I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint.? For your reference, details of the offer I reviewed appear below.? Paragraph Four of the response by Misty Shores Events, Inc is a flat out lie.? I never received ANY notification that the barn would not be completed.? I was NEVER offered a refund of my money.? I was NEVER? given a choice of canceling or having a lakeside reception.? Ms [redacted] kept insisting that she hoped the barn would be done in time and it wasn't EVER flat out stated to us that the barn would not be completeParagraph Five, there were emails exchanged as I stated and I also have all the copies of.? We were never given a choice to cancelTo say that we all decided to have the reception at the lakeside is absurd.Paragraph Six, I had stated the same as to the changing of the price and have Ms [redacted] s email stating that the wedding would be at the $price tag with the decor and such as stated in our last meeting in which Ben T [redacted] was a witness to.? Paragraph Seven, There were a few tiki torches at the wedding, I never disputed that but there were bugs everywhere, maybe not mosquitos but my guest list, my photographer, etc all can attest to the fact there were bugs everywhere.? As to whether the area was sprayed I can't say whether it was or wasn't, I can only attest to the fact that there were bugs everywhere!? To try and say there were no mosquitos ever on the property is impossible as it is out doors and do not need standing water to attract mosquitos.? In their reponose though all is stated is that Misty called to check the availablity of having it sprayed not that it was indeed sprayedNo pictures were attached as to the tiki torches or the citronella they claim were litlast Paragrait is understood that what was provided cost money, it is not my issue how? much it cost.? I was contracted an original wedding that was not fulfilled.? Agreed to a 2nd wedding being we had no choice with the timing of when the truth was realized.? Second wedding agreement was not fulfilled.? ? The amount the Misty Shores events, Inc does not really matter in this instance.? The attached amended contract was never signed by me, my husband, or even misty herself.? She made mention that at our rehearsal she would like us to sign an amended contract (seriously, the day before the wedding) but she never once showed or asked us to sign such contract.? Today is the first time I have ever seen the attached contract.We feel that we are entitled to a FULL REFUND as NOTHING that was contracted and promised came to light, let alone the stress and mental anguish we still feel to this day.? I completely reject Misty's Shores Response.? I can provide witness, pictures, and all written communication between Misty shores and ourselves if need be including other brides.? It is stated in the response they feared being sued, but yet still did not provide what was promised and ruined what should have been one of the most memorable days of our lives.? Misty Shores Events is a special events venue located on Lake Erie along Route in Ripley, NY? Owner, Misty [redacted] , purchased the acre property in December of ? The Misty Shores Events website, Facebook page, and other advertising was launched on December 22, 2016.? Owner Misty [redacted] started immediately to receive calls by potential couples wishing to tour the property and discuss options to hold their wedding at the new venue? Simultaneously, Misty [redacted] hired a contractor and architect to create the design for the remodel of the existing Historic Dutch Hoop Barn and a new addition that would include restrooms, changing rooms, and a staircase and elevator to access the second floor loft.? Ripley Township worked closely with Misty [redacted] to secure the proper permits and zoning changes necessary for the business? Chautauqua County Health Department also worked closely between the township and Misty [redacted] to ensure all the architectural designs met their specifications? Construction began in February of ? The contractor originally hired promised Ms [redacted] that the construction would be completed by May of 2017, so Ms [redacted] scheduled a Grand Opening for early June 2017After several months of ongoing construction work by the original contractor, it was evident to Ms [redacted] and her business partners that work was not progressing according to plan? Ms [redacted] began notifying couples that had booked weddings in June, July, and August that construction was not finished? All these weddings were moved to other sites and full refunds were given to each of the couples? A new contractor was hired in August to expedite construction? In August, all the September and October couples were informed that the barn and new addition would not be finished in time for their wedding, but that a lakeside ceremony area had been completed where both the ceremony and reception could be fully realized? Each of the couples booked for September and October were given the choice to keep their wedding and reception at Misty Shores Events or to receive a refund and move their wedding? Four couples decided to stay with Misty Shores Events because they loved the lakeside area that had been created by the MSE owner and staff (See attached pictures).? Regarding the couple filing this complaint, emails were exchanged in August stating that the barn construction would not be done, but that their wedding could still take place by the lake? After several emails and face-to-face meetings, it was decided by the couple along with the MSE owner and staff to keep the wedding at MSE and hold all aspects by the lake? (Emails and meeting notes can be provided upon request)The bride provided a binder and detailed pictures and drawings of exactly how she wanted the entire wedding and reception decorated and conducted? The MSE owner and staff worked diligently to make sure every detail was followed: guest tables, the gift table, memory table, bridal table, decorations, lighting, etcBecause MSE could not uphold all aspects of the original contract with the couple regarding the use of the barn, etc, the originally contracted amount of $15,was lessened to an agreed upon amount by the couple and Ms [redacted] of $7,? Several emails went back and forth between the couples and Ms [redacted] to come to an amount that was agreeable to each party? MSE deducted $8,from the originally agreed upon amount? Ms [redacted] worried about the couple potentially suing MSE after the wedding ?" even though the couple agreed to the new location and the new changes ?" so the companies attorney drew up an addendum to the original contract? (See attached)MSE owner and staff made sure that all details for the new wedding and reception design outlined by the bride and included in the addendum were met? To respond to the last comment by the couple in the complaint regarding the following section of the complaint: “I (the bride) asked for a couple things, it (the lakeside ceremony area) to be sprayed for mosquitos as my husband and and I both got eaten alive, tiki torches surrounding the area with citronella in them .” ? Twelve glass tiki torches were purchased and placed all around the area where the reception and socializing took place? Six citronella candles were also lit during the event(Please see the attached pictures showing the tiki torches and the citronella candles lit during the couples wedding.) (Receipts can also be provided of these items being purchased)Also, it is important to note that there were no mosquitoes at the lakeside area or on the property ever seen by any MSE staff or guest the entire year, as the property has no standing or stagnant water? Lake flies are the only thing that was around the day of the wedding and they do not bite, and only are active in the morning? (Documentation can be provided of three companies called by owner Misty [redacted] and a staff member to check on the ability for these lake flies to be sprayed)? In summary, MSE regrets that any of the weddings booked for were not fully actualized? The aforementioned wedding cost MSE in total in hard costs $8,(catering, DJ, table, chair, & linen rentals, salon fee, restroom trailer, fabric )? The couple paid $7,after the amended agreement was reached? MSE had originally contracted with the couple for $15,000, but gave the couple an $8,discount when the barn and addition were not done? In the end, MSE lost $1,plus additional staff expenses on the wedding? MSE owners and partners feel that this above described settlement is fair to both parties.? ?
