I am rejecting this response because the response is untrue/invalid as shown below:1. "Mike Lopez Roofing, LLC does not have any records reflecting this persons roof concerns. We did not receive any calls, fax's, emails or a letter via USPS. Our computer data-base does not reflect this complainants name."Complainant's response:> A certified letter stating the roof is leaking and requesting the warranty be honored was sent by complainant on 15 Oct 2014 to Mike Lopez Roofing,LLL, [redacted] a copy of the Warranty Bond attached. The letter was received by Mike Lopez Roofing, LLC on 21 Oct 2014. I have the Domestic Return Receipt (#[redacted]) signed by Mike Lopez. (See attachment #1.) Therefore, I have the proof that the letter was received by Mike Lopez Roofing, LLC. No response was ever received by complainant.>As proof, I have kept the call logs of my calls to Mike Lopez Roofing, LLC. In addition, I called Mr. [redacted] M. Lopez's cell phone once. Mike Lopez Roofing, LLC never returned my phone calls.>As Mr. Lopez is aware, the name of the owner of the residence is not warrantied, the residence is warrantied, as stated in the Warranty Bond: "... the building known as the Residence at [redacted], Santa Fe, New Mexico 87505...". In addition, the Warranty Bond states: "This warranty is-ONE TIME TRANSFERABLE AND IS THE EXCLUSIVE SOLE REMEDY TO THE CONTRACT." I purchased the said residence from the original owners. Therefore, stating that my name is not reflected in the computer data-base of Mike Lopez Roofing, LLC is invalid. (See attachment #1.)2. "We require as per our legal contract and all warranty issues or concerns, to be put in writing and mailed to our company."Complainant's response:>Per the Warranty Bond, a certified letter stating the roof is leaking and requesting the warranty be honored was sent by complainant on 15 Oct 2014, [redacted] a copy of the Warranty Bond attached. The letter was received by Mike Lopez Roofing, LLC on 21 Oct 2014. I have the Domestic Return Receipt (#[redacted]) signed by Mike Lopez. Therefore, I have the proof that the letter was received by Mike Lopez Roofing, LLC. (See attachment #1.)3. "I personally would like to view and evaluate said roof system and take care of any issues immediately."Complainant's response:>I sent the Warranty Bond required letter and followed up [redacted] phone calls to Mike Lopez Roofing, LLC in OCTOBER. TWO MONTHS have passed [redacted] no response from Mike Lopez Roofing, LLC, until now. Therefore, I had no other choice than to have another roofing company evaluate the roof, remove the original roofing, replace the roofing (at a cost of $9,400.00-see last past of attachment #1). The roof was leaking and has been for some time, as stated in my certified letter. It is too late for Mike Lopez Roofing, LLC to state that they will take care of any issues. They already did not honor their Warranty Bond.>The other roofing company I hired performed an evaluation and determined that the roofing leaks were due to poor workmanship performed by Mike Lopez Roofing, LLC. I have pieces of the original roof applied by Mike Lopez Roofing, LLC. I will be glad to provide Mr. Lopez [redacted] a piece of it, so that he can see the numerous holes and gravel in the material. (See attachment #2 for a scan of the material, showing holes and gravel.) It is too late for Mike Lopez Roofing, LLC to honor their Warranty Bond. That is why I want the original amount paid to Mike Lopez Roofing, LLC ($4,000.00) to be returned to me to help off-set the cost of removing their original roofing.[redacted] [To assist us in bringing this matter to a close, the consumer must give a reason why they are rejecting the response. Sorry that you and Mr. [redacted] continue to have issues with your spray polyurethane foam roof system that was installed by us in 2009. It is not our intentions to disappoint you. Please understand that we would like to make good on...
these issue and due a complete roof restoration of the existing SPF system at a deep discounted fee. I propose to do a complete preventive maintenance and re-coating your roof with Gaco Western Silicone S20. I will then provide you and Mr. [redacted] a new 16 year roof warranty. Gaco Western will also warranty the roof materials side for 50 years. Please let me know if can send my SPF roof-techs out tomorrow morning to address any ongoing leaks or issues. About the current roof warranty we can not continue warrant because the previous owner(s) negligence on not performing deferred roof maintenance and not paying to transfer the warranty into your names prior to closing, which has been our police for 42 years. We truly want to resolve these roof problems and it is our goal to ensure a quality roof system. You and Mr. [redacted] concerns are very important to us. Please let me know what your decision is?
