In regards to the complaint from ** [redacted] Jr Ministering Angels has been taking care of his father, ** [redacted] Sr since September In the recent weeks, I have received several letters from [redacted] Jr stating how unprofessional Ministering Angels is, that he is reporting my company to the Revdex.com, ACHC (healthcare organization accreditation), and to the Office of Civil Rights for violating his (** [redacted] Jr.) privacy** [redacted] Jr also stated he was going to make sure Ministering Angels goes out of business, if it is the last thing he does We have never taken care of ** [redacted] Jr, only his fatherTherefore, we do not have any medical records or paperwork describing ** [redacted] Jr's medical conditionWe did inform caregivers of ***'s medical condition, due to the fact he lived in the same houseAt times, he and his father would have loud arguments in the presence of the caregiversOn one occasion, a gun was pulled out, apparently it was not loaded, but the caregiver was very concerned and frightened Ministering Angels did receive a couple of phone calls from ** [redacted] Jr over the past year, voicing concern about the CNA [redacted] and his job performance When we would call him or his brother Hunter (dad's POA), they would say that "dad likes ***, you can leave him there for the time being." ** [redacted] is a Certified Nursing Assistant, we do have a copy of his license on file and he can be located on the licensing website We have been filing the insurance claims, as a courtesy, to ** [redacted] Sr's Long Term Care insurance, [redacted] *** [redacted] requires that we send in a copy of the CNA's care notes in order for the claims to be paidOur company also requires that the patient or the family member sign off on these notes to acknowledge that the caregiver was there for those hours ** [redacted] Sr and ** [redacted] Jr both had signed off on these records, up until the end of December [redacted] processes the claims and makes the payments to the POA, ** [redacted] *** [redacted] then would send Ministering Angels a check The balance on ** [redacted] Sr's account is now over $past due If [redacted] has made any payments recently, they have not been forwarded to Ministering Angels We had asked the CNA in the home to bring the personal belongings of the caregiver who was taken from the [redacted] home by the police, to the office One of the administrative staff members called a towing company in [redacted] to find out what to do about the vehicle in the drivewayShe was informed that the owner of the house had to call to request the vehicle be towed This information was then relayed to [redacted] and he was supposed to then relay that to ** [redacted] Jr We strive to take the best care possible of our clients Unfortunately, there are times when not everyone, staff and family members, can see eye to eyeWe try to remedy the situation to please all involved We look forward to the conclusion of this investigation

response because:
As has been the practice of the Ministering Angels since the day we hired them
months ago, they are lying throughout their response, hoping to cover
themselves, but the are not good at itYou will note that they state that they
do not have any medical records or paperwork describing my personal health
issues, but in the next sentence they state that they did indeed provide this
information they had no description of to their employeesThis is a blatant
violation of HIPAA laws regarding me and my personal and private health
information
You will also note that they contend that during an argument between my father
and me a gun was pulledThis is certainly a ridiculous fabrication, for if
this event actually took place, why did not the frightened and concerned
caregiver, or the Ministering Angels, immediately notify the police of this?
Wouldn't that have been the most obvious response to the situation? Would not
any thinking person have done so, especially someone/some agency whose business
is to provide for and protect their always vulnerable clients? Yet, we never
heard a single thing from *** *** regarding this incredible situationBut we
rarely received any communication from the Ministering Angels regarding any
important issue that I brought to their attention
And how about our signing off of the caregiver's daily log? Rarely did I, in
fact, sign them; instead, the caregiver who was the primary person who led me
to report the Angels, would have my father - who has dementia - sign themEven
so, the Angels, in their response here, do not even attempt to address or
defend themselves against my allegations of insurance fraud on their partIt
was *** *** who, upon my inquiry regarding the falsified daily logs of the
caregiver, told me that that practice was necessary because the insurance
company or Medicare would otherwise assume that my father did not need the
stipulated care, and would then not pay for itI have registered a complaint
with *** ** *** and Medicare alleging insurance fraud on the part of the
Ministering AngelsThey will not be able to deny their fraudulent activity by
virtue of the daily logs in question, which will show clearly that the Angels
practice insurance fraud
Regarding the former caregiver's car being left in our driveway, once again the
Angels are lying in their response hereThey do not even mention the fact that
the car was left in our driveway for one month, or that I called the Angels
requesting, unsuccessfully, that they remove the car
Incredibly, *** ***, the director of this "Christian ministry,"
continues to lie to cover her deceit and unconscionable unprofessionalismBut
she is not good at it, as is demonstrated above, and in trying to deny my
allegations against her and the Ministering Angels, she implicates herself by
the very words she uses to deny her obvious deceitConsequently, I see no
further need for me to address this matter; the several other agencies I have
reported the Angels to will see that justice is done in this matter

Review: Shortly after Ministering Angels "CNA" [redacted] started working for us, my father began complaining to me (I have an apartment in the basement) about him not doing his job and stealing. I wasn't sure about this as I was not usually in their presence during the day. As time went by, my father continued to complain, so I requested a different CNA. Five times over the course of this past year I have tried to secure a new CNA, yet the Ministering Angels somehow could not bring this to pass, but continually lied to me, saying they would take care of it - even stating which days and when such persons would start with us - then just ignoring the situation.

Approximately 11 months ago, a Ministering Angel nurse pointed out to me that [redacted] had been writing the exact same things every day in his daily log; things which, for the most part, he had never done. When I contacted [redacted], the director, about this, she explained that [redacted] had to fill the logs out that way, otherwise Medicare/insurance would think that my father did not need in-home care, and would not pay for the services (which I did not understand at the time). Still, [redacted] continued to assure me that [redacted] was their top employee. I began calling regularly about things like this, until [redacted], and her assistant, [redacted], stopped answering my calls and responding to my messages. The only times then that [redacted] would answer the phone were when she was apparently awakened by my call and answered as though she had a hangover. This happened several times. In each of these instances, [redacted] lied to me straight out regarding my questions, then would not answer my calls the following week.

Earlier in the year, social services investigated my father’s situation because they had received an anonymous call regarding neglect and an unclean environment, but we never heard a thing from [redacted] regarding this, and [redacted] continued in his position without even the most basic inspection of the situation by the Ministering Angels. When I told [redacted] and [redacted] about [redacted]’s obvious OCD and germ phobias - which caused him to use up all of our soap regularly - I received a lighthearted non-response.

Despite all my efforts to remove [redacted], he remained with us from Sept 2012 until Jan 2014, when I had to fire him for lying over the past year, neglecting my father, not doing half his job, stealing, and, as I came to discover last month, not cleaning my father's bathroom (of which I have picture evidence) or bedroom at all. When this was brought to my attention by a good CNA, I was incredulous to find an incredibly dirty and unsafe environment, with waste, soiled pull-ups, dried feces, and c[redacted]ed waste in the tub, sinks, and toilet. The closets were in unbelievable disarray with clothes scattered everywhere, under which were hidden soiled rags and pull-ups, and even old food . [redacted]’s response was weak, as usual, and, incredibly, she even told us that it could take up to three weeks to transition [redacted] out! I had to demand that she not send [redacted] to our home again. After this, when looking up [redacted] on the Virginia Board of Health Professions website, I found that there was no indication that he was, in fact, a CNA. [redacted] is still employed by Ministering Angels.

Other subs that [redacted] sent to work for us were equally as unprofessional, and did even less work than [redacted] had done. All of them would sit and talk to my father their entire shifts, and do nothing else except play with their cell phones or laptops. One lady, after only two days, began discussing with my father my personal and medical issues, offering him advice on how to deal with me and how to handle my inheritance. She even went into my father’s safe with him to help him look for a large amount of money he had lost. Based on this loss, my brother (Dad’s POA) then requested my dad to void, tear up, and send back a large check he had just sent to Dad. The CNA/”nurse” then volunteered to take the check for him as she had envelopes at home. I texted [redacted] that I did not want this person to return, but she came the next day anyway. This caregiver is still employed by Ministering Angels.

One caregiver would sleep prone on the couch while Dad fixed his own breakfast, and he would tell me of illegal practices he had done during his assignments. Another one was taken from our home by the police and never returned, so that his personal effects remained in our living room for two weeks, and his car stayed in our driveway for a month. As was typical, [redacted] never called us to discuss the situation at all, and though I called [redacted] five times to remove the car over the course of a month, and even though she assured me each time that it would be done that very day, it never happened (she regularly told me she would do things, then simply ignore them). Finally, I had to have [redacted] call a friend of his to tow the car.

One week ago, I found half of a serious prescription of mine missing (13 capsules; a controlled substance). One of the caregivers ([redacted], who is not even a CNA) came to me and showed me two of the missing capsules she said she found on my father's bathroom floor, and that the others were in the toilet, but she flushed them. My father denied taking the meds. Because I had called the police about the meds, I asked her to hold on to the two capsules until the police could talk to me. Now I cannot reach this caregiver; she will not answer texts or calls, but has had her supposed son respond to me via text, and he has been evasive, saying his mother is not available. Consequently, I am in harms way because I cannot get those two meds back from her. I was just told by our most recent Angels caregiver that she and [redacted] were called by MA associate director, [redacted], to come in and have a meeting about me because they needed to cover their "....." This caregiver told her she did not want to do so, but would stay neutral. However, this caregiver has assured me that she will back all that I have reported according to what she is aware of.

The above-mentioned caregiver has also made known that, throughout the course of time, [redacted] (director) has informed her caregivers up front, before they were sent to our home, that my father has a crazy son who lives in the basement who causes trouble. [redacted] is by this referencing me and a particular health condition I have. I have already registered a complaint with the U.S. Dept. of Health and Human Services against the Ministering Angels for blatant HIPAA violations.

In every questionable circumstance over the past 16 months, [redacted] has never contacted me to explain anything, or to apologize for any bad service, or to outline a way to resolve any issues. Now I have come to learn from new caregivers that [redacted] tells each of them up front that my Dad is a good man, but he has a crazy son (referencing me) who lives in the basement and causes trouble. As this all unfolded recently, when we discovered [redacted]'s duplicity, I texted [redacted] several lengthy messages regarding my serious concerns, but [redacted] told my brother to tell me that they could not receive text messages(?),though I'm not sure how they would have known I sent any, in that case. I knew they had received them via my phone's notification. I again sent texts, as they did not respond to me, but these came back blocked. However, within a few minutes, one of my services noted that my messages had been redirected to a land line. At this point, because I had said in the texts that I would report them, [redacted] called me and said they did get my messages, but that they were difficult to read(?). I gave her an overview of all the deceit and trouble they had provided us, which she did not even try to dispute, and I told her that, as they are a ministry, I would work with them if they would simply own up and tell me they needed my support, but that if [redacted] continued to deal with us in an unprofessional and unethical manner, I would not hesitate to report her and her ministry to all pertinent agencies. [redacted] agreed, but the problems returned not even a day later.

Regardless how many times I warned the Ministering Angels that I would report them, I was informed by our most recent caregiver that [redacted] and [redacted] thought I was just making idle threats. When I informed them that I had indeed begun reporting them, they gave my brother (Dad's POA) their two-week notice before stopping services. When they received copies of two reports I had filed, they stopped services before even a week was up. There is so much more I could detail here, but I have documented it all elsewhere and can provide it later if requested to.Desired Settlement: My desired outcome through the Revdex.com is for the Ministering Angels to refund us monies we paid them for services they promised, but did not deliver over the course of 16 months, which I will accept in lieu of whatever amount in damages I may be entitled to through filing a personal lawsuit against them.
