This gentleman wants us to repair his ceiling from water damage from his AC unit in his attic. We installed a new system for him in 2010 and have not been back to his residence since .
The pictures he sent in clearly shows that someone has stepped in his drain pan and caused a hole in it. We do not know what company he has been using for maintenance nor do we know who has been in his attic. We do know it was not Mills heating and Air.
The customer contends that we installed a new drain pan even though it is not on his proposal. He was given a 1 year labor warranty on his install. It is now 7 years later.

Mills reply again is replete with rhetoric, misrepresentations and smoking mirrors; they can't seem to get their story straight.
Reply: Mills replies they have not been to residence since 2010. Paid Mills $6000, June 2010, to install new outdoor unit and turn air handler 180 degrees in attic over garage. The did not install required decking under drain pan and ran aux line uphill.

on each of these 3 other visits, Mills had the opportunity to "cure" their negligent and defective installation (drain pan decking) and the aux. line that ran uphill.
The picture of the drain pan is evidence of what happens to the drain pan that is resting on joists that is not supported by decking.
If it was stepped on or otherwise, it would be Mills negligence when Mills moved the air handler in 2010 and positioned the drain pan directly on the joists, absent decking.
The drain pan rests on rubber grommets directly under the air handler, that weight in excess of 100 pounds, it would be virtually impossible to step on drain pan. The air handler has not been moved until recent repair to install decking, replace drain pan & run aux. line downhill (10-2017)
The hvac system has been routinely maintained since 12/2013.
Our home maintenance company inspected the drain pan leak;refused to pay full coverage of damages due to no decking under drain pan; and would not provide partial payment ($350) and continued hvac coverage until decking was installed with new drain pan and run aux. line downhill (instead of uphill). The three hvac contractors that inspected the hvac system, two other hvac contractors I contacted and a professional engineer all concurred that decking was required to be installed under the drain pan.
Pursuant to phone call of required decking of 1/2/2018 originating at 2:42 pm, Mills spokesperson, Richard, said decking was required and was installed by Mills. He even called me a liar when I told him I had to install decking. On a subsequent phone call (1/8/2018) originating at 2:24 pm, he refused to acknowledge that I had installed decking; even though, we provided him significant documentation of the homeowner's corporation and hvac tech discovery of cracked drain pan, no decking and aux. line that ran uphill. Additional evidence was provided of completed construction by hvac contractor, who installed decking, drain pan and ran aux. line uphill.
The alleged one year warranty is moot; negligence and defective installation tolls the beginning of clock of discovery-(10/12/17).
I said, pursuant to incorporation of the two proposals that a new drain pan was to be installed; remarkably, an employee of Mills recalls not installing the new drain pan (about $50) in 2010-breach of the $6000 contract. We relied on this incorporation of proposals. We offer for a third time, for Mills to inspect the new construction of decking, drain pan & line.
