I am rejecting this response because:I have had used forklift batteries for yearsI know how to treat them.The last one I had was a 70% battery that lasted years.I was never offered a full or even a partial refund when the 1st cell was replacedI was told there was only the option to replace the cell and Steve said he would try to get me a discount on the cell replacementI agree you did replace it at no charge.If I was given a full refund option I would have gladly taken it.My point is that you knew these batteries had a history of cell problemsI'm pretty sure the one I bought was a warranty return that you fixedSince these batteries were made for and only sold by your companyWhy else would you have an almost new battery being sold as used? Why do you not sell them anymore? Why did Steve tell me you had problems and discontinued them after the 1st cell died? Why have other forklift dealers had problems with these batteries.I am not asking for a full refundYes you had hard costs into the battery but also profit.What I am asking for is 20% of what I paid for the battery that has failed twice in a year and a half.I'm not going to debate this and toss blame back and forth anymore.If my offer is not something you will do then I will see you in court and provide witness's that also can verify in warranty failures of these batteries and I will subpoena Steve to testify about not ever offering me a full refund and all of your records relating to the failure historyI will also ask for a full refund of the battery cost.I am willing to settle right now for $500Sincerely***

Dear Sir or Madam: We would be more than willing to refund this customer the requested $if we can have the battery back That said, the customer has refused to let us have it As stated by the customer, we only put a day warranty on this battery The battery was
discounted significantly to reflect condition As a good faith gesture, we did replace one cell days after the sale at no charge Now that another 1-1/years has past, the customer has had another failure This is why the battery only had a day warranty and not years like a new product would In closing, we feel we have been more than fair in responding to this matter Respectfully, Gene ***

Dear Sir or Madam: To begin, we need the old battery returned as it needs to be sent back to the DC in California for further analysis.  If they determine additional credit should be given in this case, we will certainly pass this on to Mr. [redacted].  If not, all we can offer is the $500 in scrap value.  Given the low hours that Mr. [redacted] claims he has on this battery is a definite red flag in many cases.  If this battery was not properly charged (correct charger sized for this battery), or allowed to sit in a discharged state, this battery is quite possibly sulfated which will lead to reduced capacity and/or cell failure.  That said, we are not insinuating that this has occurred, however, the battery needs to be opened up in order to rule out customer neglect. It should be noted that the customer was informed truthfully about the problems we were beginning to see with this product.  Our Sales Representative recalls Mr. [redacted] saying he was willing to gamble on it at the time the first cell failed stating he was not planning on using the truck much.  If he would have requested a return at that time, we would have gladly refunded his money in full...not a year and half later.  Mr. [redacted] needs to keep in mind that we had "real" costs with this product as well.  If we can push the manufacturer to give us more, we will certainly pass this on as mentioned. In closing, we believe we were very fair with this sale.  A used battery rated at 83% (which this one was) is selling for $2,950.00.  We sold this battery for much less, as well as replaced a cell outside of the stated warranty as a show of good will.  We sincerely hope we can come to a conclusion to this matter that both parties can agree upon. Respectfully, Gene [redacted]
