Approx 8/16/19 traded in my 5065E tractor and equipment for a new 2018 John Deere 5075E tractor and equipment. Approx 2 wks later while in hay field tractor quit. Salesman told me to call shop new tractor - warranty would cover. So I called shop and they sent mechanic out and he cleaned out filter in tank and was supposed to go back and tell service mgr that the tank needed to be taken off and cleaned out or replaced - which he did not do (tractor was new but was a yr old because it had been setting up and had been priced it to sell to get rid of). The diesel in the tractor was what the dealer put in it to deliver it - was not filled from my tank. Warranty didn’t cover and they charged me $400+/- which I refused to pay because salesman told me wrong. He told them it was his fault and I didn’t have to pay. And mechanic never told service mgr what the tractor needed or it was ignored by service mgr.
Tractor started quitting on me approx Feb 6, 2020. I went to dealership and met with Troubleshooter and service mgr and we went over all problems I was having I told both of them when tractor was in shop look at it and if it was going to cost me anything to call me first they both said that was no problem. At that time I would either refuse anything further or I would authorize the work Then approx 2/10/20 tractor was in shop and they started working on it On about 2/12/20 I got a call from service mgr that tractor had been fixed - they removed tank and cleaned it out and replaced it on the tractor which was going to cost me $547.93. They never called to let me know what it was going to be or anything My problem is - I buy my diesel at the same place they do The trash in the tank was in tank from setting up for so long and it was in it when they delivered tractor to me If they had cleaned out in the beginning before they delivered tractor there would have been no problems. I dont think I should have to pay full amt If it had been checked out before delivery they would’ve found

In response to the referenced complaint, several false statements appear in the original complaint.

1.Mr. states "two weeks after he received tractor he had his first trouble. That would place the date at or around September 1, 2019. The machine was delivered August 21. 2019.

The repair complaint was called in October 8, 2019. 1 month and a half after the initial delivery.

2. The salesman did say warranty should cover the failure. This was with the understanding it in fact was "warrantable" Infusing trash in the fuel system from an outside source is not warrantied failure.

3.Mr. states "the technician was going to tell the service manager what he found, but did not." He did in fact advise the service manager as to the trash, and Manager (and Tech) advised Mr. would continue to have these issues as long as he continued to fill from his tank without a filter.

4. Mr. states "The diesel in the tractor was what the dealer put in it to deliver it." This can't be possible in any realm. The tractor had 22 hours on it at the time of our October 8 service call to repair . Records indicate there were 2.2 hours on the tractor at delivery. That would mean the tractor would have to have logged 20 hours since delivery. This tractor will only run 6.5 to 8.0 hours of operation on a full tank of fuel. That said. The tractor would have had to been refuel at least once and possibly twice.

5. Mr. did not pay the original repair as he stated in his complaint. The salesman paid for it because of the misunderstanding in communication in above item (2)

6. Mr. states "They never called me to let me know what it was going to be or anything." This is also not correct. Our service manager did call and advise him it was the same issue as before (trash had been introduced into his tank. ) He asked how much would that repair be. Our service manager responded "somewhere around $500.00. I don't know for sure right now." I would be remiss if I didn't add: Our service manager also sent a truck out to pick up the tractor and bring it in to the shop at "no cost" to Mr.. This is almost never done. We have industry warranty standards that Deere does not warranty any pick up and delivery nor drive time. This was one further attempt to satisfy our customer.

7. Mr. states " I buy my diesel at the same place they do." That may or may not be so. That conversation has never come up. We don't know now nor have we ever known where he purchases fuel. I would suspect he knows as much about Mississippi Ag's business as well.

8. Mr. states "The trash in the tank was in tank from setting up so long." Mr. has admitted he doesn't have a filter on his bulk fuel tank. Mr. admitted to our salesman *** as late as last week "I had only filled it up once".

The fact of the matter is; the tractor has been run a total of 75 hours since delivery. If the unit had been delivered with a full tank of fuel, that would leave approximately 67.5 hours or approximately 8 refuels.

Mississippi Ag performed every step of these two repairs with the customer satisfaction in mind. Mississippi did not continually replace contaminated fuel with contaminated fuel. It isn't incumbent on Mississippi Ag monitor the customer's business plan in any way. It is our responsibility, duty and privilege to provide fairness, communication, and service in favor of our customers. We do so with pride.

I am attaching supporting documentation from out checklist at delivery and repair orders.
