To Whom It May Concern: We are in receipt of the complaint (#***) filed on August 10, Please allow the following to be our response to the complaintThe customer applied for a mortgage on March 2, with a loan officer who is no longer with the bankThat issued a pre-qualification
letter that was subject to final review of a complete loan package which typically includes current paystubs, federal tax returns for years, current asset statements, credit review, and employment verificationsThe borrower was considering a new construction purchase and the closing date was unknown at that timeWith the new construction likely taking a few months, we would have needed updated information eventuallyWhen the client contacted the bank in late June to check in on this loan process a new application was started since the original file did not have a purchase contract or other income/asset documentationWhen accessing a new credit report on June 28, 2017, the client’s credit report had changed adversely since the first report affecting ability to approve the loanUnfortunately we did verbally or via email tell the borrower that everything was back on trackOnce the new loan officer and processor received the updated income and asset documentation the underwriter discovered that the income documentation did not support the income initially calculated and did not meet the Ability to Repay/Qualified Mortgage standards that financial institutions are subject to comply with (set through the Dodd Frank Act and implemented through the Consumer Finance Protection Bureau or CFPB)The borrower asked if we would consider a co-borrowerWe did offer to review the loan with a co-borrower, and we have not received any information for a co-borrower as of the date of this responseIt is our understanding that the borrower is pursuing financing through another mortgage lender since that lender has asked us to transfer the appraisal to themWe did offer to reimburse the borrower any earnest money that was not refunded by the builder/sellerFurther, we did offer to compensate the borrower for any materials and labor that the builder will not reimburse for work done to dateIt has been made clear that this will only happen if the purchase of the home is not completedWe are currently waiting for the client to inform us of his decision to proceed with our application and a co-borrower or to cancel the loan and transfer the appraisal to another lender

of bank services during a conversion, an overdrawn account sent to collections and
inability to access eStatementsWe acknowledge that we experienced
challenges during our conversion in April and greatly apologize for the
inconveniences caused by this situation.
While an error was made in not closing the consumer’s account, the
consumer continued to utilize the account during the remainder of 2016. The Bank notified consumer of his overdrawn
account by phone and by letter (on occasions). Upon receipt of complaint, Bank immediately
provided statements to the consumer and gave consumer time to review
documentation. Bank held numerous phone
conversations with consumer, during which time the consumer asked that if they
paid charges owed, minus the bank fees, would the bank remove the account from
collections Consumer paid full balance
owed, bank refunded the fees and bank removed account from collections. Consumer advised bank that we may send future
correspondence and we provided direct contact information for our area manager
if consumer chooses to use the Bank for future financial services.We appreciate the opportunity to
take care of the consumer’s concerns and greatly apologize for the
inconveniences caused by this situation
