Mirak Hyundai wrongly states we had taken delivery of our vehicle on October 15th 2016.We picked up our vehicle on October 13th 2016th and paid for the repair the same day.Copy of the credit card slip is available. After contacting [redacted] , [redacted] and our local Hyundai dealer, we know that there is no warranty coverage for the work that was done by Mirak Hyundai.Our vehicle is drivable so we could drive home to Canada.The shudder when engaging the clutch, still has not gone away.To get this fixed we would need to get a new clutch installed at full cost to us (cost estimate ca. $1300 CAD).Our request for a refund of the repair costs (less the costs for towing) is based on talks with 3 different car mechanics and an e-mail from the service manager from our local Hyundai dealer stating that there was no need for a clutch replacement.We took the old parts with us and had them examined by the car mechanics and the service manager.The experts even say that our car could work with the old parts put back in.The marks of a grinding tool on our old friction plate are a stark indicator of a cover up by Mirak Hyundai to justify the clutch replacement.See attached the e-mail from the service manager of our local Hyundai dealership. As I am told, Mr*** was given an option to drill out the bolt and was explained that this may not work & full replacement might be the final remedy which would be more expensiveI do not have anything in writing that shows Mr *** signed off on this and therefore Mirak Automotive Group
will agree to his request to be refunded

Listed below are the steps taken in the repair process of the vehicle belonging to Mr & Mrs Kopp Vehicle to towed to the dealership on 10/10/16, vehicle will not shift and has a very soft pedal.Vehicle was inspected on 10/11/by the technician.Technician found that the clutch was not
grabbing at all, the clutch was moving back and forth inside the transmissionbut was not making enough contact to allow the transmission to shift.Clutch master cylinder fluid level was checked,Fluid level was full, pressure test done on the Clutch master cylinder and the slave cylinderpressures were at factory specifications and both components were operating normal.Service advisor contacted the customer and and authorization was given to replace the clutch.Parts ordered on 10/11/16, parts arrived on 10/12/16Work started on the clutch replacement on 10/12/and completed on 10/13/16During the dis-assembly process the slave cylinder required removal from the transmission for access,while removing the slave cylinder the flange on the side of the slave cylinder broke, due to excessive rust.The slave cylinder was replaced due to breaking during the dis-assembly process, the slave cylinder was functioning100% and was not the cause of the clutch failure.The clutch parts, most notably the clutch plate, clearly showed at least one of the rivetsrubbing on the pressure plate, which is an indication that the clutch is worn to the point of replacement.The flywheel required replacement due to excessive heat spots on the surface.The vehicle repair was completed on 10/13/16Customer took delivery of their vehicle on 10/15/16.Customer contacted us on 10/20/and stated the vehicle had a little shutter when engaging the clutchInformed the customer that the parts are covered by Hyundai for months or 12,miles at their local Hyundai dealer.Customer contacted us on 10/24/to inform us that dealer would not cover under warrantybecause the repairs were completed in the United States.Informed the customer that the parts are covered and the dealer in Canada should cover he faulty part(s) under the Hyundai warrantyI contacted Hyundai Motors of America and the response from them is the parts are covered for months or 12,milesand the dealer in Canada should handle the repair accordingly, this information was given to the customer.This vehicle did require a new clutch, the slave cylinder was replaced due to damage during dis-assemblynot because of any malfunction as the repair shops are indicating.The vehicle was towed into this shop because it it wouldn't shift, vehicle could not be driven.After the clutch replacement was completed the vehicle was road tested and drove as designed without issue.After the customer took delivery of the vehicle the customer drove this vehicle to Canada without issueDiscussions with the *** and the dealer in Canada were how to get the defective new part that caused the shuddering covered under warranty in CanadaThe dealer himself said he would handle it with Hyundai warranty in Canada
