I contacted Miller Toyota on Saturday, August 18, 2018 about a 2010 *** Limited they had listed for $13,775. I had been looking for this particular model/color/mileage/condition for several months. Since I live 1.5 hours away from the dealership, I gathered information about the condition of the vehicle from the salesman (Scott F), who sent me photographs/video of the vehicle. I then spoke with the sales manager (Wes Snoots) who filled me in on the service history of the vehicle. I submitted an offer of $13,000 via text to Scott F (571.278.9555) at 3:21 PM on Sunday, August 19, 2018. My offer was accepted at 3:28 PM the same day. I requested the total amount to put on the certified check to be made payable to Miller Toyota. At 4:18 PM, I received a reply text stating "13680.10 gets you the title to go to MD DMV." I advised Scott that I would pick the car up on Monday, August 20, 2018. I then purchased a train ticket and Scott agreed to pick me up at the train station at 5:45PM on Monday, August 20, 2018.
At 8:05 AM on Monday, August 20, 2018, I received a text from Scott F advising me that the vehicle was sold to another person on Sunday evening. I was very upset since we had an agreement in place and the car should have been put on hold. He said his manager didn't tell him to put it on hold.
I contacted Wes Snoots (Sales Manager) at 9:00 AM on Monday, August 20, 2018 to discuss the situation. I explained that Miller Toyota had received and accepted my offer, relayed the total price, and knew I was making arrangements to pick up the car. He said they had the right to sell the vehicle to someone else because I had not paid for it yet. If I had been told they needed a deposit to hold the vehicle I would have made one. I requested him to reimburse me for the $32 train ticket I had already purchased. He said he would not. I have retained the texts as they constitute a legally binding agreement and am considering legal action.

Dear ***,

Thank you for the opportunity to respond to ***'s complaint. As I was not privy to any of the conversations, I can only review the electronic records.

We will stipulate the following as true:
I contacted Miller Toyota on Saturday, August 18, 2018 about a 2010 *** Limited they had listed for $13,775. I had been looking for this particular model/color/mileage condition for several months. Since I live 1.5 hours away from the dealership, I gathered information about the condition of the vehicle from the salesman (Scott F), who sent me photographs/video of the vehicle. I then spoke with the sales manager (Wes S) who filled me in on the service history of the vehicle. I submitted an offer of $13,000 via text to Scott F (***) at 3:21 PM on Sunday, August 19, 2018. My offer was accepted at 3:28 PM the same day. I requested the total amount to put on the certified check to be made payable to Miller Toyota. Our disagreement begins at:4:21PM; Mr. F texted ***, "We close at 5:00PM today. Were you thinking of about coming tomorrow?"

Reply by *** at 4:23PM, "Probably...Need to check a few things."

Text from *** at 8:45PM Saturday after we had closed, "Hi Scott, Couple of things...will you provide temp tags? If I need to take the train, can you pick me up at the Manassas train station?"

Text from *** repeated at 6:49 AM Sunday morning, “Hi Scott, Couple of things...will you provide temp tags? If I need to take the train, can you pick me up at the Manassas train station?"

Text to *** from Scott at 6:50AM the following morning; "There was someone showing it when I left. I can pick you up. I'd like to know if it is still available first."

Further texts follow and show frustration but are of no consequence to the facts at that point. The vehicle was sold to another customer after Scott had left Saturday night. *** was notified at our first opportunity that it had been sold.I appreciate ***'s disappointment. However having price agreement does not constitute a sale, promise of a sale or any contractual agreement. All vehicles are subject to prior sale as noted on our website and *** which is where *** initially found the vehicle of interest.

*** appeared less than committed when he responded, "Probably...Need to check a few things." Miller Toyota never stated or led the customer to believe that we were holding the vehicle.

We are sorry that this experience occurred. This is never a good situation for the dealership and frequently multiple interested parties. Used vehicles in particular are unique and cannot be duplicated. If a dealership held vehicles for every individual that had price agreement but wanted to think about it some more, we would have no vehicles to show or sell.I trust this matter can be closed.
