Sincerely, [redacted] ***

As it states in the complaint, we are waiting for parents that still owe us money to pay us. As soon as we receive these payments, we will gladly be returning the remaining $2,500.00 that is owed to them. We are working very hard to collect the tuition that is owed to us from these parents. We have...

no intention of not returning the complaintant's money. We have a limited amount of resources and registrants to run our program. When we have families that delay their payments to us, we are unable to meet our contractual agreements with our vendors. As stated in our contract: "You, the Applicant, may cancel this transaction at any time prior to midnght of the seventh (7th) calander day after after the program begins and receive a partial refund of money paid to the Academy. The $1,500.00 Enrollment Fee is NON-REFUNDABLE." The complaintant knew this and agreed to this policy PRIOR to signing the contract. And for the record, we are not dealing with "children". These are all young men that have graduated High School and are at least 18 years of age.

[redacted]   To Whom t May Concern:   Thank you so much for your efforts on our behalf. Midwestern Preparatory Academy’s response is not satisfactory. While I am encouraged at the acknowledgement to the Revdex.com of the debt owed to us, I am concerned regarding the tone of the response. We are fully aware of the refund policy of Midwestern Preparatory Academy and the terms of the contract we signed. The $2,500.00 still owed to us is in addition to the $1, 500.00 NON-REFUNDABLE enrollment fee. We have already written the enrollment fee off, it has no bearing on our claim and it should not be presented as evidence in the future so as to not attempt to cloud the facts.  The contract we signed stated that, minus $1,500.00, we would be fully refunded. The remaining refund totals $2,500.00. This amount is not in dispute. Mr. [redacted] has acknowledged this amount in previous text messages and in written, mailed correspondence attached to the previous check sent to us. Proof of this can be provided if necessary. Here is the verifiable and documented timeline of events:   January 13th, 2017 $1,500.00 deposit was paid to Midwestern Preparatory Academy. February 3rd, 2017 $2,500.00 tuition installment was paid Midwestern Preparatory Academy. April 3rd, 2017 $2,500.00 tuition installment was paid Midwestern Preparatory Academy. June 19th, 2017 notice of cancellation letter sent per guidelines delineated in the signed contract: “Notice of cancellation must be in writing and addressed to: Business Manager, Midwestern Preparatory Academy, [redacted]. Notice must be via Certified Mail, Return Receipt Requested and is valid as of the date of receipt by the Business Manager.” June 21st, 2017 [redacted], Business Manager, at Midwestern Preparatory Academy texted me informing me that the cancellation letter needed to be sent to, Midwestern Preparatory Academy, [redacted]. June 21st, 2017 “Notice of cancellation must be in writing and addressed to: Business Manager, Midwestern Preparatory Academy, [redacted]. Notice must be via Certified Mail, Return Receipt Requested and is valid as of the date of receipt by the Business Manager.” July 3rd, 2017 [redacted], Business Manager, at Midwestern Preparatory Academy texted me informing me that our refund would be received by August 15th, 2017. July 7th, 2017 Marques [redacted], President Midwestern Preparatory Academy, signed receipt of notice of cancellation. August 8th, 2017 initial letter sent to the address delineated in the contract returned by the USPS. This letter remains unopened as recommended by USPS. August 23rd, 2017 [redacted], Business Manager, at Midwestern Preparatory Academy texted me a photograph of the certified mail receipt informing me that our refund was sent to our former address. August 25th, 2017 our partial refund check arrived with $2,500.00; half of what was supposed to be sent. A letter included with the check informed us that the other half, or $2500.00, would be paid by September 15th, 2017. September 15th, 2017 we did not receive a refund check of any amount. [redacted] was contacted. He was polite and explained that we would be paid once they were paid and that the check would be sent out October 1st, 2017. This check never arrived. We have since attempted to contact him and Mr. [redacted] through text messaging and phone calls but none of our messages have been answered or returned. This money was never used by our son and should not have been spent to pay for the tuition of other young men. We paid for services we did not receive while others received services for which they did not pay. We were never afforded the opportunity of a “pay after play” payment plan. We signed a contract and on that contract it stated, “ALL FEES MUST BE PAIN IN FULL PRIOR TO JULY 1ST, 2017.” We understood that in order for our son to play football at Midwestern Preparatory Academy, he would have had to been paid in full prior to arriving at Midwestern Preparatory Academy. Were other young men offered a different contract, one that allowed them to play without paying? We are not unreasonable people. Had Mr. [redacted] answered any of our numerous recent attempts to contact him, we might have been reassured that our refund was guaranteed. Not answering calls and/or text messages because the refund funds are still unavailable is not a credible way to do business. We would not have needed to contact the Revdex.com had open communications been maintained, instead of simply being ignored. The tone of the response letter might suggest that we are unreasonable, but $2,500.00 is a significant sum of money to us. Our obvious question, as Midwestern Preparatory Academy’s football season draws to an end, is when will we have our refund?   Sincerely,   [redacted]
