The customer issuing the complaint purchased a new Yamaha YZ250F motorcycle from our dealership on 10/25/2014 after seeing the model advertised on-line. The...

advertisement, which is featured on MillersYamahaPolaris.com, [redacted], and [redacted], shows the model advertised with ail available discounts and rebates. I have attached a copy of the advertisement. The main body of the advertisement clearly states that the "advertised price includes al! available discounts including Yamaha bLU cRU Racer Reward credit of $500.00. This reward is provided from Yamaha to the buyer after the buyer purchases and registers with the Yamaha bLU cRU racing contingency program." Also included with all of our advertised models is the message "Price, if shown, does not include government fees, taxes, dealer freight/preparation, dealer document preparation charges or any finance charges (if applicable)."
 
Unfortunately, our dealership cannot be held responsible and expected to refund fees post-purchase because a buyer did not read the clearly-marked terms and conditions of a vehicle's advertised price. It is our dealership's policy of no hidden fees; hence, such conspicuous statements in our advertisements. These statements are generalized with no specific dollar amounts because fees and taxes can vary based on the type of vehicle purchased, residency of the buyer as well as method of payment, which is why we encourage buyers to "contact dealer for details" or "request a quote." We also itemize any fees/taxes separately on our vehicle bills of sale as required by Pennsylvania law. I have attached a copy of Mr. [redacted]'s bill of sale. It clearly shows the vehicle price of $6,490.00 (which excludes the $500.00 bLU cRU rebate), $355.00 freight/set-up fee, and $105.00 document fee.
Mr. [redacted] has spoken to Yamaha Customer Service about the $500.00 rebate, and there is nothing hindering him from receiving said rebate as long as he registers for the bLU cRU Program. It was clearly explained to Mr. [redacted] at the time of purchase how this program/rebate works and how to register. Therefore, I believe it is unreasonable for Mr. [redacted] to demand our dealership further discount this model nearly a week after agreeing to pricing and purchasing a vehicle.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.In the end, I was over charged for a Yamaha 4-Year Warranty at the cost of $890.00 plus tax and as of today's date, 3/19/2015 I cannot ind a Yamaha Dealer that charges this high amount for the same warranty. The same warranty I found for less then half of what I paid. Mr [redacted] if this is how your dealer conducts business and being managed by you, well then speaking to you or your staff will to me no good. I will be contacting Yamaha and filing a complaint as well. I still find it unethical to charge a customer who cancelled a warranty within days after purchase by your dealer since I was grossly over charged. I still do not agree with the end result that was described by [redacted] who is the manager of Miller Yamaha. Regards,[redacted]

This letter is in response to complaint ID: [redacted], received March 12, 2015, regarding [redacted] In the days after Mr. [redacted] purchased his new Yamaha Grizzly ATV and Yamaha Extended Service (YES) coverage from our dealership, he did contact me personally via telephone to...

discuss the pricing on the YES coverage. I made Mr. [redacted] aware that we do price match competitors offering the same products. In the case of a price match, my dealership would refund the appropriate amount back to Mr. [redacted] after receiving the pricing information for a competitor and his YES coverage would remain intact. Despite my offer, Mr. [redacted] opted to cancel the coverage. Since YES coverage is backed by Yamaha, I requested he contact Yamaha to process the cancellation. After contacting Yamaha, Mr. [redacted] sent us a letter formally requesting the cancellation of his YES coverage. We promptly cancelled his YES coverage at the direction of Yamaha. Yamaha processed the cancellation and refunded our dealership for purchase price on 2/24/2015. We dispatched the refund check for $807.62 from our dealership to Mr. [redacted] the same day. Regarding the discrepancy between the original purchase price, including sales tax, and refund amount, this is due to two reasons: cancellation fees and sales tax remitted to the [redacted] DCNR. The cancellation fees total $82.38, $32.38 from Yamaha and $50.00 from our dealership. The YES cancellation fee from Yamaha is listed in the terms and conditions of the YES contract Mr. [redacted] signed. The fee is comprised of a $25.00 flat fee plus a prorated “depreciation” for time used, which was 1% of the contact term, as reported by Yamaha. The service contract cancellation fee policy of our dealership is prominently posted in our business office, which is where Mr. [redacted]. signed all purchase documents. The combined sales tax for the service contact and vehicle was sent to the ** DCNR, and we, as a dealership, are unable to recoup a refunded tax amount from the DCNR; therefore, we cannot provide a refund to Mr. [redacted] for the sales tax. Mr. [redacted] is entitled to a refund of the sales tax paid, a total of $53.40, on the refunded purchase; however, he must contact the ** Department of Revenue and submit a Board of Appeals Petition Form in order to be reimbursed.   If there are any further questions regarding this claim, please feel free to contact me.  Sincerely,[redacted]Miller's Yamaha

Review: Advertising 2015 yamaha yz250f,blu cru racer discount to racer reward of 500.00. How ever drove to get bike for my son, all the way to PA. Price for the yamaha was 5,990. Go to pay the cost was now 6,960. So they added the 500.00 to the price.Maid up prices to add to the price of the bike. Freight & set-up charged $ 355.00 Plus a charge for document fee of 105.00. So they are charging me for the 500.00.I told them about it. They chose not to give me the price that was advertised.I also will add that I spoke to them the day before I went to confirm this ad for 5,990. Plus a 500.00 rider reward discount.Please help me in this matterDesired Settlement: Want what was advertise the price 5,990.00 plus the 500.00 discount.

Review: I purchased a 2014 Yamaha YFM550PEL ATV with VIN#[redacted]04277 on 1/16/2015 and was offered an extended warranty for $890.00 plus tax. I accepted this warranty offer and the warranty was paid in full along with taxes that would total $890.00 plus 53.40 for tax totaling $943.40. After paying for this, I did some research and I couldn't find one dealership charging this high amount for the same warranty. I called Miller Yamaha within days after my purchase and talked with the manager, [redacted] who stated he wouldn't refund the amount for the warrant and stated to call Yamaha which I did. Yamaha explained that the Dealership would need to refund the warranty if cancelled. I immediately sent a letter addressed to the manager, [redacted] explaining to cancel the warranty and to refund the full amount of $890.00 for the warranty plus tax $53.40 for a total of $943.40.

The atv purchased came with a 6 month warranty and I was told the extended warranty would take affect after 6 months. The first week of March I received a check from Miller Yamaha for $807.62. I'm not sure why I didn't receive the full amount of $943.40 since the extended warranty never took affect yet and wasn't used.Desired Settlement: I request an additional $135.78 that would total $943.40 which I paid when purchasing said atv.
