As per estimate I completed said project, the room Mr. [redacted] is referring to is all custom wood walls and ceilings stained and laquared finish aside from two small sections of sheet rock around ground level windows, as which those areas were painted. All standard sheetrock and prepainted surfaces were prepped and painted to a professional degree with quality [redacted] paint. Mr. [redacted] contacted me as to his issue of said room and demanded a $500 refund, I told him I would not just refund $500 but that in two days I would go and paint that room. He told me that would be fine. I thought issue was resolved at that time. The day before I was to complete the work outside of my contract at no cost to him he sent me a text message saying NOT to paint the room because they had 2 offers on it and it was under contract. the time frame from paint to contract was right at 2 weeks. After painting the house for Mr. [redacted] it went under contract and sold in 2 weeks. I have been doing business in [redacted] for 25 years and have never been questioned by any customer for their house selling within 2 weeks nor have I ever had a complaint filed. My work and ethics are among the highest, I work for many different agents and reality companies in [redacted] because of my ethics and quality, [redacted] paint company is another large contact of mine as they refer me on a regular basis. As for the desired settlement Mr. [redacted] is asking for, totally unfounded, outrages and will not happen. I have been to city and my name, reputation and license are still outstanding and there is no issues according to them. Myself and my attorney are prepared for any unsubstantiated demands from Mr. ***. [redacted] [redacted]

I spoke with my attorney and we will not be participating in the Binding ArbitrationMy offer to settle for $was a generous offer to settle without involving an attorneyIt became clear that *** was stubborn and a cheat to so obviously breach a contract and even admit to having done so in his text messageI’m extremely disappointed that the Revdex.com isn’t more proactive in situations like this were the evidence is blatant against the businessI will not settle for $at this point and I’m sure you’ve noticed the character of *** not being one to do the right thing or allow me to collect the real damages as he neglected to finish almost half the house
This isn’t the first time I’ve experienced the Revdex.com so protecting one of their members and allowing a bad business person to continue operating with a clean recordRevdex.com membership means very little to me now knowing how hard it is to prove a member is of questionable character
My attorney will take it from here and if necessary have a judge decide through a local law firm; I’ve got a hunch though once Brightly’s attorney sees what a scam artist his client is, he will advise him to pay the unearned moniesLet’s face it, at this point *** is busted in black and white to have breached a contract and for $hires a lawyer? Now a business anyone would recommend
If I can send the conclusion to rightfully mar his reputation at Revdex.com let me know, though I still plan to pack up all the facts and send them to every *** in SE Wyoming, this guy is far too dangerous to let go without warning

I have already sent the contract, a legal document stating the entire scope of the jobThe contract states with no exclusions to painting the “interior” of my home, it’s not as if I’m expecting him to paint the interior of the garage but the living space which he failed to completeAs I mentioned in an earlier response, *** says he can’t paint lacquered paneling without significant pre preparationFirst of all none of the paneling was lacquered and I had no problem painting with one coat other areas of the very same paneling, second there was no conversation, as he states, that that would cost extra and most important to counter his statement about not painting finished wood; if you look at the picture of the master bath that shows a painted door on a cupboard in the wall by the shower, I had freshly refinished to match the bathroom vanities that were also refinished, that cupboard door and it wasn’t to be painted but he, without any expensive pre preparation, successfully painted that door with no ill effectsWhen he bid the job he assured me that the paneling (being as old as the house) and all those downstairs rooms with acoustic ceiling tiles would paint up nicely and would only require one coat as he was spray painting the jobThis came as no surprise to me as I have watched professional painters spray paint quite similar paneling with no pre preparationNone of the paneling in question had a shiny lacquered finish, they were all panels factory sanded to a very smooth finish and stained
I contacted the *** Real Estate Commission inquiring that *** Painting contacted them and he insinuates that they favor his position and they are the source of my refund for his breach of contract Nobody there knows anything about Brightly’s contact them and that organization as nothing at all to do with this kind of situation in any way, they license ***s, so I’m not sure what *** is trying to do using the *** Real Estate Commission as a defense
In contract law, any ambiguity in a contract favors the contractee and is used against the authorThe contract clearly state that the interior of my home be painted without exception; the pictures clearly show three rooms not painted, where can there be a dispute? My home selling has nothing to do with his breach of contract, I paid for the value of a service that did not get completedIf *** can show me where it says some rooms wouldn’t be painted I will concede that he is right, but it doesn’tso what’s the question?
I sure hope this can be settled here as it will be cheaper for all of usIn preparation I am getting my legal service to start working on the cases validity and will be getting quotes to have the three unpainted rooms painted as he really owes me much more than $ As I am not obligated to have *** remedy his breach and with the hostility he has shown to me and my ***, I wouldn’t in a million years have him do any work for me, my *** who suffered continuous abuse from *** feels the same way and no doubt sharing his experience with other ***sNo doubt a Judge will read the contract and see the breach since they don’t allow the contractor to verbally change the scope of a contract after a breach to cover their tracks

I am rejecting this response because: His answer is a total lie, he said there would be no problem spray painting the wood paneling and I know as a fact that with past painting projects with professional painters that there is NO expensive preparation required as is even evidenced by my painting some wood paneling in the laundry room; he's just blowing smoke towards people who might not know better.
His comment about the house selling in 2 weeks has nothing at all to do with his contract with me, His contract says nothing about getting my house sold in a specified time, it does state clearly and with no room by room exception that he shall paint the entire interior of my home for the contracted price. The picture provided are clear evidence that he breached his contract with me and did not complete the work being able to take advantage of my being out of town. There was no conversations whatsoever about any exclusions and if there had been exclusions, they needed to be spelled out in the contract.

I am rejecting this response because: [redacted] is quite the pro at twisting reality.  First of all please see his attached contract with me to paint the interior of my house with NO exceptions or exclusions; every room. he says in his response I told him to essentially do what ever he saw fit to prepare the house for sale; nothing could be further from the truth, the contract spells it out.
[redacted] may have a good record to date because this is the first time he had the person he was painting for half way across the country so he could do whatever he wanted and get away with it, or that nobody to date bothered to complain.  My [redacted] said he was a sloppy painter and there was paint in many places it shouldn't have been including a big white ring on top of a porcelain stove top; I cant imagine someone that sloppy having a stellar record. My settlement sheet will state the cost to clean up after him and I've already been in touch with his insurance agent to file a claim.
Unfortunately [redacted] knew beyond a shadow of a doubt that I moved out one day, he started painting the next and must be done in 3 days as he said he would so the place could be cleaned and immediately listed. The day he offered to complete the job was the [redacted]s home preview date and before he could finish the job he was paid for we had 13 interested buyers (but no contract yet as he made up not 2) and it would likely be fatal to change the appearance of the property so dramatically so my [redacted] said it's too late for[redacted] to fulfill his contract which put him in breach of his contract with money due me.
f someone from the Revdex.com would give me a cell phone number, I can forward his ugly conversation with me and you can read where he admits to have not completed the job. is ethics are far from business like. I'll be glad to get a painter to quote painting the unfinished rooms if he wants more substantiation that I've already provided.
I have also emailed part of this response with photographic evidence to show the painted and unpainted rooms, and as far is his made up claim that he wasn't to paint finished wood surfaces, the master bath has a wall closet I myself refinished in a beautiful dark stain to match the vanity as it did before and he painted over it spoiling that refinishing job, you'll see it in the pictures. I will be forwarding the email as sent to [redacted] County who was in fact appalled at this case of theft, it also has some additional information.
I'd love to have his attorneys contact information so he can view the indisputable evidence of a breach of contract and see how egger his is to take action, but I'm guessing it's nothing but a bluff, I have a contract and a partially painted house that breaches the contract.

I called today to see how this process works and if I may need to send any additional information and I do.
 
I just got off the phone with my [redacted] who [redacted] read the riot act to over this situation. It took so long for me to get a hold of [redacted] that 13 prospective buyers looked at the property and showed interest. My [redacted] said it would be a considerable risk to, at such a late date so substantially change the house by finishing the painting  [redacted] omitted so I had to tell him not to finish so I didn’t jeopardize a sale and refund me only $500.00 which is far less than the square  feet of unpainted rooms, the one room is the biggest room in the house. Brightly’s response was to the generous settlement was “that’s not going to happen”. I paid for the time, materials and labor to paint the entire interior of my house and got far from that and unfortunately I gave the check to pay the painter to the [redacted] who didn’t have a copy of the contract to know the terms in detail. It made me a little uncomfortable how insistent he was demanding immediate payment after he was done while knowing the person he had the contract with would not be there.  If you could provide me with your cell phone number, I could forward our lengthy text conversation where he admits to not completing the job.
 
I’m attaching the [redacted] pictures so you can see there are rooms not painted. Since paneling is dated, we elected to paint the paneled walls.
