Review: I was a member at Kingsley. I first attended because I was suppose to receive a free massage. The massage never happened I joined the health institute anyway but when I cancelled in December they could find no way to not charge in January. I told them I was not going to use the facilities but it has to "stay in effect" until February why?? is I am charged in January. I feel that these are dubious practices and no matter when you cancel they are going to charge people another month - Sleazy!!Desired Settlement: I would like the $55.00 credited to my account.I would also like the Revdex.com to tell them to straighten up and have some finically integrity.[redacted]

?[redacted] was a member of our Small Group Training fitness program through [redacted] (operating name [redacted]) at our Kingley Health facility at [redacted] NJ 08854. Being a member entitled [redacted] to unlimited small group training led by our team of Exercise Physiologists. [redacted] voluntarily chose to become a member of the fitness program and was offered no inducement to do so. Once they joined, new members were offered the opportunity to try a free massage.[redacted], for whatever her reasons, chose not schedule her free massage. We fail to see the relevance to her complaint of her deciding not to obtain a free massage.

In order to become a member of the Small Group Training fitness program at our facility, [redacted] voluntarily choose to sign a legally binding membership Agreement, as is standard practice among fitness facilities on [redacted], 2013. When any client signs a membership Agreement, a staff member sits down with them and explains the entirety of the Agreement. The client is required not only to sign the Agreement as a whole, but to specifically initial specific paragraphs ofthe Agreement that address the client's financial obligation, length of the Agreement, how to cancel the Agreement, and the conditions related to cancelling the Agreement. This Agreement has been filed with and approved by the State of New Jersey as meeting all regulatory requirements for fitness centers. [redacted] signed each paragraph of the Agreement as well as the Agreement as a whole as required. Above her final signature is a paragraph that she also initialed saying that she read, understood, and agreed to all aspects of this Agreement. [redacted] was given a copy of her signed agreement.

[redacted] Agreement obligated her to a fitness membership for a series of automatically renewable three-month commitments. The cancellation terms of the Agreement clearly state that the auto renewal of the Agreement (not the membership itself) will be cancelled 30 calendar days following notice of cancellation. [redacted] filed a notice of cancellation on [redacted], 2013. Given her start date on [redacted], 2013, her last 3-month commitment ended [redacted], 2013, one-month after her notice was received.

The Company fully honored its Agreement with[redacted]. We were surprised and disappointed that [redacted] has gone to great lengths to get out of her legally binding commitments. Ms. [redacted] was well aware of her commitments at the time she signed her Agreement and was reminded of them when she sent in her cancellation notice. We estimate that 99% of our customers have no issues living up to their Agreement and we have no issue with living up to our Agreement 100% of the time.

We would expect [redacted] to do the right thing and apologize to the Company for her attempts to get out of her obligations. Her comments are without basis and defamatory to the Company and we

request that she cease and desist with immediate effect. She has engaged in an unjustified campaign to avoid paying for her last month when she knew all along of her obligation that she willingly entered into.
