Initial Business Response /* (1000, 5, 2015/07/27) */
The loan in question was closed in MayThe borrower had made her May paymentBased on the information that we received from the lender, the payoff they were using did not include her paymentThe payoff showed that the May payment was still
dueAccordingly, the expectation was that the May payment would refunded to the borrower after closeThis was communicated to the borrowerAfter the loan was closed, the escrow refund did not include the May payment as expectedWe spent a lot of time clarifying the situation with the lenderThe bottom line was that the May payment had been included in the payoff the lender used despite the payoff showing that the May payment had not been receivedThis is why the payment was not refundedThe interest rate was correctThe savings were correctThe payoff amount was correctThe borrower received full credit for her payments and was able to skip one paymentHowever, she was not able to get her May payment refunded like we thoughtOnce this was determined, it was communicated to the borrowerWe certainly apologized for the situationHowever, we felt that the issue was based on confusion caused by the lender payoff, not because of anything we had done or had any control overWhen the borrower was not satisfied with the response, she was referred to our branch managerThey played phone tag and exchanged emails over several weeksRecent emails from our branch manager asking for a good time to discuss the situation were not returned
Because the borrower has refinanced her loan again, all commission earned by our company will have to be returned to the lenderWe will receive nothing for the work that we have doneIf the borrower were to receive a payment refund, it would need to be added to her current loan which would be up to the lenderIt is not something that we have the ability to do
Initial Consumer Rebuttal /* (3000, 7, 2015/08/03) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not except their response because on up to the day of closing, I repeatedly asked the loan officer if the May payment was included, and if I would receive it back, and he assured me that I was, but I did not receive the refundThe payoff did include the May payment, and the payoff that they were given was not a difference of $1137.00, which was the monthly amount of the Mortgage paymentI made the loan officer aware of the fact that I had made the May loan paymentI made the May loan payment on April 30, 2015, he did not receive the payoff until May 8, That is why I kept asking the question of would I receive a refund of May payment, and the loan officer (*** ***), insured me on up to the day of closing (in writing and telephonically) that I would get the May refundI tried talking to his manager prior, with no return phone callWhen I received a call from the manager was after I left them a message stating that I was going to report them to the Revdex.comHe then left me a voice message stating that he wanted to hear my sideI returned his call only to receive his voicemailI left him a message saying that the only thing that needed to be discussed was when I could expect to receive a refund of my May Mortgage paymentThe only reason that I refinanced my Mortgage from the very start was because I was promised months with no Mortgage, and a refund of the escrow, it was appealing to me because that would afford me the opportunity to finish making much needed upgrades to my homeHad I known that I would not get the months worth of mortgages, I would not have refinanced with this companyThe fault does not lie with the lender, but with Military Mortgage Un-Professionals*** ***, never told me when to even expect to closeLooking at the situation in hind sight, because I had already made the My payment, which he was aware of, I should not have closed until JuneI am deeper in the hole, because I had to in turn go with another company to refinance again in order to finish up the repairs in my home that had already been startedThere was never even an offer of apology from that companyIf I was wrong, I apologize, but I did make *** *** aware of the fact that I was going to file a formal complaint because I did not receive in full what I was promised, they cost me money, also, I am not a satisfied customerIt is irrelevant whether they receive Commission or not, you are the Company, you are insured, I am a lowly consumer with a lot to lose, and I just paid dearly, and all I was trying to do was fix up my homeIf this is how you treat a disabled veteran, thanks, but no thanksI will take my business elsewhere
