Dear Mr [redacted] , We appreciate the opportunity to respond to your commentsWe apologize for the delay in our response, but given the severity of your complaint regarding the nature of your experience, and your description of it as a “hate crime.” We wanted to ensure that we had the ability to consult each member of our staff who were on-site that evening, as well as our nightly incident log, where we record any incidents that happen, especially when the Moscow City Police Department (MPD) is notified To begin, we would like to state that in no way was our decision to have you trespassed from the facility related to your interaction with “the gay man.” The decision not to serve you and consequently, ask you to leave, was due to you showing signs of intoxication while in the facility prior to leaving the building to smoke a cigarette, and the conversation you held with a member of our staff while outside of the facility—during which he made the decision that you were not fit to continue drinking based on your inebriated stateOur staff is trained to observe all physical manifestations of intoxication, some of which include: slurred speech, lowered reasoning ability, staggering walk or inability to walk, glossy appearance to the eyes, and slower reaction time Since you displayed some of these common characteristics, to comply with our policy at Mingles, as well as our governing authority, we have the right and responsibility to discontinue service for your own safety, as well as the safety of our other customersWe feel that our staff performed correctly when determining your state of intoxication, and followed the correct steps in letting you know that we were not going to serve you further, and asking you to exit the establishmentOur staff informed you that “you’ve had too much, and it’s time to go ” to which you responded in a confrontational mannerIn order to continue to ensure the safety of our customers and employees, you were physically ushered to the front entrance, at which, our staff notified MPDAs is policy, for any negative altercation towards our staff or customers, we reserve the right to have MPD issue a notice of trespass to anyone that has compromised the safety, well-being, and enjoyment of our customers We also understand that in an establishment like ours, inhibitions are often much lower, and recollection of events can be limited, as is the nature of alcohol consumptionHowever, when situations like this arise and can again, compromise the safety and well-being of our staff and customers, we have a zero-tolerance policy for people that are unable to conduct themselves in a safe and responsible mannerBased on our experience, the testimonies of our staff members, along with our incident log, we stand by the decision to discontinue serving you based on your intoxicated behavior and ensuing belligerence when asked to vacate the premises We also recognize that you are asking for a refund for your meal and drinks, and restitution for the “hate crime” as you have statedWe will not be issuing you a refund, and given that the reason for your asked departure is unrelated to your interaction with “the gay man”, we also respectfully decline any request for restitution for a “hate crime,” as our decision to discontinue service did not involve any consideration to your or the man’s sexual orientationFurther, we take great concern in your description of the event as a “hate crime” against the LGBTQ communityWe have always been strong supporters of all members of our community, making sure to support all members equally Specific to the LGBTQ community, we have been sponsor supporters of the Moscow Pride event, as well as worked to provide assistance and staffing for multiple LGBTQ events Again, we appreciate the opportunity to respond to your complaint, and hope that both sides can work towards a resolution based on the facts presented Regards, [redacted] , Owner Mingles [redacted] Moscow, ID [redacted]
