Mr [redacted] has asked that I please respond on his behalf to the complaint of Mr*** That said, be advised Mr [redacted] categorically denies that he failed to properly install windows at Mr***’s home, or that the damages complained of by Mr [redacted] are in any way attributable to defective installation by Mr [redacted] or his agents Mr [redacted] has been installing windows for in excess of forty years and he can say with a good bit of pride that he has never had a window leak as a result of defective installation.In this particular case, when Mr [redacted] first met with M [redacted] at his property in Westwood MA, in the fall of he observed that the property was in deplorable condition resulting from an obvious neglect to properly maintain the home Specific reference is made to the siding, or lack thereof, the roof, and apparent improper flashing in various areas, most notably to a bump-out addition to the kitchen that has been done by other contractors However, despite that the house was in need significant repairs, Mr [redacted] is a window installer and that is exactly what he did Install the windows He was not engaged to do any work other than the windows He performed that service in a good an workmanlike manner.Actual installation was delayed for a good period of time because Mr [redacted] could not pay Mr [redacted] for the windows until he was in receipt of some disability check Mr [redacted] continually referenced This put Mr [redacted] in a rather tenuous position with his suppliers who were looking for payment Nevertheless, the installation was completed by Mr [redacted] in early Subsequently, Mr [redacted] did not hear from Mr [redacted] until August when he contacted Mr [redacted] requesting that Mr [redacted] come over to inspect the windows to see if they were properly installed Mr [redacted] was complaining of water leakage into his home, and he was suggesting that it might be caused by the windows When Mr [redacted] visited the home, contrary to the assertions of Mr***, he did not acknowledge in any way that the windows were leaking What he did observe however was that the house was in the same condition of neglect that it was back in 2006, and perhaps a bit worse Also, Mr [redacted] never advised that the windows and the installation were warrantied for life After that meeting in August 2011, Mr [redacted] never returned to Mr***’s home, first, because the windows were properly installed, and perhaps equally important, because it was clear that Mr [redacted] was insistent on heaping all of his issues with his home on Mr [redacted] and the windows, when it was clear the causes thereof, for whatever reason, were attributable to work performed by others, and by Mr***’s failure to properly maintain his home.Interestingly, in his letter to the BBO Mr [redacted] lays out a litany of issues, but he fails to articulate exactly what Mr [redacted] did, or failed to do In any case the work Mr [redacted] was hired to do was done professionally and in a workmanlike manner and it is unfortunate that Mr [redacted] seeks to anoint Mr [redacted] the scapegoat for all of his woes As such Mr [redacted] respectfully requests that he retain his accreditation with the BBO[redacted] By His Attorney

ensuing description that will explain, as well as document, professional back up to ***'s claims against ***, as well as ***'s level of workmanship depicted and explained by those in ***'s field, all respected professionals in the construction fieldPlease also find a copy of ***'s own email regarding his warranties and onsite position also verbally rendered by *** during time of order process.***, first and foremost, has had numerous opportunities to live up to his warranty contract, as a business, and sole proprietorHe failed to do so with the many opportunities *** extended to *** in past occasions*** was not, and did not, show up on the job site at anytime during installation processThis suggests that since *** was not on site during installation he could not have witness any of the installHence *** has no ability to comment on steps taken, or missed in this processAll contact made by *** from to present, went virtually unreturned by *** after numerous attempts on the part of *** to get the situation rectified in a fair and reasonable manner to allThere seems to be absolutely no warranty, as promised, or concern for the consumer, where ***'s professionalism and ethics are concernedThe response to Revdex.com by ***'s attorney is the first attempt made by ***, to contact ***, excluding his inspection in 2011, which is believed to be brought on by supplier *** in 2010.The *** home was purchased in This home's supposed deplorable conditions were never noted in the home inspection report required at time of home purchase, which it passed with no issues noted.In this reply, please refer to the following documents:An email from *** stating his claimed "warranty for as long as the occupant lives in the house or until home is sold" as he originally informed *** at time of window order and purchaseIf *** does not offer this form of warranty then why does he include this statement in an email with regard to his work and warranties? *** was o be on the site while job was under construction, this never happenedResponse from *** Window and Door's Attorney stating that the *** Window and Door Investigator inspection of the windows that were installed improperly, notably, as the *** Window Investigator stated (as stated in ***'s response to the 93A (see section B) filed against *** by ***, and since filed with Revdex.com by ***)The *** Investigator noted that there was failure to apply any silicone sealant to perimeters of the subject windows (including between (a) window and trim and (b) trim and clapboard, and a failure properly to secure wood trim around windows, such that the trim has separated and created points of access for water to enter the home*** also installed window sill trim upside down turning what should be a water shedding device into a water collecting deviceIt is contended that due to massive water leaking, due to improper window installation, as stipulated by the *** Window and Door Investigator, throughout all windows installed in *** home, is most obviously the cause of all water leaking and flooding issues experienced in *** home since new window installation took placeA licensed engineering inspection/evaluation, along with a construction appraisal to repair all damages has been completed, and available if needed(not included).Please note that the only deplorable condition of this home stems from damage caused by the work performed by ***Case in point, the farmer porch covering front door which leaks water over front door header beneath actual roofing, not under any circumstanceDuring a hard rain leaking becomes waterfall like as water seeps into roof line, through overhead ceiling, coming from second floor side window of bedroom and bathroom, used by the children (please see already submitted videos sent to Revdex.com)This was never a problem prior to the new *** windows being installed by ***The home is in need of paint at this time, which was/is ***'s next step toward improving his home, however at this time it fiscally makes no sense painting home until all windows are properly installed, allowing trim to be painted, acting as an additional seal/shield around window frameSeveral painting contractors have quoted job, after windows were installedTo date, no painting contractor will/will warranty their work for any length of time due to issues of constant wet wood stemming from improper window installationThis in turn causes paint not to adhere properly, in turn creating a constant peeling of paint, hence why no contractor will warranty.*** has spent to date over $20,000, above costs of windows and installation, in repairing home to cease flooding of basement, due to improper window installation and the heavy rainfalls of The only neglect has come from *** not being able to financially continue to repair any more of his home due to his disabilitiesThere was (is) constant concern of mold with concern to ***'s children, and the continuing and mounting damage to the building structureRepair will erase evidence of ***'s poor workmanship which he is in total denial ofAs in accordance with ***'s warranty, if *** sold his home today, the alleged *** window warranty would no longer be availableThis has forced *** to hold on to his home until some resolution can be metIf home is placed on the market today, *** stands to lose a potentially large sum of monies due to damage incurred from ***'s poor workmanship*** states that the *** home was in deplorable or neglected condition *** contends this as inaccurate, with exception of damage done after ***'s improper window installation practicesCosts are now exceeding in excess of a $130,000, far exceeding ***'s price quote of roughly $28,for new windows (basement, first, and second floor) purchasedThe repair costs could have been significantly reduced if the problem was addressed, and resolved properly, when *** first made contact with *** regarding his promised warranty*** made numerous attempts starting in 2009, one year after *** installation was completed, excluding the yet installed basement windows and door, one more reason *** was trying to get in touch with ***Meanwhile, the repair of damage costs, continues to increaseIn keeping with his obvious work and contractual ethic, *** also neglected to install the basement, replacement windows and cellar entry door and frame that *** was paid in full for, hence never fully completing the job he was hired to do.*** was offered at time of accepting job, full payment, based upon Mr*** being led to believe, during placing of order, that *** was in fact the "certified installer" of *** Window and Door New England, a division of *** Window and Door (according to ***/*** Window and Door this was never the case)*** acted with deception in order to get order placed for his install*** Window New England salesman (no relationship to *** Window and Door New England) Doug Handfield, was in fact not from *** Window and Door, as *** was led to believe, but from a subsidiary of Lynx Windows (see *** 93A response) called *** Window New England, intentionally deceiving and misleading consumerNeither the sales companies statement pertaining to *** being an *** Window and Door "Certified Installer," or the installer, ***, were "certified" solely to install *** Window and Door products, as *** was led to believe at time of purchase, and throughout installation process***'s initial down payment was enough to cover all costs of windows purchased at time of order being placedHow *** decided to spend those funds is not ***'s responsibility*** did have to pay additional money on ***'s behalf, to *** Window and Door New England, when truck came to deliver last shipment of windows for first floor*** had to speak with *** Window and Door accounts receivable department in order to get windows released for delivery, however only after *** gave check to driver, on behalf of ***'s payable account with *** Window and Door.*** is 100% incorrect in his statement that *** first notified *** in August of 2011, as he is also incorrect in his statement that the leaking is caused from neglect and deplorable conditions to home prior to window installation taking place, as *** would like all to believeIt is contended that if there is any deplorable or neglect in regards to the *** home it is a derivative stemming from the water damage caused from window installation work performed by ***This damage will further not allow for paint to protect wood clapboard, and trimWith wet wood comes insects, dry rot, and a severely dangerous mold concern within the parameters of the house structure, occupied by children and adultsWater seeps between the walls from perimeter of all windows creating the perfect environment for mold spores, as noted by construction specialist and also apparent within the home.Mr*** notified *** via email, and phone calls, on numerous occasions, leaving message explaining that he was having at first, leaking above some of the kitchen windows prior to *** had sent pictures directly to *** several times*** most likely has not seen most recent state of damage in photos and videos*** did not, and would not, respond to *** only contacted *** after an ***/*** window representative contacted *** to investigate the leaking problem*** only contacted *** once, by phone in early August of 2011, stating that "he had no idea how bad the damage was," obviously visible from the pictures sent to him, this time from an *** representativeIn ***'s walk through in August 2011, *** not only "apologized" to *** for the improper installation, but also stated "he (***), and his son in law, would return in two weeks, or less, to repair all damage so leaking and wind drafting does not continue or occur," causing escape of heat during Winter months*** told *** that he would be installing all basement windows and cellar outside door and frame at time of return, which had already been paid for by ***, but has yet been installed*** states, as a professional at installing windows, he has never had one window leak in his year career, when it is clearly evident by professionals within his own field, stating that all windows installed by ***, were in fact installed incorrectly and continue to be the source of leaking, and the cause of obvious, and continuing water damageProfessionals involved in the window/building industry disagree with ***'s perspective when they state that there was more than just one essential step missed in proper installation of all windows installed in *** home(see section B of the response to *** by *** Window and Door on 93A response)When a "certified installer" places all window sills upside down, one has to question his company's expertise, leading doubt to ***'s claim he has yet to suffer an improperly installed window in his years.***'s basement flooded due to improper installation of windows (backside of residence) during spring rains of 2010, causing great loss of possessions owned by ***'s deceased wife and parents, along with many of his own, and his children's, possessions (televisions, toys, furniture, and furnishings in ***'s finished basement, and storage areas)When deducing point or water entry of flooded basement in 2010, it was noted during deconstruction to repair back of *** home, that the wood trim around kitchen windows and clapboards were tacked only to tar paper and two by fours, while plywood was eliminated (not proper procedure), eliminating plywood that should have been present to decrease leaking potentialThis was a major point of water entry into basementIn 2010, *** had all plywood, tar paper, clapboards and trim replaced, from top of second story windows to foundation, replacement of structural beam, in stages of rotting due to constant water supply leaking from windows allowing water between interior and exterior walls around window structuresThis was done to cease all basement leaking known at that time, so basement did not continue to leak or windows or windows continue to leakAll plywood under existing clapboard at time of replacement showed extensive water damage caused from improper window installation (dry rot noted most heavily around window perimeter, expanding outward) needing replacement to avoid further issuesThe *** home never had a wet basement, or leaking within any part of home prior to the installations of *** Windows and Door product, installed by ***.In closing, there has never been any water leaking issues in the *** home, as proved by home inspection at time *** purchased home and not noted by *** at time of accepting jobThe response to *** 93A states all discovery by *** Investigator, with regard to the installation process, which emphatically states there were many problems with the window installation performed on *** home by ***Said damage and improper installation is instead pulling water into the *** home with each precipitation (rain or snow), causing more damage each time*** again made many attempts to resolve this issue in a gentlemanly manner on many, many occasions*** misrepresented himself, stating he was the "Certified" *** Window and Door installer, not true or apparent from ***'s finished workLastly, the email attached sent from ***'s email address states his obvious answer of warranty offered by *** to all when inquiring about purchasing windows, or selling his jobs*** would like to extend to Revdex.com the offer to come and inspect all damage for themselvesWe believe that you will find this home, (with exception to damage caused by window installation) in very good shape.Thank you for your time in reviewing this information, as your
