Mr [redacted] did in fact purchase a vehicle from us February 11th, At the time of sale Mr [redacted] signed a “Retail Instalment Agreement” in which he agreed to not just make payments on the vehicle he purchased but to keep and maintain full coverage insurance throughout the duration of the loanUnfortunately Mr [redacted] failed to comply with the agreement and subsequently was repossessedMr [redacted] stated that “ON the 17th of this month, without any phone calls or correspondence, dealership repossessed my vehicle,” and this is extremely inaccurateWe sent Mr [redacted] insurance and cure letters via certified mail and we verbally spoke with the customer on numerous occasions in regards to both his continuous late payments and insurance issuesWe have documented on several of these conversations Mr [redacted] became verbally aggressive and uncooperativeAs far as his complaints about the drivability of the vehicle, in the numerous conversations we had with Mr [redacted] at no point in time did he mention anything to anyone at K&C Budget Lot LLC that he was having any issues with the vehicle and it is hard for us to address any kind of issue if we are not made aware of itWe always make every attempt to help any customer when they have issues with their vehicle because not is it just the right thing to do but we genuinely care and want all of our customers to be happy with their purchaseFurthermore, after Mr [redacted] was initially repossessed we gave him the opportunity to resolve this and redeem the vehicle but he told us that he didn’t want “that car” and that he wanted us to put him into another vehicleAfter declining our offer Mr [redacted] and his father (father is not on the loan and has absolutely no connection to this account) opted to send us numerous threatening messages via public social media platforms and implored others to spread the word that we are not a good car dealer, to do harmful things to our vehicles, made several libel comments about K&C Budget Lot employees as well as current/past customers and threatened to sue us if we didn’t meet his demandsWe have reviewed this entire situation with council and feel extremely confident that not only did we follow proper protocol but went above what is typical to try to resolve an issue of this nature.K&C Budget Lot, LLC does not ever “want” to repossess any vehicle, however when a customer doesn’t abide to the terms of the agreement we are left with no choice but to protect our interest in the vehicle and take appropriate action.In conclusion, K&C Budget Lot LLC did not “steal” his vehicle, it was “repossessed” due to defaulting on his loanK&C Budget Lot LLC is NOT refunding any money and is continuing the repossession process on Mr [redacted] account

In fact Mrs [redacted] was repossessed due to default on her retail instalment agreement that she signed with us that stipulated that not only must loan payments be paid but the vehicle must have and maintain full coverage insurance on the collateral for the duration of the loanMrs [redacted] was given multiple notices and opportunities to resolve her default and failed to do soIf Mrs [redacted] would like to resolve her remaining debt that she has with K&C Budget Lot LLC, we would be more than willing to make some payment arrangements to satisfy her debt that is reporting on her credit report which would reflect much better on her report being paid as opposed to being unpaid.Mrs [redacted] should contact the credit reporting agencies if she feels that there is something incorrect on her report as is her right under the FCRA

Typically how we handle credit disputes is directly with the associated credit bureauWe have received disputes from Mrs [redacted] however the reasoning for dispute at those times was the consumer saying "not her account, verify ID." We did verify that it was her account and submitted this to both Trans Union and EquifaxHowever, after review of this account we will adjust the credit reporting on Mrs [redacted] to reflect "voluntary surrender." I am rejecting this response because: K&C Budget Lot didn't give me any amount of time to make my insurance payment. I didn't receive any notices regarding of the repossession. I was not told that they we're going to be taking my vehicle from me when they did. They weren't allowing me to have even a week to pay my insurance payment and still let me make payments to do them for my vehicle that same week they took my car. I'd like to see attachments of the letters they say to have sent me because I did no receive any.

I spoke with both Trans Union and Equifax, and both are reporting correct balance and account status.Credit report disputes are handled thru the credit bureau's directly. We advise Mrs. [redacted] to contact the credit bureau's as she has done in the past to handle any disputes that she may have under FCRA. Furthermore,  we are always willing to make some kind of payment arrangements if Mrs. [redacted] would like to satisfy her remaining debt with K&C Budget Lot LLC.

After discussions with Mrs. [redacted] we came to a mutual agreement that we would correct the...

issue and fix the damage. Jamie brought the vehicle to us Saturday May 21, 2016 and we replaced the door that was not working properly to the customers satisfaction. Mrs. [redacted] expressed to me that she was satisfied with the repair we performed. K&C Budget Lot LLC regrets that this issue ever happened but customer satisfaction is always top priority and we have made adjustments to protocols to ensure that this does not happen again in the future.Sincerely, K&C Budget Lot, LLC
