Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, detai** of the offer I reviewed appear below.In response to Mike's Repair's last rebuttal, nothing of mine has changed. The original question to start is simple, did Mike's Repair ask me to try and find a local welder to fix the hydraulic ram of the loader, as it would save money on transportation? The answer is yes. Did I tell [redacted] that no one would touch a warranty hydraulic ram? Yes. Did [redacted] tell me that he had a friend in Green Bay Wisconsin that might be able to weld it? Yes. Did [redacted] Tell me after nearly two weeks of no contact, when I called him, state that his friend's son had answered the phone and explained to [redacted] that his father had passed away a year previously from cancer? YesIn just those facts above, that was [redacted] giving me authorization to have someone other than him take care of the Ram, in an attempt to save me some transportation money. I agree to that whole heartedly. But at no time in his attempts to have someone esle fix it, did he say that if HE doesn't do the work, then I may not be compensated. At no point was he persistent to be the one who wanted to fix it. When I spoke with him about finding transportation, at no point did he tell me he couldn't find any, he stated he would check with his drivers, but never got back to me. I called and ASKED HIM if I could take it to one of the tractor repair companies locally and he said yes. When I received the quote for repair, I called [redacted] and told him, we discusses how he thought it was high, but the warranty would cover it all except the travel. I agreed to that! That is why they had the authorization to fix from me.  Again at no point did he relay to me that I would be at risk of not getting refunded if he did not do the work. This was important to me as I needed that money back for bills! I even asked him when I submitted the claim how long before they send it back and he said 2-3 business days. Again never stating that it would not be covered or that there was any issue upcoming. As far as me using [redacted], there are only two companies up here that was recommended, the first, a [redacted] Dealer refused due to issues of payment from other dealers. The second place I went was [redacted], who said they would do it, but it had to be direct pay. As far as my judgment issues, I was under the impression the whole time that I was dealing with [redacted] as an honorable dealer, hence me driving over 2 hours to buy from him when there is another ** dealer 45 miles closer. I took it to that dealer to get fixed, because they were able to fix it and my primary dealer never said anything against it!! I may be off on the amount for transportation, but at no time was $750 discussed, but if it was, it still would have been cheaper than the $1490 I paid out of pocket, I mean really?!?!?! I will pay $1490 out of pocket for a repair, risk no or little money back for compensation, then hope for a return, or pay Mikes an alleged $750 for transportation and have no other bill? I was able to comment on his repairs due to the fact that he stated that he had never had the leaking issues before, but had dealt with a ram issue years ago. [redacted] offered me the monies paid by ** warranty of $300 and change initially toward the amount I paid out, then after a week offered another $200 on top. I spoke with ** Tractors USA on numerous occasions who stated that the issue iw between me and [redacted], but they stated that [redacted] told them that this issue was settled. ** was surprised to learn that [redacted] had not paid me the money for reimbursement that they had already given him. I never told him I wasn't taking that money, I stated that it was not the full amount. Everything that [redacted] states is the exact opposite of what originally was stated by him. He misrepresented the truth in this entire repair process to me, as well as to **. As I stated before, he was very adamant during our first encounter about the bill(yes the one where I was very upset and cussed because he had lied to me) that no matter what I do, don't call ** because they could refuse to pay since HE didn't do the work. This is why I called ** Tractors!! I am requesting the Money from ** tractors that was paid to him, as well as copies of all warranty work that submitted to keep with my tractors records. I had arranged for him to take the filter money that he claimed I never paid him (it was suppose to come out of the warranty money). Since this last accusation, I have mailed those funds in a certified letter to his business. [redacted]

On approximately 8-7-15 [redacted] called me and stated he had a small, pinhole leak on oneofhis tilt cylinders. I asked for and received a picture of the area in question and called himbackon approximately 8-11-15. At that time, I presented him three options for repair. He couldhave the whole tractor...

brought in and I would weld\repair the cylinder as needed. I quotedhim $600 round trip transportation to haul the entire unit, not $250 as stated in the customerscomplaint and stated it would be seven to ten days before repairs could be made due to ourbusy schedule at the shop. He could remove the cylinder and ship it back to me for repair ashe is located about three hours from my shop. He expressed a deep desire not to returneitherthe tractor nor cylinder to me unless I would cover all transportation costs in either case.Being as this is a warranty situation, I told him I could not do that. After a few days, hecontacted me again and the conversation turned to having someone local weld\repair thecylinder. I did advise him that if he had someone he was confident in to weld it, I wouldattemptto make things right between him, I, and **. He then had a competing local dealer pick up thetractor on or about 8-17-15. I believe it was at this time [redacted] contacted me again about ahydraulic oil leak at the rear of the tractor. He stated that the dealer he took the tractor to hadfound the source of the leak. I attempted twice to make contact with the person at the dealerwho's name I was given by [redacted] with no luck and no return call by anyone at the dealership.During the week of the 17th, [redacted] contacted me several times about the issues with histractorand on approximately 8-20 or 8-21, [redacted] called to state the source of the leak was a lack ofsealant on the right, rear axle housing. At some point, [redacted] advised the dealership where thetractor had been taken to make full repairs to the tractor. He did stay in contact with methroughout and I did advise him that I would do everything possible to assist even though hehad decided not to bring the tractor to me for repairs as was my recommendation throughout.On 8-29-15 I received a fax copy of the invoice [redacted] had paid the local dealer for the repairsand submitted a warranty claim on his behalf through proper channe**. This was the first timeI had any idea of what amount the repairs were going to cost. The warranty with theaforementioned claim number was approved in the amount of $321 late last week. Per aconversation I had on 9-14-15 with the customer, he for a lack of better terms"flew of the handle" at the amount of the difference between what he had paid the outsidesource for the repairs and what was covered by **. Name calling and threats of legal actionwas all that was directed my way when I attempted to explain the situation and have ameaningful discussion with [redacted]. Over the next several days, I did offer [redacted] an additional$200 over and above what was covered by ** under warranty in an attempt to rectify thesituation. [redacted] has changed his story three or four times about the events that have takenplace in what I believe is an attempt to pit ** employees against one another. He has beendishonest and I believe chose to take it to a dealership where he has a friend in the servicedepartment in an attempt to extort monies from either ** or Mike's Repair. Review: I purchased a ** 4040 Tractor from Mike’s Repair Service. The tractor was brand new and fully covered under the warranty. After a few months of owning it, I noticed a small hydraulic leak on the right side loader ram hydraulic cylinder. The leak was coming from the welded joint. I a**o noticed hydraulic oil leaking from the right side rear differential. This was due to a lack of sealant at the manufacture I contacted [redacted] from Mike’s repair and told him about the problems. He stated that is was warranty items, and that it can be fixed. We discussed the cost of him coming from his store to my home to pick up the tractor as expensive. He then recommended that I try to find a friend or welder locally to fix the hydraulic leak on the ram. When I asked about getting a new ram, as it is a new tractor, he stated that ** will not replace the ram unless they try to fix it first. I told him I understood, but thought that was wrong. I tried to find a local farmer or company to weld the ram, but no one would touch it. They cited that it was under warranty and did not want to be held accountable if something went wrong. I called [redacted] back and explained this to him. He stated that he had a buddy that was a welder in [redacted]I, and he would contact him to have him come fix it. This is now nearly 6 weeks since I reported the leak. After waiting for nearly 2 weeks, I called [redacted] about his friend the welder. [redacted] stated that his friend had passed away a year ago, and that is why he had never returned his cal**. At this point, I told [redacted] that I really need to get this fixed, and what was our next step. He explained that he would get with his drivers and see if anyone would be making trips up north that he could se t up a ride. Two weeks later, I had not heard from [redacted] so I called him back. I asked him if I could take it to [redacted] to have it fixed. [redacted] is a highly respected tractor dealer and maintenance shop. He stated that I could. The only things [redacted] told me, was that he would not reimburse me for any mileage I was charged by them to come and get the tractor, as that is not cover3ed under warrantee work. I agreed and understood. I contacted [redacted] and spoke with [redacted], the [redacted]. They came and picked up my tractor. [redacted] called me and said they could fix it all, but the ram they would send out to a professional welder, as this was a high pressure cylinder. At that time I called [redacted] at [redacted] and relayed the information to him. I a**o gave him [redacted]’s number to [redacted] twice, to which he stated he would call. [redacted] called me to inform me that he never reached out). Once the repairs were fixed, I paid $1521.94 for all of the repairs and travel. I then submitted the remainder of the bill, $1334.94 to [redacted] and Mikes Service to be covered under the warrantee as agreed. [redacted] stated not a problem, and that it should take 2-3 business days to get the money back. One week later I called, since I had not heard from [redacted] stated that ** Tractors only agreed to cover about $300 of the repair citing that I was over charged. [redacted] and I got into a verbal altercation, with him stating “I never told you to take it to [redacted], I told you I would have rather done the work here” This is a lie. After more arguing he stated that he knows I am upset, but do not call ** and report this to them, as they will not cover even the $300, if they found out that he did not do the repair work. This lead to a even longer argument. [redacted] then told me to hold on, and that he would call a “buddy” at ** and try to get more money. I then spoke with the president of ** as well as the sales distributors, who all stated that they have problems with [redacted] fixing peoples tractors under warrantee and that they would tell him to pay, but could not make him. On September 17th, I spoke with [redacted] and he stated that he would pay an additional $200 out of his pocket, in addition to the $330 from **, but no more. Today he confirmed that I would need to do what I need to do, as he was not going to honor the work completed. [redacted] stated that there is no way anyone could have completed the work in the time frame that ** stated it had to be done, there is a 5 hour difference in time. [redacted] owes me $1334.94 for approved warrantee work on my tractor.Desired Settlement: I want my $1334.94 that he owes me for money I paid for warrantee work. He keeps saying that he told me he wanted to fix it, but I didn't want him to drive it....that's a lie. it would have cost me $250 for him to come and get it, why would I pay $1500 out of packet but not pay him $250 to come and get it?!?!?!?
