Hello *** First and foremost I would like to mention that I have been successfully operating *** *** Landscaping for over years without any complaints, EVER! I have not advertised for business in over years and that is do to my impeccable reputation and word of mouth through
successfully conducting an honest business*** *** first reached out to us in and at that time I was just too busy to squeeze her into my schedule, but promised I would handle her project early Spring of When I contacted ***, I mentioned since I was unable to get to her project last year, I would work with her on the numbers and help her out all I could to make up for not getting to her in the fallShe had scheduled Pantina Landscaping to completely landscape the front of her house and mulch all back beds, and replace white pines which she had lost from ANOTHER landscaperAfter meeting with her several times at her house and at my nursery, she informed me that her husband is getting transferred and they were moving to another state and that she would not need my service for the re-landscaping of the houseShe only wanted new pines planted in the backyard, beds mulched and front walkway power washedAt that time, I said I would power wash and re-sand front walkway at no charge, which I completed personally myself as well as trimming all existing shrubberyAt that time I verbally and clearly mentioned I will plant the trees for her at a "savings" as if I was planting them for a relative and give her the same deal without a guarantee, and I assured her I would still plant these in the same manner with screened top soil and peat moss, which we did and said the Rest is up to her to keep them wateredAll three trees were of perfect quality when delivered and planted( I have detailed photos of the trees being planted as well as picked up from the nursery, "I phones" are the best tool !) It is clear that they were not properly watered throughout a very hot and humid seasonThe nursery, that these trees were purchased still have several from the same lot above ground sitting in the yard in perfect healthI mentioned in an email to *** that the trees again were never guaranteed but I would work with her to replace them and at that time started to locate a deal on some white pines for herAll of my landscaping when a guarantee is included in the project it is Always, always in writing! I am rejecting this response because:
The history of his business is not relevant and just reflects as an attempt of "salesmanship" to the Revdex.comOnly the facts of this case matterWe did reach out to him in 2013, and we had to follow up with him a few times before he said it was "too late" in the year to do the work we were planningThis should have been a warning to us, but we gave him another chance as he was very apologetic and offered a bit of a discount to make it up to us if we did the work in early 2014.In we had to contact him again to begin discussing the work we wanted doneWe had originally planned a bigger project, but decided to scale it back which is entirely feasible at the discretion of the clientWhile the reason for our scaling back the project is not relevant, I will point out that he is not being entirely truthfulWe never told him that we were movingWe told him we might be moving, but that we may contract him later for additional workIt is the additional work that, if contracted, may have been provided at "friend" rates, but the mulching and trees were paid at regular rates. We agreed to have him mulch and replace three white pinesThese are three trees in a set of trees that were all planted years ago, and the other trees are thrivingSince these trees had died, of course we wanted a warranty just in case something happened again! *** *** assured us that he offered an unconditional guaranteeWe've had other landscapers offer a conditional guarantee, so we confirmed this point with MrPantina on several occasions.There was no verbal agreement that the trees were without warranty, and it is clear that we paid market rate (including warranty) for installation of this type of treeWe paid him $per tree, which represents a markup of 100% of his cost of the tree to account for labor (his markup rate was clarified by him to us via email)A call to any local nursery will confirm that retail "non-landscaper" rates for a similar tree is $325, with landscapers paying less at a nurseryWe had also received other quotes to plant the trees with a similar quote of $with warranty.Mike Pantina also is confused about how the trees diedHe has stated in a separate email to us that they died from too much watering, and now says to you that they died from no watering? In any case, the reason for their dying is not relevant as the trees had an unconditional warrantyMrPantina has to acknowledge (as he has done to us before) that any plant that is transferred can undergo stress that will cause it to die, through no fault of the client. We contracted for market rate work with a full warrantyI would ask MrPantina to provide a signed, completed work order stating that no warranty is includedWe would also ask that he provide a bill of sale to confirm his price of the trees, as he claimed in an email to us that the $was his cost for each tree and he did not do his usual 100% markup which I believe to be factually incorrectHe makes it clear that he documents everything in his business, so it should be easy for him to provide this information if what he saying is factually correct.

If you are looking for only the facts, Bottom line, only the facts...the trees were NOT guaranteed, had they been guaranteed, it would have been IN Writing.1) They were quality trees planted properly and professionally.2) They were kept alive above the ground in the nursery prior to planting and there were some of the same plants from the same growing field that were sold above the ground at the nursery after the [redacted] were planted.3) This leads me to believe that they were negleted either over watered or under watered on the [redacted] property.4) Please review my 35 year successful track record of plantings with not 1 single issue or complaint ever!If the trees were quarenteed I would have simply replaced them!

Review: Mike Pantina planted 3 trees at our property in May of this year, one of the trees died, mike has been contacted on several occasions regarding honoring his one year warranty on the trees and he is unwilling to replace the tree under the warranty.Desired Settlement: The trees were planted at a cost of $500 each, we would like the tree replaced under warranty or a refund of $500.
