I have spoken to *** on several occasions and am familiar with the vehicle, the sale of the vehicle and ***'s list of concerns
Autolane and Cycle Inc's response is as follows:
*** was provided with accurate information prior to his decision to Purchase
Autolane sells vehicles on occasion to absentee Purchasers
In this transaction, *** first reviewed our Advertisement, which contained high resolution detailed photos of the vehicle from virtually every angle, before calling us
*** asked for and received several other detailed photos of the vehicle taken by myself in response to his request for more photos of the vehicle, including as I recall the undercarriage
*** asked many detailed questions about the vehicle, its known history, condition, etc in several calls to my salesperson over a period of approximately weeks prior to his decision to Purchase
***'s questions asked in these multiple conversations were answered frankly and to the best of our knowledge
The vehicle passed a *** Motor Vehicle Inspection prior to Sale and shipment across Canada to *** by rail
Autolane & Cycle Incoutright rejects any suggestion that *** was "lied" to at any time
In fact, *** saw this vehicle from more angles and received more information about the vehicle than any Customer I can recall
*** also obtained additional information about the vehicle's history on his own, as stated in Paragraph of his Complaint
After nearly weeks of pre-purchase research, questions and photographs, *** made the decision to Purchase the vehicle and have it Shipped by rail across Canada at his expense
Specific Complaints with the Vehicle
*** had the vehicle shipped by rail across Canada at his expense
Autolane notes the possibility that some of ***'s concerns may have occurred during Shipping a year old vehicle across Canada
Further, as *** notes in Paragraph of his complaint: " I recognize it is not a new vehicle, there are some things he may not have known about and I am not making a stink about some of the smaller deficiencies."
Indeed, the vehicle is years old and is not New
Used Vehicles are, by their very nature, worn
Some of ***'s complaints relate to Wear....and some likely relate to Shipping
Our Response to ***'s Concerns
As *** of Autolane & Cycle Inc, I handle Customer Concerns
For this reason, my staff always refer Customer Concerns to me
*** did not "refuse to discuss the matter with" ***...he referred *** to me
After listening to ***'s concerns in detail, Autolane & Cycle Incagreed as a goodwill gesture to pay *** $*** in full and final settlement of his concerns
*** agreed the $*** payment would settle his concerns
Summary
After searching across Canada and conducting extensive due diligence, *** purchased a used *** from Autolane
In the months that followed, *** has had the vehicle inspected carefully by one or more mechanics in ***
***'s list of concerns was mutually settled with a payment of $*** towards his $*** list of alleged repairs
Autolane has responded promptly, properly and professionally to ***'s concerns

Thank you for providing me *** response to my concernsI will clarify and elaborate below under the headings he provided:
1)
Yes, I saw the photos Auto Lane put in their advertisementI do not recall how many there were, but they showed satisfactory views of the exterior and interior of the vehicleIt is quite a nice looking vehicle from the outside, and the interior was not bad either
I was provided no additional photos from either *** or his ***In fact, I had no contact with *** at all until *** refused to discuss the undisclosed defects in the vehicle he told meI have kept all email and text correspondence with Autolane, and I would be interested to see evidence of those pictures *** took "as he recalls"The description of the undercarriage of the vehicle was from *** verbal description
My questions about the vehicle were answered by *** in phone calls after which I decided to go ahead with the purchase of the vehicleHe answered very clearly and very confidently the questions I had*** At no time did *** say he did not know the answer to my question about the vehicleHowever, I did not ask if the turn signals and brake lights workedI believe that to be implied in *** statement that the vehicle "needs nothing"The rest of the week period was waiting for the payment to clear, and waiting for *** to take the vehicle to the shipping yard
The vehicle has an inspection sticker that expires June I understand this to mean that as a "type 2" vehicle, it was inspected in June I have since come to understand that unless a "***" (***) is signed by buyer and seller and the inspection sticker removed, that a Motor Vehicle Inspection must be performed within days of the sale of the used vehicle from a dealerNeither of those two things occurred and I am unaware of any exemptions that should apply here*** let me to believe that the transaction was being completed properly, and that the month old inspection certificate should be viewed as testament to its road worthinessRegardless of the above, the vehicle I received would not have passed any inspection in any jurisdiction, and was not roadworthyThat is why it sat in my driveway for months
I was in fact lied to in that many of the obvious vehicle defects were things I asked about specifically and was told there were not problems withAt no point was I told by *** that he did not know the answer or the condition of the vehicle throughout my questioning

*** suggestion that some of my concerns may have occurred during shipping is far-fetchedI listed obvious defects and nearly all of them show evidence of having existed for some time
***s assertions that the defects should be attributed either to shipping or to being, as he puts it "wear" are very weakobvious defects are not related to shipping, and any defects related to "wear" are things that *** would have been aware of prior to selling the vehicleHe drove the vehicle for 1,km during its time at his dealership, and concedes in paragraph of his response that he is "familiar with the vehicle"None of that was disclosed to me
3)
My "due diligence" was reliant to a great extent on *** information from *** of Auto LaneAll of the defects are things that were evident by myself upon receipts of the vehicleI am not a mechanic by any stretch, and I have had to take the vehicle to a mechanic to repair some of the more pressing defects
I did receive, after weeks of unreturned calls and texts to ***, $*** from *** as that was all he was prepared to reimburse for repairsI asked him about all of the other repairs and defects, and he was very clear that was all we was prepared to to to resolve itFor that reason, I accepted that money and am pursuing further means to achieve what I deem to be a fair resolution of obvious wrongdoing
*** cannot say in the same breath that he was "familiar with the vehicle", that I was provided "accurate information prior to his decision to purchase" and then go on to chock up most the list of defects to "wear"Any known defects, related to wear or otherwise, are to be made known to the purchaser plain and simpleThat did not happen, and that is why we are all hereHad I known all of the defects with the vehicle, I plain and simply would not have purchased itBut because of misleading statements by ***, it is now in my possession and we will have to make the best of it

On December 9, 2015, *** negotiated a Discounted Price for the vehicle, with No Warranty
*** was offered Warranty Coverage in writing for an additional cost that same day, which he declined
This model year vehicle was sold without warranty
This model year vehicle was sold at a Discounted Price without Warranty at the specific request of ***
This year old used vehicle was NOT sold "on approval" or with a Month (or any) " free adjustment period"
The $*** subsequently paid to *** after weeks of his attempting to "rewrite the transaction" was paid as a mutually agreed Full & Final Settlement of his concerns
***'s other allegations are specifically denied
