I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.This is my response to the business. As a consumer I had an accident and thought I choose a reliable business to fix my vehicle. [redacted] gave me the run around about everything. The vehicle had to be fixed within at least 30 days and it took him almost two months to fix my vehicle. At this time I did not have any other means of transportation to and from work... etc. He promised several times that he would take care of the rental fees if I was to be charged in excess of what the insurance company covered. NEVER did he say he would take care of the fees if the insurance company were to reimburse him. He went with me to turn in the rental vehicle and paid with a check then went and put a STOP PAYMENT on the check which is illegal. I started to get bills stating that the bill was not paid so I contacted [redacted]. I was almost taken to collections which I have proof of all of this. I just paid the bill myself and have proof of this too. My lawyer instructed to try to have the insurance pay the fee since the business was not taking responsibility of what was owed. The amount owed was 612.33. I spoke to a [redacted] Insurance Agent 4/2 named [redacted] regarding this matter and he said that when trying to talk to [redacted] the owner of the body shop and getting a detailed information why it took so long to have my vehicle repaired. [redacted] stated that 1) He did not have enough workers to fix the vehicle 2) There were a lot of Holidays 3) Vehicle stat without being worked on. [redacted] insurance was generous to reimburse me $215.34 so the amount I am out now is $396.99. I am not trying to collect money from different sources which is what [redacted] said. I am only trying to recover what is owed to me due to his negligence.

Mrs [redacted] did bring her car for repairs to my shop , she was recommended by a relative . during the month of November, we were in our last 3 weeks of business in Spring Valley 91977 .  The inspector of the Insurance company , came over to the shop to look at her vehicle , see the damages, pay...

for the repairs. The insurance company made a 2 party check. My name and her name. I called her and recommended to take a picture of her driver's license  email to me ,we scan it , use the power of attorney stamp to endorse check and be able to deposit at bank .this is a procedure that has been in place for a long time , if she wouldn't have agreed, she would have    n otmailll me her driver's license . Ialso advised her II was going to be moving the vehicle to the new location. During the time of closin gthe business and moving I was taking some time offgoing back and forth between my second home I n Baja Mex and San Diego .In no way affecting her repairs on her vehicle .I have employee working on her car. When she would call me it was none of her businessi if I was in Mexico or San Diego .She was always welcome to come to the repair shop and look at her .No excuses .Her lying about me running a business out of,I don't know where does not make sense .Her insurance inspector came to look at the vehicle at the old address and new address . Her lying again .Don't make sense. I was sending her pictures of all the repairs as we went along with the repairs .We had aback order problem with one of her parts .I brought it to the attention of the insurance, why , because she was in a car rental , her time was running out   , she needed to return the car back. I told her I was going to talk to the insurance company to see if we can get an extension due to parts and holiday s interfering, we would get credit s if approve. I did tell her don't stress,if necessary I can help with 2weeks ofrentallswhile I waited for approval. when we were done with herrepairs I met her at [redacted] car rental to give her car and sheturnin car rental .Like everything else  never had time to come to shop,   I did write a check to [redacted] . Why , because I was told by them that they were going to reimburse me .I found out 2 days later thaat they were not,they needed more time to look into the matter hi had no choice , I put a stop pay ontheocheck. To this da tethey have not given me credit ,she lied again saying that I got paid . About a month ago I started receiving calls from the insurance company of the other party thathit her ,asking me if I was the repair shop that did the repairs on her vehicle. I said yes,why. Because we have  the attorney for [redacted] asking us to pay her for the repair s plus cover her car rental .They told me that they paid for her rental while they were doing there investigation to see if their insured was at fault. Mrs [redacted] trying to get money from different sources not right.  She saying that [redacted] taking her to collections , liedagain [redacted] paid it  , .So all this comes down to a car rental agreement .Has nothintg to do with her repairs. any questions feel free to call me at 619379[redacted]

Mrs [redacted] contact me through a referral .I went to her home to look at car, before I even took car she already had a car rental from [redacted] car rental who was paying for it. She gave me keys to the car I came over with the towtruck  I don't know what run around she is taking about . Why is she saying that she had no transportation or ways to get around .she was provided with a car rental . Don't make sense , just inventing stuff, please have her get her stuff straight. , After one month of repairs , there was still some parts on back order, I immediately brought it to the attention of the insurance company, why , so that they can extend the car rental and be aware of the status of repair. I never told her we were short staff . It is very different when you tell someone ,we are waiting for parts it's Thanksgivings weekend , we not working see Next week .I'm giving employee s time off.   Her insurance assure me that they were going to look into the matter to see if they will help us with a reimbursement they never did. It was not good on there part. ThevinsThe in of the other party started getting involved they told her they were helping her with a payment.

I gave him back his money. Complete refund. If he wants to take me court because he thinks that's the solution than fine.

I was not satisfy at all for the work that Mr, [redacted] performed on my truck and some  of the information that hr sumited is  incorrect.I have the proof paper where he guaranty he work and signed,as I said I was not impressed at all with hes work done to the moldings and even him aknowledge  that he screw up my moldings,I did not found any profetional work been done to my truck,I was so disatisfied with hes work that I will not take my truck back to him,Thats the reason that  I took him to the small claims court,I have picttures of the moldings still sticking out of the doors in the truck plus the statement of warranty.that he signed.He signed that statement on march 3/1/2017.I will provide the court with pictures of the work he did.

Mr [redacted] brought me his truck for an estimate on 4 door molding s. The original color on the molding s were beige/ pewter. When he brought them to me they were black faded ,paint peeling.   That was his reason for bringing them to me to restore back to their original color. There was 2 reasons...

to remove the molding s. One , was the condition they were in. Second , it wasn't necessary for him to leave his truck while his molding s were being repair. He agree to the conditions. He came back a few days later and we professionally installed his molding s. They were not broken. He was happy with the work when he drove away in his truck. He did call me as few days later to tell me he wasn't happy with one molding because it had broken. I told him how can that be. He told me that when he opened both doors from the drivers side ,the left rear molding because it was separating a little from the door it broke. I did tell him that because the molding was separating I would take responsibility for that I will buy him a new one from City Chevrolet. The molding cost me $80.00. I reinstalled it as a good courtesy of warranty on the work. 2 week s later he comes to me to tell me that the other 3 molding s were coming apart. I told him sorry  I can't give you warranty on that. Your molding s are holding good at a 99.9  percent with OEM adhesive tape   looking real good than from their original look from when he brought them to me.  He brought it to my attention that he wanted 3 new ones and that he wanted me to buy them at a price of $300   .  I told him no. I only charged you$150.00 I already bought you on and now you want$300 dollars more. I refunded him his$150.00  and see you later.  He came for his refund and told me he was taking me to court.   Any questions feel free to call me at [redacted]

Review: I dropped my vehicle off with [redacted] (owner) on 11/22/13 to be painted and returned by 12/15/13. I paid 50% up front by check ($900). He kept the vehicle until 1/10/13. Not only did he charge my credit card the remaining $900 balance, but he used it to make unauthorized purchases of $1,039 with other merchants. After confronting him about the unauthorized charges and being so late to finish the job, he apologized and gave me a credit card receipt for a refund in the amount of $1,039. However, the refund never went through. On top of this, my car was returned with even more damage to the back tailgate, and it was found with a lot of his personal items in the car (eyelash glue, coffee mugs, and brochures). The additional mileage makes me think that he was using the vehicle for personal use. I have all receipts and text messages corresponding with [redacted]. I have already reported [redacted]'s unauthorized use of my credit card.Desired Settlement: I would like a full refund on the job. My car now has more damage to the back tailgate than when I dropped it off. When he delivered the damaged car, he updated the receipt to say "All work shop with buy new plastic on tailgate and install." Additionally, I am suppose to have a 5 year warranty. I have provided [redacted] with ample time to repair his damages.
