405 W. Constitution • Victoria, TX 77902 Office (361)573-4337 • Fax (361)573-1797 [redacted] In response to the complaint we received from customer We are very sorry to hear of this customer's complaint about the window glass he was requesting. Th s customer came to us late November 2015...

complaining about an insulated window glass that a different glass company had recently attempted to install in his home and was looking for our he43 to resolve his issue. He said the previous glass company he used installed a piece of glass that was too thick which messed up his window and ended up breaking after the Installation, He also mentioned that he had problems finding the correct size from other local residential retailers and the home builder, "rhe opening for the glass he needed was 67 3/8" x673/8" with an overall thickness of 5/8". Our suppliers cannot provide us that thickness for this large of a unit due to safety tolerances. The thinnest Insulated unit we could offer to this customer for this size opening was 15/16". We offered to order it with a 3 week lead time and doChe install to our best ability without a warranty. The customer approved so we ordered the glass for him. Upon arrival our installers found the window molding to be damaged from prior attempts to install glass in that window. The install did not go to his liking but the unit was secure and in place so we suggested leaving it in place until a better option came available to him. He complained about the service he received so we waived charges for the glass and materials used even though it was what he asked us to order and install. He then later came back to the store raising his voice and becoming unreasonable with our receptionist. Seeing that he was going to be unreasonable going forward about the situation we politely told him that we wouldn't be able to help him any further. We do not feel that its necessary to compensate this person as we too have lost time and money in the attempt to fulfill his request,

I am rejecting this response because:                                                                                                                                                                January 2016 ID # [redacted] ([redacted])On approximately November 20th, I went to Mitchell Glass Co., 405 W. Constitution St., Victoria, TX.77902 to inquire about a patio glass window replacement in my home, [redacted].  I explained to the front desk staff (female) how in September 2014 DM Custom Homes Builder ([redacted]) had Glass Dr., Co., Victoria, TX, replace the two panel defective glass. The exterior section shattered in November 2015. I also explained I was asking around for bids and had visited Glass Dr., Texas Glass and had spoken to J.W.Marrs Lumber Co., Inc., of Victoria, TX, for quotes, all of which measured correctly and gave me their cost estimates.    I never stated I could not find the correct size, as being stated. I never measured my window and trusted Mitchell with their measurements.  The glass replaced by Glass Dr Company shattered months later, and did not break or was damaged in any way, or the molding damage when it was installed.  Glass Dr. has these records.  The glass fit perfectly and the molding was installed within its space.  Further, I was never informed  Mitchell Glass suppliers could not provide the for the measurements needed, (as being stated) or I would not have approved going further with the Mitchell agreement.  The Mitchell Glass staff [redacted] and [redacted], both acknowledged the size was incorrect and also took pictures of the defective glass, which Mitchell fails to mention.  I further explain below.  I was never unreasonable and only reacted to the staff’s argument with me accordingly. In November when I visited Mitchell Glass the employee told me she would prepare the cost estimate, but that it would be until after the Thanksgiving holidays, and she would call me. She never made any calls to my home.  A day or two after Thanksgiving I went back and the clerk had still not prepared an estimate, or arranged for anyone to go to the house and take the glass measurements, as she said they would. I again made arrangements for someone to come to the house to measure.  A few days later “[redacted] and [redacted]” from Mitchell Glass came to the house and measured the window. Again in November I went back, to Mitchell Glass and was given a written estimate of $584.55(copy available with Mitchell measurements), but I told the staff it was a low e tempered glass. She told me “[redacted]” did not tell her that and would talk to [redacted]. I again had to return for the new quote of $903.89(copy available).  I trusted the measurements, and were never discussed by the Mitchell glass. I was informed she would order the glass and call me when they received it, however never called me.  There was never any mention of measurements to me that could not be met, as it is being stated!!! Approximately 12 days later I called [redacted]’s cell and he confirmed the glass was in and he would be installing it the following week, or so. In mid-December I once more contacted [redacted] and was told they would be at my home the following Monday. I waited all morning and at noon, called the office and was told [redacted] was in Cuero and would not be back until late.  I also called [redacted] and left him a message to confirm and ensure I would be home, and for him to please call me. He returned my call and told me they would come out the following day, Tuesday. When [redacted] and [redacted] arrived, but discovered they did not have the necessary tape to install the glass.  I mentioned leaving the glass in the house so that it would not be chipped, or brake in their truck. They explained they could not do that.  I waited another few days and followed up with [redacted] who told me they would come back out, and would inform me, but I again had to be calling him for updates.  When I called a few days later, [redacted] told me they were busy with another job, but would call to set up a day and time to install the glass.  Days later, [redacted] and his helper again came to the house to install the window glass.I asked [redacted] and [redacted], if they had inspected the glass to make sure it was not damaged, but “[redacted]” told me the glass they originally had on the truck was not mine, so they had returned to the shop for my own glass and it was ok.  They in fact did not inspect the glass condition, or the size measurements. I question if they in the first place had the right glass for my home window! This crew “[redacted] and [redacted]” removed the left over interior glass panel on the house window, taped the edge and struggled to place the new glass; then noticed it was too thick, and defective, and told me they would temporarily place and leave the glass so that I would have something until the new piece of glass was ordered and replaced. They took several pictures.  They left the glass half installed. It was here they and I noticed the frame molding next to the small side window had separated from the center molding frame. I told [redacted] the opening had not been there and questioned the gap happening when they installed their window.  [redacted] told me he would fix the separation.I was not happy with this set-up, but did not say anything, and because I had no choice.  [redacted] then used two pieces of the four inside edge moldings to hold up the glass from inside. He did not take time to make sure the molding pieces were from where they originally were placed, and cut the ends to fit to hold the glass temporarily in place.  It was also during this time [redacted] mentioned the glass was too thick (1 inch, vice ¾ inch) and the glass had taken up the molding gap where the molding was to rest on. The glass size was incorrectly ordered.  [redacted] and [redacted] both took pictures of the defective glass.  After they left I noticed the other two pieces of molding would not have fit, because of the oversized glass.   [redacted] told me he would keep me informed, but failed to do so. Approximately a week later I called [redacted] on his cell and inquired about the status of the order and glass replacement.  He told me “I don’t know I gave it to the front desk”, and added “You have an inch glass there, and you need a ¾ size glass”, call the front desk and talk to them. He also told me “they are trying to find the right ¾ size”. I told him I would think the same company in Houston would have the size.  However he told me he did not know. I mentioned the delay causing heat to escape and drain water to sip through the bottom of the glass and enter the window frame.   He ended the call quickly.  I waited a few extra days, and received no call from anyone.   I again visited the Mitchell Glass office. The employee told me she was still asking around to see who would have the ¾ inch glass and for me to wait until she called me.  She intentionally never called my home. To not make a 5 minute phone call to me is simply inexcusable and was done on purpose, simply had decided not to go forward with their agreement, and could have cared less for me as a customer. On Thursday December 30th, at approximately 9:30am I went to the Mitchell office. The staff member (same employee) told me she could not find the ¾” size I needed and stated “you are on your own”, in fact repeated it several times during the ensuing conversation.  I mentioned that I could not believe no one in Victoria had the correct size. She again repeated she could not help and that I was on my own.  I then I informed the employee  I would contact Texas Glass to do the job, and I needed to know what she wanted  me to do with their piece of defective window glass.  She stated I could have the glass and do whatever I wanted to do with it. She stated she would have to charge me for going to the house to take measurements. I informed her she had never told me there would be any charges for taking measurements, (their own website advertisement so states).                                           ... Page 2 of 4 PagesI am sure Mr. [redacted] whose office is adjacent to the front counter overheard the comment and all the other previous conversations I had with this his employee.  I continued to respond and defend myself toward her rude and abrupt comments; she continued with accusations of sorts and I asked her what I was supposed to do when she told me I was on my own The employee continued to make excuses against me in order to cover up themselves.  I felt discriminated against by the action of the Mitchell Glass staff. They caused me stress and anxiety, and I expressed my resentment in leaving me to hire someone else to finish their project.  I feel I had a contract with Mitchell and they did not complete the contract as we had agreed.  It was obvious during this conversation they did not want to go back to their Houston Company and expose they had ordered the wrong size glass and not be able to get reimbursed, or return the defective glass without further exposing their own errors.  I also mentioned the damage left by [redacted] and [redacted], and how [redacted] had told me he would fix the window frame molding gap.During the conversation another lady (“owner”) stepped into the conversation who argued of unrelated issues in order to take the focus off their own mistakes, and leave me with an unfinished job. I was desperately trying to work with them. I gave them every opportunity to work with me, but they failed.    The argument continued with them bringing up issues not related to them leaving me with a defective piece of glass and telling me I was on my own. I immediately stated they had left me without properly carrying out their part of the contract and were forcing me to find where I could purchase a $500.00 dollar glass, and then find someone else to install the glass for approximately another $500.00.  I told them there I would not pay them anything and that I would “take this up”. There is nothing to waive, Mitchell Glass is responsible for not completing the job.  Mr. [redacted] was in his office for most of this conversation, but walked out.   They immediately begun to apologize and told me I would not be charged and to have a Happy New Year. Needless to say, Mitchell Glass did not want to continue with the job for obvious reasons.  I walked out without responding.Later that same day, December 30th I again went to Texas Glass and briefed the owner of my dilemma with Mitchell Glass Co., and asked if they would come out to the house, measure once more and do the job.  The manager told me they would be out the following day, Thursday, December 31th.  At approximately 1:45pm Texas Glass Co., the manager (owner) and his assistant came to the house re-measured to insure they had the correct measurement, and inspected the gap damage, and were able to determine how to fix the molding gap by adjusting the outside molding and estimated what had to be done to fix the inside gap broken screw and realign the interior molding.  I thanked them for their help, gave them half of the $1,089.00 cost, which was for $500.00 to order the glass. The two men left my home at 3:15pm. In addition, and previously, In mid-December, I had visited J.W. Marrs Lumber Company. I informed the lady there that I had received a response call from “[redacted]” in reference to the glass size if I was interested, he had one.  However, I informed the staff I had contacted Mitchell Glass, and they would be installing the glass, and thanked her for “[redacted]” calling me. (I had also, previously informed Mitchell Glass, Marrs had the glass size, but apparently they ignored me). Previously I had asked the Mitchell Glass staff person to please call J.W.Marrs Lumber to confirm they had the glass.  I did this in order to help Mitchell find the glass size and to continue to give Mitchell Glass my trust, and abide by our agreement.  The Mitchell Glass staff told me they would call Marrs Lumber, but I never received any feedback on this matter.                      Page 3 of 4 PagesOn Thursday, December 31st I submitted a complaint report to Revdex.com and reported my experience with Mitchell Glass.  I have since received a response the report was sent to Mitchell and would be keeping me informed as to the results.
