Mr. [redacted] has asked that I please respond on his behalf to the complaint of Mr. [redacted].  That said, be advised Mr. [redacted] categorically denies that he failed to properly install windows at Mr. [redacted]’s home, or that the damages complained of by Mr. [redacted] are in any way attributable to defective installation by Mr. [redacted] or his agents.  Mr. [redacted] has been installing windows for in excess of forty years and he can say with a good bit of pride that he has never had a window leak as a result of  defective installation.In this particular case, when Mr. [redacted] first met with M. [redacted] at his property in Westwood MA, in the fall of 2006 he observed that the property was in deplorable condition resulting from an obvious neglect to properly maintain the home.   Specific reference is made to the siding, or lack thereof, the roof, and apparent improper flashing in various areas, most notably to a bump-out addition to the kitchen that has been done by other contractors.  However, despite that the house was in need significant repairs, Mr. [redacted] is a window installer and that is exactly what he did.  Install the windows.  He was not engaged to do any work other than the windows.  He performed that service in a good an workmanlike manner.Actual installation was delayed for a good period of time because Mr. [redacted] could not pay Mr. [redacted] for the windows until he was in receipt of some disability check Mr. [redacted] continually referenced.  This put Mr. [redacted] in a rather tenuous position with his suppliers who were looking for payment.  Nevertheless, the installation was completed by Mr. [redacted] in early 2008.  Subsequently, Mr. [redacted] did not hear from Mr. [redacted] until August 2011 when he contacted Mr. [redacted] requesting that Mr. [redacted] come over to inspect the windows to see if they were properly installed.  Mr. [redacted] was complaining of water leakage into his home, and he was suggesting that it might be caused by the windows.  When Mr. [redacted] visited the home, contrary to the assertions of Mr. [redacted], he did not acknowledge in any way that the windows were leaking.  What he did observe however was that the house was in the same condition of neglect that it was back in 2006, and perhaps a bit worse.  Also, Mr. [redacted] never advised that the windows and the installation were warrantied for life.  After that meeting in August 2011, Mr. [redacted] never returned to Mr. [redacted]’s home, first, because the windows were properly installed, and perhaps equally important, because it was clear that Mr. [redacted] was insistent on heaping all of his issues with his home on Mr. [redacted] and  the windows, when it was clear the causes thereof, for whatever reason, were attributable to work performed by others, and by Mr. [redacted]’s failure to properly maintain his home.Interestingly, in his letter to the BBO Mr. [redacted] lays out a litany of issues, but he fails to articulate exactly what Mr. [redacted] did,  or failed to do.  In any case the work Mr. [redacted] was  hired to do was done professionally  and in a workmanlike manner and it is unfortunate that Mr. [redacted] seeks to anoint Mr. [redacted] the scapegoat for all of his woes.  As such Mr. [redacted] respectfully requests that he retain his accreditation with the BBO.[redacted]By His Attorney
