Mission Market
#222222;">Mission BlvdSan Diego, CA 92109Dear Sir or Madam:My name is *** *** and I am the *** ** Mission Market. I have been the sole proprietor of this business since 1983. This is the first time that we have received a complaint. I would like to address the allegations made by *** *** and respond as follows:*** *** entered my business on June 22, with the intent to purchase a couple of bottles of wine. The wines that we carry have a price label that specifically identifies for our customers what the price is for each bottle. At the time of her visit she brought up two bottles of wine to the counter for me to ring up. While talking to her she indicated that she thought that the price of the wine was too high. I explained to her that the prices on the labels were the price of the wine not including tax Our company procedure when dealing with customers is to always be up front with them and provide them with quality items and service. I believe that *** *** has made these allegations not based on fact but based on her feelings of being refused service in our establishment. The issue that she alleges regarding the “rounding the total” is a service that we provide our beach customers who are traveling on foot or by bicycle as a courtesy so that minimize change in their hands on their way home. However, that courtesy that we provide does not in any way impact our payment of the required sales tax regarding those items. We report our sales using purchase ratio method as allowed in sales and use tax regulation With the respect to income taxes we report our total gross receipts At no time have we sold any items that are beyond their freshness date nor have we ever received any complaints or citations regarding the taste or quality of the foods that we provide in our deliOur grade for our deli has been always "A" by the Department of Environment and Health. We are requesting that this complaint be removed from the file for Mission Market.Best Regards,*** *** ** Mission Market

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID *** and have determined that this proposed action would not resolve my complaint. The business has not properly explained their methods for alcohol purchases and tax, as well as not honoring the prices marked in the storeAdditionally, the owner completely skipped over the reason I was asked to leave the store (prices marked did not match total and he wouldn't show me a receipt to prove the elevated total came from his claim of taxes), and has made no attempt to rectify the situation.
The business owner made no attempt to apologize or correct actions from my original complaintThe business owner did not address taxes for alcohol, which are completely separate from tax regulation he mentionedAdditionally, the prices marked on the bottles of wine I attempted to purchase were not honored at the checkout counter, and no attempt to show record of that transparency was made availableInstead, I was told I needed to get out of the store, and while I respect an owner's right to deny service to whoever they want, I believe I was shamed out the store for demanding transparency as a customerAs a consumer, I have the right to be able to purchase items at prices marked in the store, and should have full visibility in regards to total and taxesI deserve an apology for being told to leave because I wanted to exercise my rights as a consumer, and I ask that the business improve their methods for marking items and being able to provide itemized receipts.

Review: This store does not offer itemized receipts for purchases, and the total price amount tends to always be an even number, which means they are "rounding" the total instead of charging you an exact price with tax. A lot of items do not have a price marked on them, and you can pay two different prices for the same item depending on which cashier is working. Product items are also advertised with false prices that are not granted at checkout, and I have seen food items that are expired on shelves. The visual appearance of the deli section is also questionable, and should be further inspected for safety purposes.Desired Settlement: I would like this place to be investigated for how they are filing their taxes, and how they are charging for items. I would also like to see an inspection made to ensure all of the food items are not expired in this store, and that the meat and deli section of this store are inspected for sanitation and safety for consumers who make purchases at this store. If they are unable to pass an inspection, I would like to hope they are closed down for poor business and safety practices.

Dear Sir or Madam:

My name is [redacted] and I am the [redacted] Mission Market. I have been the sole proprietor of this business since 1983. This is the first time that we have received a complaint. I would like to address the allegations made by [redacted] and respond as follows:

[redacted] entered my business on June 22, 2014 with the intent to purchase a couple of bottles of wine. The wines that we carry have a price label that specifically identifies for our customers what the price is for each bottle. At the time of her visit she brought up two bottles of wine to the counter for me to ring up. While talking to her she indicated that she thought that the price of the wine was too high. I explained to her that the prices on the labels were the price of the wine not including tax.

Our company procedure when dealing with customers is to always be up front with them and provide them with quality items and service. I believe that [redacted] has made these allegations not based on fact but based on her feelings of being refused service in our establishment.

We report our sales using purchase ratio method as allowed in sales and use tax regulation 1602.5. With the respect to income taxes we report our total gross receipts.

At no time have we sold any items that are beyond their freshness date nor have we ever received any complaints or citations regarding the taste or quality of the foods that we provide in our deli. Our grade for our deli has been always "A" by the Department of Environment and Health.

We are requesting that this complaint be removed from the file for Mission Market.

Best Regards,

[redacted] Mission Market

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint. The business has not properly explained their methods for alcohol purchases and tax, as well as not honoring the prices marked in the store. Additionally, the owner completely skipped over the reason I was asked to leave the store (prices marked did not match total and he wouldn't show me a receipt to prove the elevated total came from his claim of taxes), and has made no attempt to rectify the situation.

The business owner made no attempt to apologize or correct actions from my original complaint. The business owner did not address taxes for alcohol, which are completely separate from tax regulation 1602.5 he mentioned. Additionally, the prices marked on the bottles of wine I attempted to purchase were not honored at the checkout counter, and no attempt to show record of that transparency was made available. Instead, I was told I needed to get out of the store, and while I respect an owner's right to deny service to whoever they want, I believe I was shamed out the store for demanding transparency as a customer. As a consumer, I have the right to be able to purchase items at prices marked in the store, and should have full visibility in regards to total and taxes. I deserve an apology for being told to leave because I wanted to exercise my rights as a consumer, and I ask that the business improve their methods for marking items and being able to provide itemized receipts.
