I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below The response given by MrMiller Castle is not completely accurateTherefore, I do reject his responseMrCastle is using the warmer weather as anexcuse not to repair our home is just another procrastination he is trying to do in order not to repair our home altogetherHe built this home mostlythrough cold weather during the winter months and now trying to say that the weather is too cold to make repairs to the houseMrCastle didn’tanchor the truss to the house because he told us that, according to the code, he was not allowed to do soNow in his response, he states thatit was the truss company who told him not to anchor the truss to top of the wall areasThis is in item of MrCastle’s responseWhile buildingthis house during the cold months, MrCastle’s crew had different types of saws that were used to cut wood for different thingsAnother time whenMrCastle told us he was going to do something at a future date was when we closed on the house he was coming back in a few days to sewgrass seed and get the yard ready for grassHe came to the house with one burlap bag of grass seed and, on approximately tenths of anacre, he sewed about 20%, if that much, of that burlap bag of grass seedHe took the rest of the grass seed with him when he leftThe grasscame up in spots throughout the yard with mostly spots of the yard with no grass at allThose bald spots in the yard were just dirtWhen Iconfronted him about that, he told me to wait until the fall of the year and I could rent a device to put on the back of my mower and airiate, putholes in the ground, so that grass seed would get into those holes and come up betterHe said he would throw the grass seed out after thatin the fallI asked him why he didn’t hydro seed the yard and he never respondedHe told me it was going to take two years to get the grassseed goingThis is another time that lMrCastle has not been telling the truthMy wife and I had to pay for top soil, grass seed, straw to spreadon the yard to try to get some grass to grow in the yardEven this didn’t produce much grass so we finally had the yard hydro seededYet,when he built another house, he bragged on hydro seeding that yardThe holes under the porch is not due to the settlement of the house.Those holes were left there when they built the porchI’ve had two different contractors, since MrMiller, to look at this house and bothtimes they have commented about the holes left under the front porchCould be a place where water accumulates during hard rains.I told MrMiller that the cinder blocks or the mortar was cracking away from the cinder blocks leading to the entrance under the house.I told him that one man got down into that area and had a lot of water he was standing inMrMiller said he had stucco those cinderblocks and that there should not be any water thereHe said the top was not on correctly over the area to go under the houseThisinformation about the cinder blocks I am mentioning here was all done on the phoneAs far as I know, MrMiller has not even lookedat the area in questionNow, he wants to put sealant on the insideThese other contractors have seen the cracking cinder blocksI mention hereMrMiller is trying to get you people to believe the house is settling in order to make an excuse about the holes underthe porchThose holes have been there since we closed on the house and several visitors to our home have commented on it.He is being untruthful to you people to get out of fixing our homePlease make a correction to my original statementWe closedon the house, I found out, on March 9, and not March 8, Yes, MrMiller said he was going to replace the shower doorsand we did pick out the doorsHowever, it has not been done yet and in lieu of what has happened between MrMiller and us sofar, seeing is believingMrCastle’s obligation to repairing this house runs out March 9, 2018, and I believe that is the reason he isstallingEven the stain on the back door is peeling offFinally, I’ve been in new homes with hard wood floors before and they werevery solid and tightThese floors are notThe ceilings are still split and if MrMiller can get by with it, he has no thought at allto fixing this houseRegards, [redacted]

1)Sheetrock Tape Cracked - I am hiring engineer to meet me at residence Monday, Febat 2:00PMWill get his engineering letter advising how I need to address truss uplift matterWill have matter addressed and crown molding up by March 9, 20182)Shower Door - I received call from *** yesterday the new door selected by homeowners arrived and I call and spoke with Mrs*** and advised we would be there Monday to remove old door and install new one.3)Cinder Blocks - I have asked my mason that did the block work on that job to meet me at residence on Monday, Febso we can look at that matterWill have matter addressed by March 9, 2018.Thanks,Miller Castle Const., LLC

My response to matters below:1) Hardwood Floors - I did respond to homeowner and advised him all hardwood floors pop and creek when season changes and going from air conditioning to heating and vice versaNever had one that does not do it somewhere in the house and advised him my personal house
does it as well.2) Wall Cracks - 12/when homeowner called me I advised I would be out of town week of 12/25-1/1/but I would get the guy that does my sheetrock to stop by and lookAs he noted, my guy stopped on 12/and he called me on 1/1/He expressed he felt the trusses had a uplift and said he advised that to the homeownerI called homeowner the week of 1/and updated him on what my sheetrock guy said and I would stop by to take a lookDuring that same conversation, he ask what causes that and what can be done to address itI informed it was caused by cold weather and the truss company's do not want us to nail the bottom cord of the truss to any interior wallsI advised we had to let weather get back to warm weather and let bottom cord relax and I would get my guys to go in attic and addressAlso, we would install crown molding throughout the houseI encouraged him to google it online so he could understand what is happening. 3) 1/he called and advised shower door was out of adjustment again because this had made the 3rd of 4th time doing soI went that night and adjusted the door with him present again and the door was working fine when I leftDuring this visit, I installed two screws in wall oven to help if from movingAlso, during this visit he asked me again about the cracks! I explained the same as mentioned aboveHe even called me later that night and asked me to clarify how much warm weatherI advised we needed consistent warm weather and his response, "July, August"I told him no, more like end of April or for sure MayAt that time, I told him it probably would be May to address for two reasonsOne, warm weather to let trusses relax and two, we would have to set up saw outside to cut the crown moldingNo way to cut inside the house and have all saw dust in house and they both agreed! He mentioned that my one year was up in March and I advised him I would even put it in writing that I would come back and address the issue but no responseOn Sunday 1/14, he called and left me message that shower door was out of adjustment again and felt a new door was neededHe felt a swing door would be better than the siding door installedI called *** *** in next couple days and ask *** at contractor sales desk what needed doneHe took information on the door and called *** *** doorsHe called me back and advised I had to call them direct and give them the informationAfter requesting from them and sending information on my end, they finally emailed my on Friday 1/when I got home, they advised me that I had to send picture of old door removed before they would refund me the moneyDuring all this I had called and informed homeowner what I was being told! On 1/29, I called homeowner and told them to go to either *** or *** *** and pick out a doorThat night the employee in plumbing at *** called and advised they were there picking out a door and the one selected was a special order with 2-weeks lead timeI advised him to make sure to explain that to them and he confirmed he wouldThe employee entered a quote on their computer in my name so I could pay for it when I stopped by storeI went there and paid for door on 1/and door was ordered! I saw homeowner evening of 2/at *** and advised I had ordered the door and it would take 2-weeks for it to arriveHe said he knew because they had told him! I told him I would call him when door arrived and we would come remove old door and install new door.4) Cinder Blocks - he mentioned this to me back late fall or early winterThe blocks in question are the ones laid up for the access hole to crawlspaceThey are not part of the foundation, just there to have access because all foundation is below gradeThe blocks are laid against the foundation and not directly tied into the foundation wall and a built shingle covering over itI explained that to homeowner when mentioned and also I would come in spring and put foundation coating on inside of blockThere is an 8" block across the footer at access opening so water would have to build up 8" to access crawlspace. 5)Ground not level & holes under porch - First I have heard on this but I am sure the ground has settled under the porch against the foundation as all dirt does. The response given by Mr. Miller Castle is not completely accurate. Therefore, I do reject his response. Mr. Castle is using the warmer weather as anexcuse not to repair our home is just another procrastination he is trying to do in order not to repair our home altogether.
