I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below I tried again all I am getting is when I try to send my reply is an error saying it is not foundI am sending the letter I made in response to rejecting what mill street auto saidthe rtf file is from doing several compression tests on the car and the pictures are from when the "new" radiator failed before the tow truck picked it upI found it odd that I am being blamed for breaking it when I was driving down the roadOr that no one I have talked to has ever seen something like it happen beforeI only tried this route because of how things have gone and the fact that in under 7k miles I am now looking at having to replace a car engine I was not the only person that smelled a gas smell in the car other people that rode with me smelled it as wellIt only happens when the car is above 3/4th of a tank of gasWhen I had exahust work done this past winter [redacted] found fresh and old gas stains under the car when it was up on the lift near and under the fuel tankThe radiator in the car was not replaced a couple of weeks after first it was the thermostat was tired which did not fix the overheating issue then after the radiator was "changed"After the raditor was replaced the overheating issue was a lot more rare but did occur I even called the place that did the work and was told the radiator takes "time to get all the air out" which is a lie bleeding the cooling system does that or at least 95% of itAfter the issue remained and I tried to flush the system twice and changed radiator caps to see if that fixed the issue because the overflow was overfillingThen I was driving back from rome ny and the temp light came on so I pulled into a stewarts shop parking lot that was about ft after the light came on and opened my hood to find my radiator bustedI would like to know why and or how I am to blame for my radiator braking when it happened when I was driving down the roadI have talked to other shops and auto parts stores and even the local subaru dealership and being told I must have leaned on it so I broke it is bs to put it mildlySo after I was blamed and had to replace a supposedly new radiator again in under monthsI had a overheat issue again and found hydrocarbons in the cooling system this time so new head gaskets are needed again nowI was suggested to check the compression on the car so I was going to start it to warm the engine up and the car wouldn't start so I ran it on a cold engineThe results were bad to say the leastI am sending a copy of the results and pictures of the radiator Regards, [redacted]

The customer stated he smelled gas upon fill up and each time he came by with the vehicle there was no gas smellThen a few weeks later the radiator went badEven though the vehicle was over 100,miles at the time of purchase and there was no NYS Lemon Law Warranty, which the customer signed, we replaced the radiator and thermostat, put new fluids in it and the vehicle performed fineThe car was driven, idled, re-driven and there were no overheating issuesAt this time the garage looked for leaks, including gas, and found noneThe customer had no issues for monthsAfter months he came back and wanted a warranty on his radiator which had a crack on the topWe honored his request, because the part would have a year warranty from the manufacturer, and he took it the garage that had done the workThey took pictures of the radiator and forwarded them to the manufacturer who denied the claim because it looked like abpressure had been placed on the top of the radiator from an external source cracking itThey said it was no fault of manufacturingIt had also been noticed by the local garage that additional work had been done on the engine prior to the radiator issueThe customer or anyone who may have worked on the vehicle in the months prior to this point denies having placed undue pressure on the radiatorWe believe we have done due diligence in trying to assist the customer, even well outside of any mileage or timeframes stipulated in a Lemon Law Warranty, which didn't apply to this caseIn the case of Implied Warranty we have gone above and beyondWhen a customer takes a vehicle away we do not know how it is treated, or how far a customer may drive the vehicle after a problem arisesWe try to be fair and treat our customers as if we have purchased the vehicle

Dear ***, The problems with Mill Street Auto and my car are not being resolvedHe is only willing to pay for the repairs I have already paid for and not the repairs that actually need to be done soonI have now asked him to just take his car back and return my moneyI think this is fairI shouldn't be paying for repairs to a car that shouldn't have passed inspection when I bought itI just want my money back. What *** writes here is accurateIn addition, when we were repairing the window switch and muffler, we also replaced a wheel bearing that has started to make noise, she said, on her way down to the garage that dayWe replaced all of these items at no charge to her, although none of the repaired
items mentioned were under any type of warrantyWe get it, she just bought the car and it was the right thing to doWe also got her a year/mile extended care warranty at the point of sale that she evidently canceled just before her motor started making noiseWe spoke to her husband recently and he was unwilling to have the vehicle brought to us for assessmentHe did bring a $estimate to have the motor replaced from a garage of his choiceWe told him that unless we could assess the condition of the motor ourselves we would not write him a check for $We were willing to work with the *** although they were past the day and way past the mile threshold on the NYS Buyers Guide/Lemon Law warrantyAs you are aware vehicle in NYS that are sold that have over 100,miles do not qualify for this provision, it’s State LawHowever, as a good business practice we still put the warranty on the engine and transmission for the days or miles, whichever comes firstUnfortunately, the warranty had expiredYet, we get it, the *** had only owned the vehicle for daysWe were willing to work with them, they just had to get the vehicle to us for assessment...which they were unwilling to doAdditionally, since then they have now requested assistance from NYS Safety and Compliance out of Albany, NY and we are awaiting an inspection and a decision from themOnce this process is started we no longer have an interest in assisting the *** until a decision is rendered by NYS

Attached you will find a picture of the actual car with the fog lights working as advertised on our websiteWe have offered to pay for the broken strut mount, not the one that was not brokenWe understand that the customer has the choice to replace both at the same time and that is his decision
However, to expect us to replace one that is not defective is not our placeThe thermostat replacement is not covered under any warranty as it is not part of the engine or the transmission and is not listed as a covered part under the NYS Buyers Guide of covered partsTo be fair neither are strut mounts, which were not bad at the time of saleIf a check engine light is on when we purchase a vehicle, we fix it, not just reset itThe engine light was never on in this vehicle and as a matter of fact it had zero pending codes and monitors in the computerAdditionally, it had passed NYS Inspection the month prior to my customer purchasing it, which was done at a garage chosen by the previous owner, not usIt should be noted that my customer didnt contact me for almost weeks after the sale to note the strut mount and the check engine light so to claim it triggered or broke on the way home is unfairI would have called immediatelyThe customer was also informed that all warranty work must be brought to us for repair as in todays world there are too many scams and for as much as the customer feels frauded, it happens to us as wellThe fact that the fog lights work, as can be seen in the attached photo, and it is claimed they do not work, seems fishy to usTo address the neutral safety switch, the customer did know about it prior to the sale as he brought it to my attentionHe spent a considerable amount of time with the vehicle and at one point noticed it wouldn't startWe isolated the problem and agreed on a price that would be taken off his bill to satisfy himNeutral safety switches can be extremely intermittent, as was the case hereThe vehicle had started percent of the time prior to thisHe knew about it before the sale. ALL things considered, we get it....he lives hrs from us and he wasn't going to wait to have the neutral safety switch fixed or come backWe addressed it and he was satisfiedHe wasn't going to bring the car back to have these minor issues resolve as they were picked up on during his state inspectionAgain, we understandWe believe that we have made him a fair offer, we have offered to send him a refund check for $to cover more than half of his repairs, sight unseenWe really prefer and made it clear that the vehicle be brought back to us for COVERED repairs, which these are notAs a BETTER business though we are interested in a fair resolution

We were forced to take action and file a complaint with the Revdex.com and the DMV due to the lack of response from Millstreet auto . I attemted several times to make  contact with millstreet auto to address the issues. I even spoke to his wife and left a message with her, I never received a response.The engine issues have been documented by another garage prior to the end of my 30 days after purchasing the vehicle. The other issue that has continued and greatly affected the drivability of the vehicle is the sunroof. I have attached a list of the codes that are associated with the sunroof leaking.  Whether there is a warranty or not is not relevant as the issues with the vehicle should have been taken care of prior to selling the vehicle. The vehicle had an inspection sticker from Millstreet auto, how does a vehicle pass inspections with a hole in the muffler. Myself and my husband missed several days of work to deal with major issues with this vehicle within 24 hours  after purchasing it. We drove 60 miles one way on 3 separate occasions, on top of missing work, to have the same issue "fixed", the sunroof. Each time the auto shop did the exact same thing blow out the drain vents and apply silicone around the seal instead of replacing the seal. I stand by my request to have the vehicle taken back into the possession of Millstreet auto and a full refund.

I was miss informed by my daughter (the only one who drives the car) who didn't understand that they only work with the low beams. I apologize for that miss understanding. As for the other matters Mr. S[redacted]'s response is lacking in honesty. The engine light came on during the drive home. I don't consider this some 'odd coincidence' but only the result of a pre-existing condition which I believe Mr. S[redacted] was fully aware of. (please note that there have been other very similar complaints displayed on Revdex.com site about Mill Street Automotive vehicles) Mr. S[redacted]'s claim that the thermostat is not related to or part of the engine is incorrect as it was the cause of the engine light coming on, i.e. faulty engine component. The shock mount also broke on the drive home a further indication of the exceeding poor condition of the vehicle. I was advised by the mechanic who worked on vehicle that the other shock mount was cracked and due for almost immediate failure.  I find Mr. S[redacted]'s claim that the vehicle started 100% of the time prior to the sale to be completely dishonest. Failure of the neutral switch at the moment of sale was not yet another 'odd coincidence', as the switch continued to fail at least 50% of the time after we purchased the vehicle. The fact that Mr. S[redacted] had the car running when we arrived (he had been advised of our arrival time) is a further indication he was aware of the problem and was only hoping that it would not reappear until after the purchase.  Mr. S[redacted] was advised of these problems the next day, at which point he claimed he was not responsible for anything and that we must have "hit a pot-hole". It took two weeks to get the vehicle repaired as we live in a rural area and getting the car to and from a reputable garage is difficult and time consuming. It was at this point that I was advised by my mechanic that the vehicle has extensive rust damage to the frame, to the point of it being uninspectable. I have no doubt that Mr. S[redacted] will claim to be unaware of this problem but I would note that he went to great lengths to hide the considerable surface rust on the vehicle, the photos displayed of this vehicle were grossly misleading. I challenge Mr. S[redacted] to repost the photos of the listing, as compared to the photo (attached) taken the next morning of the car.   Also Mr. S[redacted]'s claim that we "spent considerable time with the vehicle" is false, as the vehicle WOULD NOT START and we had to spend close to an hour waiting outside in my heated car while Mr. S[redacted] spent time with another customer.  This vehicle has been nothing short of a nightmare for both myself and my daughter, if Mr. S[redacted] wants to resolve this situation he may take the (REPAIRED) vehicle back for a full refund.

They took pictures of the radiator and forwarded them to the manufacturer who denied the claim because it looked like abnormal pressure had been placed on the top of the radiator from an external source cracking it. They said it was no fault of manufacturing. It had also been noticed by the local garage that additional work had been done on the engine prior to the radiator issue. The customer or anyone who may have worked on the vehicle in the 6 months prior to this point denies having placed undue pressure on the radiator. We believe we have done due diligence in trying to assist the customer, even well outside of any mileage or timeframes stipulated in a Lemon Law Warranty, which didn't apply to this case. We have reimbursed [redacted] for the repairs required on her car. She was well past the 30 day or 1000 mile agreement that was put on the vehicle, however, we feel that it was the right thing to do. She obtained a quote on...

future repairs that the car may or may not need which she has asked us to pay forward. At this time we do not feel this is fair.
