Response to Revdex.com Complaint by *** * *** from *** *** for Mineral Resources, Inc. March 10, 2015 On May 4, 2012, Mineral Resources Increceived by facsimile a Participation Election by *** * *** Revocable Living
Trust and *** * *** Trustee electing to participate as a Working Interest Owner in the *** *** well. On March 13, 2014, Mineral Resources received by facsimile a second copy of the Participation Election with a statement by *** that upon receipt and review of the legal document covering the "limited interest", a check for their share would be forthcomingMineral Resources mailed to her a Joint Operating Agreement (JOA) for her review and execution dated April 1, It was August 8, when Ms*** returned the executed JOA finalizing her decision to participate as a Working Interest owner rather than lease her mineral rightsWe determined her proportionate share of the drilling and completion costs to be $3,052.00, invoiced her for this and she did pay.
The *** *** went on production November 21, State law mandates that payment to royalty and working interest owners must be made within six months of first productionIn order for payment to happen, a title opinion containing the entire division of interest has to be createdThis well has 500+ individual ownersBecause we had not received the JOA prior to completion of the title opinion, Ms*** was listed as an un-leased mineral owner and would receive her proportionate share of 12.5% of revenuesThe process to recalculate an entire division of interest (referred to as a "deck") is extensive and takes a considerable amount of timeWe informed Ms*** that we hoped to be able to get this accomplished within to months, but was not guaranteeing that time frame as we had other wells that were reaching the six month period for payments and that we would work as quickly as possibleAt the same time in August, a financial transaction took place between Mineral Resources and *** Oil & Gas resulting in *** becoming the operator for the *** ***, as well as the other wells Mineral had previously operated, thereby making ***n the payer of revenuesAll information was sent to *** to enable them to establish their pay decks, but this was a large undertaking and extended the time frame first estimated to Ms***It is my understanding as well that *** converted their accounting software to a new system that caused further delays.
It is my understanding that with Mineral's payment to Ms*** on February 26, and payments made by ***n in the weeks prior to this date to Ms***, the obligations have been satisfied to date and the situation should now become a matter of routine.
If there is anything further I can add I will be happy to do so, but it is my understanding through communication with Ms*** and her husband *** *** that they are now satisfied with this particular situation
