and have never claimed to be an investment company- Our Members do not “own” any physical part of the horse or “future’s” in any horse They purchase Experience Shares that grant them access and privileges so they can gain an understanding of the thrill and excitement of Thoroughbred Horse Racing It is up to each individual member to take advantage of the experiences that are available - We do maintain Account Balances for members as some of our “Perks” resemble those that an actual Racehorse owner would have In [redacted] s case, he requested that his Account Balance of $be cashed out and sent to him via check The check was written on 9/20/and sent to him on his address on file the same day - There has been numerous email correspondence that have gone out to all our Members that detail what we are currently doing to grow and make our business better as well as what to expect in the future - The website is not shut down A section has been placed “under construction” so that we can make the technological updates and test the new systemAll of this has been conveyed to our members many times As far as the refund requested; it clearly states in our Terms and Conditions that a Member has up to hours from the time of purchase to request a refund If the request is made outside of the hour period then no refund will be issued We have, however, let all our members know that if they are not satisfied with the upgrades and technology changes then they can request a refund that will be processed at the end of Q Hopefully this response is sufficient but if you need any additional information, please let us know Thank you for your time and due diligence in this matter
