October 20, 2015Dear [redacted] :This will serve as the response of The Mitchell Gold Cod/bia Mitchell Gold + Bob Williams (hereafter referred to as “MGBW') to the above-referenced complaint.MGBW disputes the information contained in the “Customer's Statement of the Problem” and respectfully requests that none of the information contained therein be re-published; much, if not all of, said information is and potentially actionable in a court of law as being libelousCertainly the statement that “I was lied to at the Tysons Corner store' is such.The complainant received a discount in for purchases he made at MGBW's District of Columbia store, which discount was totally and completely discretionaryHe states that “I was given 10% off using my designer's discount (proof already provided)"We are not aware of any proof of such that he has provided to you or to us, however.In March, 2015, MGBW released a policy intended to provide a discount to designers based on certain conditionsA copy of this policy is attached heretoPursuant to the policy, a designer must complete and submit a registration for considerationThe registration form also requires the submission of (1) a current business license and (2) a current resale or tax certificate, both of which are required in order to document the authenticity and existence of a designer's business as suchThe registration form states:“The above information is subject to approvalDiscount is nontransferable and cannot be combined with any other offers or promotionsWe deserve the right to deny anyone the trade discountAll orders must be paid for in full at time of order placementCustomer is responsible for all shipping costs.” (Emphasis in italics added.)The complainant made purchases of furniture in June, July, August and September of 2015, at prices he willingly and knowingly agreed toAt the time of those purchases neither he nor his designer had ever completed a registration formOn September 20, 2015, after all of the complainant’s purchases, an individual by the name of Anika Angeli of Aline Architecture LLC submitted a registration form but did not submit the requisite (l) current business license or (2) current resale or tax certificateA copy of her registration is attachedFurthermore, she did not make any of the previous purchases herself- the complainant didPurportedly, the submission of the registration form by [redacted] was on the complainant's behalf, though the designer was never listed on the sales order or otherwise mentioned during the complainant's purchases.In order for a designer to qualify for a discount on purchases, the designer must make the purchases him or herselfAs of this writing, the complainant himself has never submitted a registration form on his own behalf.In closing, we reiterate our request that said complaint not be re-published as we vehemently dispute its accuracyWe believe the complainant’s “Statement of the Problem” is, at best, an attempt to retroactively obtain a discount on goods purchased in a manner that is less than truthful and less than transparent.Please contact me immediately if you wish to discuss this matter further, or if you have questions,We thank you for your attention to this matterWe take it very seriously.Sincerely,Phil W Esq.Corporate Counsel
