I sent a deposit to purchase a Yorkshire Terrier from [redacted] at Miracle Yorkies. I had a emergency come up & thought for a couple of hours that I could not take the puppy; however, I notified [redacted] that I could go through with the deal. Unknown to me, she had sold the puppy within 2 hours of my email. Her business practices are questionable in the first place. She was withholding medical health certification & the AKC transfer of ownership unless I would pay her an additional amount over $100. All I want is my $450 deposit returned & thus can be closed.Product_Or_Service: Deposit for Yorkshire TerrierDesired SettlementRefund of my $450 deposit immediately.Business Response Miss [redacted] placed a NON refundable deposit on a puppy from me. On 5/19, two days prior to the date she was supposed to pick up the puppy, she informed me in no uncertain terms that she was unable to obtain the puppy due to a family emergency and that likely she would NEVER be able to get a puppy ever. She also stated, and I have her email, that she understood that the deposit would be retained. Approximately 12 hours after telling me she was unable to get the puppy, she sent me another email, and this email was at 2:30am in the morning while I was sleeping, saying that she now again wanted the puppy. By this time the puppy was already sold to someone else who also left a deposit. I informed Miss [redacted] that the puppy was already sold and that she could use her deposit on another puppy. I also offered her a retired adult. She has continued to harass me with approximately 20 emails in one day saying she does not want another puppy, she wants the puppy she wanted in the first place. I apologized and sympathized with her but again told her the puppy was already sold. I also finally told her that any continued emails of this type would be treated as harassment and she is still sending me harassing emails. I have composed a letter to her stating that again I am sorry and I am sending her a partial re reimbursement of the original deposit out of the kindness and goodness of my heart. I have supplied her for the last six months with pictures, information and hours of my time preparing her for her up and coming puppy which is what the deposit is for. I have no obligation to return her deposit, however again, I am sending her at least part of it for her trouble. Any continued harassment from her will be seriously taken by me and will have to be addressed in an adult and legal manner if she does not stop with the emails. I am a very small in home breeder and have limited puppies which I don't even profit from so this is not acceptable behavior by her.Consumer Response If Ms. [redacted] sends the refund that is ok. I am not harassing her at all but exercising my right as a consumer. Ms. [redacted] needs to learn a lesson as a business owner & stop being so sensitive when customers challenge her. I have discovered additional complaints on the internet concerning her business practices & am very glad I did not go through with the purchase of a puppy from her. If my deposit is returned, I will consider this case closed will not need to have any further contact with Ms. [redacted].Final Business Response The lady who is complaining sent me an email 2 days prior to her picking up her puppy and I still have the email which stated "I am unable to get the puppy now and probably never, because of my husband's emergency back surgery which will require all of my time with him in rehab. I understand the deposit is non refundable and I hope you find the puppy a nice home". Upon receiving this information, I found the puppy a new home. The next day the complainer emailed me saying now she wants the puppy. I offered her another puppy but she refused and said she wanted that puppy. I explained that the puppy has already been sold, apologized and sympathized and tried to make other offers to her but she refused them all. She harassed me continually all day long with numerous emails. I finally told her she needed to get hold of her emotions and move forward and that any further messages from her would be considered harassment. After that, she sent at least 10 more harassing emails. Also, every puppy I find a home for comes with a full set of medical records, shot records and deworming. Also, the AKC papers are not over $100 they are $50 extra and are offered to the client after they prove their puppy has been neutered or spayed. I have already sent her a partial reimbursement. I believe her complaint is unwarranted and is a harassment. Thank you. I am a very small in home breeder and I do not even profit from what I do.
