Refuses to fully refund on a service that was not rendered.On March 10 2014, I paid for 2 [redacted] tours ($190) scheduled for Monday, April 28. Due to the weather conditions of the tornado, [redacted] called me an hour before pickup to cancel and try to reschedule for the following day in hopes the storm would pass. Tuesday morning at [redacted] A flash flood watch was in affect for the [redacted] region and was active for 11 hours. After seeing the destructive conditions all over the news, the threats, and being advised from meteorologists to stay away- I cancelled. I asked [redacted] to refund my credit card and he refused. There is no contract agreement on his website that states all sales are final and would like a full refund for the services that were not rendered. Desired SettlementRefund of $190 for services not rendered.Business Response I offered to[redacted] a refund of half the price of the tour (for two people), $95, but she has not accepted that. I have not paid it yet. I did not cancel the tour to[redacted] on Monday, April 28, I postponed it to the following day. We do 30 to 50 tours of[redacted] from [redacted] a year. We are well acquainted with the travel to and from, and with the[redacted] area. Typically, we leave [redacted] about 9 AM and arrive at the [redacted] Birthplace an hour and a half later. After allowing our customers to see everything the Birthplace Park offers, we then eat lunch and visit other places in the town which were a part of [redacted]' life. We depart[redacted] so that we return to their [redacted] hotel(s) by about 5:30 PM. On Monday, April 28 I asked[redacted] to postpone the tour because of the warnings of possible severe weather in the [redacted] area, in the counties between [redacted] and[redacted], and in[redacted]. This is very rare for us, we have postponed a tour only two or three times. Of course, a tornado did strike[redacted] that day. I do not want to minimize the damage suffered by people who were in the direct path of the tornado. News reports after the storm did show considerable damage to homes and businesses, and one death was attributed to the storm. But[redacted] is a city spread out over a large area. That tornado did not damage the entire city at all. In fact, the management of the [redacted] Birthplace posted on social media that the storm did not damage the Birthplace of [redacted]. This was good news to [redacted] fans worldwide, and to ourselves who transport fans to the Birthplace. The actual storm damage was three to four miles from the Birthplace or most locations in[redacted] associated with [redacted]. On Tuesday, it was clear from messages and phone contact that[redacted] was upset by the tornado. I am not sure what meteorologist that she consulted. But she cited the announcement of a flood watch as another reason not to go on Tuesday, April 29. A flood watch is not a flood warning, nor is it a severe storm warning. It simply indicates the possibility of heavy rains causing some flooding in the area. The weather forecast for [redacted] was clear. A closer look at the[redacted] weather forecast for Tuesday April 29 showed that rain showers would not begin until 3 PM. I assured[redacted] that we could leave [redacted] in the morning, arrive at[redacted] an hour and a half later. We could then step inside the most essential places of the[redacted] tour; the Birthplace park,[redacted] Hardware, and [redacted] In, and then leave[redacted] before 3 PM.[redacted] refused to go. Because their flight left early the next morning, she missed her chance to do the[redacted] tour. We did in fact go to[redacted] on Tuesday April 29 and complete the tour with another customer. The weather was clear in[redacted] through the time that we departed, at about 3 PM. Our friends in[redacted] were happy to see us. Days later the visitors Bureau there posted a message that 95% of the restaurants in[redacted] were open for business, and they encouraged travelers to continue plans to visit the city. I wished that[redacted] would have traveled with us on the 29th; there was no physical reason for her to refuse to go.
