June 18, 2015This is in response to a *** *** complaint about unsolicited email from MBRTAs he said in his complaint, he was instructed to click "unsubscribe" to stop receiving our emailThis is proper protocol of any reputable companyThese companies have a national service provider that
maintains standards and requires the use of an "unsubscribe" link in their emails*** *** did not follow this simple procedureIn our case, we actually have two "unsubscribe" links-one at the top and one at the bottom of all our emails which offers a greater opportunity to "unsubscribe'This is in complete compliance with national and state requirementsMBRT is not a spam entity, but a reputable organization with strategicalliances from federal government agencies to help all (not just minority) small businesses who are interested or doing business with the federal governmentIn this case, Mr*** stated that he is registered with the U.SSmall Business Administration for help and assistanceWe partner with SBA and share information for the benefit of proving services such as the example: "How to Win International Contracts" with federal government speakers.After I received your letter, l immediately contacted our web master/lead designer and asked her if MBRT was in compliance with all laws concerning the internet and she said "yes"further asked if his email address had been deleted and she said "yes" it had been deletedSo, this matter is closed.As far as some other email addresses that he mentioned and wouldn't disclose, would have no knowledge of how I would be able to delete it without knowing itFurthermore, if for some reason he receives another email from us, all he needs to do is simply hit the "unsubscribe" link which is there for this purpose.Please close this matter and do not reveal the name of my webmaster/lead designer or release or disclose my emails to anyone.Thank you,Roger *C

I am rejecting this response because of many reasons MrC*** chooses to ignore and sidestep. My wife's personal email as well as my personal email,as well as my business emails are NOT registered with the SBA and he did not get them from there. I am not a member of the SBA, I am NOT a minority nor do I meet any qualifications posted on MrC*** web site therefor he has no legal right to intrude on my personal email much less a business one. Under Florida law, as many times previously explained in emails with a Cease and Desist, the onus of "Unsubscribing" to something a consumer did not subscribe to in the first place, never had any dealings with, etcis placed on the sendee and NOT the recipient. In fact by clicking on "Unsubscribe" it gives some companies the errant claim that there was at some point an existing relationship with the reciient. Like telephone calls, Florida law states the same regarding unsolicited emails, legally trmed Spam; it does not matter what state the call or email originates from but the fact the recipient of an unwanted call or email is in Florida.Again, MrC*** acknowledged this when he was told to Cease and Desist sending emails to my wife's account when he removed it from his list, demonstrating culpability. A few months later he began inundating my personal email and when given a C&D there began sending emails to my business email. The burden of "Unsubscribing" from anything not requested is on the individual who originated it and not the consumer
