Mission Financial violated FDCPA Laws and State of Georgia laws regarding improper repossession procedures regarding a 2014 Volvo 760 (commercial vehicle). State of GA law requires creditors to provide consumers with notice that indicates that I have the right to cure the default by paying past due amounts or paying the loan in full. I should've been given the opportunity to buy back my vehicle in a public auction where I would have been allowed to bid on said vehicle. I never received notice of when or where the vehicle would be placed in auction. I was also never given the opportunity to retrieve personal property from the vehicle. Mission Financial also violated state law by contacting family or friends in an attempt to collect a debt.

On or about 6-15-17, Mr. approached Trinity Truck Sales to purchase a 2017 Volvo VNL780. Unable to pay the full purchase price, an application was placed with Mission Financial Services Group Corp. (Mission) to secure financing for the purchase. Upon Mission's approval, Mr. signed a commercial note and security agreement to be secured by the title to the above referenced commercial truck. The loan had an opening loan amount was $37,137. and was scheduled for 33 monthly payments of $1,664.94 commencing 7-15-17.
After making approximately 18 monthly payments, Mr. defaulted on this contract by failing to make his X-XX-XX payment. On 6-10-19, Mission had the vehicle secured by a third-party agency. One the same day, Mission issued a Notice of Intention to Dispose of Motor Vehicle (NOID) and sent it to Mr. at the last known address via certified mail in accordance with state law. The NOID provided the amount due at the time of repossession, the process to redeem the vehicle, the right to public sale and notice for personal property redemption. Additionally, the NOID provided the time allowed for payment to redeem the vehicle and stated that failure to redeem the vehicle I the time allotted could result in the sale of the vehicle, providing the right to Mr. to demand a public sale.
Mr. failed to contact Mission in the time allowed to redeem and the vehicle was sold on 10-24-19. Net proceeds were applied to Mr. account and the remaining balance is now due.

On or about 4/15/19 I was contacted by Mission Financial stating I was late on a payment for the vehicle in question. I stated that I was on time with payments and that a payment was made for the vehicle a week before. The associate checked her file and stated that an error was made on their part and that I was indeed on schedule. On or about 5/1/19 I received another call stating that I was now two months behind. I asked the calling associate to get a manager on the phone because I was not delinquent affording to my records. A manager came to the phone and agreed to go over the account with me. After reviewing the account the manager stated that she could see that I was actually given an extension on one month for a partial payment and that the account should have been brought current but was never corrected. I provided emails and receipts of payments for months prior and all was well. On or around 6/10/19 Mission Financial violated GA repossession laws by repossessing the vehicle that was current on payments. Repossessing vehicle from a private drive, etc. Additionally, a NOID for the vehicle in question was not sent out til after the vehicle was SOLD in auction. The certified letter was mailed out months after the vehicle was sold by Mission Financial. I was never allowed an opportunity to buy back the vehicle, prove payment history was in good standing, or retain personal property and belongings from the vehicle. Mission Financial does not handle business in a legitimate way with paying citizens and demand that this business books and record transactions be carefully monitored.

Mission follows all fair debt collection procedures as well as State and Federal regulations. All payment histories, account notes and documentation have been recorded properly. Customer vehicle was repossessed and disposed of lawfully in accordance with standard industry practices. Customer owes a deficiency balance. Below is a timeline of events that transpired since the second extension payment had been offered to Mr. in attempts to keep the account current and provide relief for the repair of the vehicle.
01/31/19 - Mission offered Mr. a second extension to allow account to remain current. Mr. agreed and Mission received extension for payment due on 01/15/19. Now due for 02/15
02/21/19 - Mission received full payment for payment due on 02/15/19. Now due for 03/15/19
03/30/19 - Mission received full payment for payment due on 03/15/19. Now due on 04/15/19.
04/24/19 - Customer contacted Mission to obtain additional financing for the repair of the vehicle and Mission issued an approval to refinance the account. Mr. did not accept the loan for repairs and refinance the account.
05/03, 05/06, 05/08, 05/09 - Mission attempted to contact Mr. regarding the approval offered and to inquire on his intentions with the account.
05/10/19 - Mission spoke with Mr. and explained the account status for payments due on 04/15 and payment coming due on 05/15. Mr. stated that he understood account status and made a promise to pay on 05/17/19 for full past due. He refused the refinance of the account at this time.
05/17 - Held conversation with Mr. and he informed Mission that payment will be made within the hour. Account payment history was explained to Mr. and he agreed payment due for April and May.
05/20, 05/21, 05/22 and 05/23 - Mission attempted to contact the customer regarding payments due on the account.
05/24/19 - Last conversation held with customer. Mission notified customer that the account is past due for 2 payments and would accept one full payment to keep the account current. Mr. terminated the call without bringing the account current.
06/10/19 - Mission assigned unit for repossession with payments due for 04/15/19, 05/15/19 and another payment coming due on 06/15/19. Vehicle located at Vanguard Truck Dealer, 700 Ruskin Drive Forest Park, GA XXXXX
06/10/19 - NOID issued upon repossession of the motor vehicle- Certified Mail # XXXX XXXX XXXX XXXX XXXX XX - XXXX Rosebud Drive Unit 1104 Loganville, GA XXXXX. This was the last know address of the customer.
06/11/19 - Vehicle taken to Insurance Auto Auctions stock number XXXXXXXX and held for response from customer on notice given regarding methods of redemption, notice of state law regarding the sale of the vehicle, redemption of personal belongings and amount due on contract.
10/24/19 - Vehicle sold to the highest bidder on auction after providing more than an adequate time allotment for the customer to contact Mission regarding the status of the account, redemption of the vehicle or the collections of personal belongings.
11/07/19 - Sent a letter of deficiency to the customer giving notification of the sale of the vehicle and the deficiency balance owed by the customer. Notice provided information on settlement opportunities and to contact our office within 20 days.

TO SAY THE LEAST, MISSION FINANCIAL IS THE WORST CUSTOMER SERVICE, I CALLED AND SPOKE TO A REP, REQUESTED A MANAGER AS I HAD A FEW CONCERNS, I WAS FORWARD TO THERE CORONA OFFICE MANAGER JESSE, I WAS SHOCKED TO HEAR SOMEONE LIKE THAT IS CONSIDERED AN OFFICE MANAGER, THIS COMPANY WILL MISLEAD AND CHARGE ABSURD FEES, AND MR JESSE WAS UPSET I WAS NOT OKAY WITH THESE FEE'S, I REQUESTED SOMEONE ABOVE HIM HE REFUSED TO TRANSFER ME CLAIM HE DID NT HAVE ANYONE ABOVE HIM? I ADVICE IF HE OWNED COMPANY, CLAIMED HE REPORTED TO CORPORATE THERE FOR I REQUESTED CORPORATE WELL HE THE AUDACITY TO HANG UP ON ME. NEVER IN MY 10 YEARS OF MEDICAL COLLECTION HAVE I HUNG UP ON A CUSTOMER. IF CORPORATE READS PLEASE RE-CONSIDER WHO REPRESENTS YOUR COMPANY, ALL COMPANY'S BEGIN FROM SCRATCH TO HAVE SOME UNEDUCATED BEING RUIN YOUR BUSINESS AND REPUTATION. I AM NOT ABLE TO SUBMIT WITH OUT SELECTING A STAR PLEASE KNOW THAT!

Mission financial did me right as long as you stay intouch with them they will do you right to their was a couple of months I didn't get to run very much and I called Sheri and she would work with me and let me catch up some of the employees at mission did not have a good attitude but most of them would do what they could to help me

Mission Financial offers the worst customer service ever. My husband and I financed a tractor trailer with this company. Our payment is due on the 5th of the month. We have never been 30 days late with the company however we are yelled at, talked down to, and threatened with repossesion. Ms. M who works there is very negative and bi polor. I have refused to take an phone calls from her because of how rude she is. AWFUL CUSTOMER SERVICE!!!

Today (11/18/17) at 10:48am my husband and I were contacted by *** with Mission Finical Services, ext 231. She immediately started off the phone call demanding $4,400 otherwise our commercial vehicle would be immediately repossessed.

My husband and I, confused, as we had no knowledge that anything was late let alone in jeopardy of being repossessed asked some questions and for her to verify her records because we knew we were not behind. She began screaming profanities, making threats, and refusing our one payment of $1,453 until we could talk with our regular account manager during normal business hours.

We made attempts to speak with other representatives because of her refusal to let us speak with a manager, each call she would take the phone from the different person we would speak with, scream and hang up on us. Assuming they are all in one office, my husband was able to find a separate contact and get in touch with a higher up to resolve the issue.

Contact by the Business I would hope this business has the integrity to remove this person from their place of business. I would also like peace of mind that someone who is that mentally unstable does NOT have access to my personal information, such as my address and banking information as it was all used against my husband and I in her threats.

Dear Sirs / Madam;

In reviewing the above referenced complaint our records show that this account was two installments past due as of November 18, 2017. This account was past due for October 10, 2017 and November 10, 2017 installments for the total amount of $2,739.35. Mission's default policies are once the account is two installments past due Mission may enforce the terms of the Commercial Note and Security Agreement.
On November 18, 2017 our representative spoke to our customer and informed him his account was seriously past due and was being reviewed for possible repossession, and the past due account needed to be brought up to date. He replied that his wife would make the installment for October 10, 2017 next week and pay the installment for November 10, 2017 the week after. Our representative advised our customer that these arrangements were not acceptable and Mission would continue with the collection effort. Apparently the conversation got heated and our representative terminated the call. In the complaint our customer claims that he had no knowledge of this account being past due. Our records indicate that prior to the conversation on November 18, 2017 the customer last paid on October 12, 2017 for his September 10, 2017 installment. At that time our customer promised to pay the October 10, 2017 installment on October 20, 2017, no installment received. On October 20, 2017 our customer promised to pay the October 10, 2017 installment on October 27, 2017, no installment received. On November 2, 2017 our customer promised to pay the October 10, 2017 installment on November 3, 2017, no installment received. On November 6, 2017 our customer promised to pay the October 10, 2017 installment on November 8, 2017, no installment received. On November 10, 2017 our customer promised to pay the October 10, 2017 installment on November 14, 2017, no installment received.
On November 18, 2017 our customer called our office after our representative terminated the call and spoke to me personally (***). I explained to our customer the status of the past due account and Mission helped him by accepting one interest installment for October 10, 2017 installment and one full installment for November 10, 2017 installment showing the account next due for December 10, 2017. The much smaller interest payment for October 10, 2017 will move his due date up one month and put the full October 10, 2017 installment at the end of his Agreement which will extend his Agreement by one month.
Please note that the customer has two accounts with Mission and may have gotten the accounts confused. This account is next due for December 10, 2017 and the second account is next due for December 2, 2017. Mission Financial Services feel this matter has been resolved.
