First, I want to set things straight about her accusations of my financesShe has no idea or any evidence of these slanderous comments Our company, after thirty one years, is going strongI never said what was wrong with her flagstone as I never saw the problemI only speculated two or three scenarios that could be the problemShe selectively heard what she wanted to hearAfter that conversation, I was contacted by the suppliers representative of the product that I used for the joints between the flagstoneHe was contacted by ***, [redacted] to look at the problemWe had a conversation about the problem and what he felt I should doI discussed this with my Forman and instructed him to remedy the problem areas on 7/3/He called me and said that she wanted him to redo the entire flagstone areaSince that would be beyond warranty work and beyond what the representative explained to me, I asked him if she was still there to discuss The issue furtherHe said she had leftKnowing that to do what she wanted was a two day job, I instructed him to leaveThe following Monday morning she called and said not to come on her property The plaster color I told her right from the start is always an issue with calcifying I told her it is difficult for homeowners to keep the PH and alkalinity in checkIt can at times require checking the water chemistry dailyTwice we got her pool plaster "beautiful" (her words)No matter what she heard from an uninformed tech, Her plaster had not been compromisedby us If we are scheduled to vacuum a pool, it is our discursion to brush the dirt to the drain or vacuum the poolAs long as the pool is clean when we leaveI told her last year that she needed new water valves for her caretaker cleaning systemThey were worn and the gears were starting to grindShe said she didn't have the money and asked if we could do it next yearShe contacted me in August 2014, but never decided to sign a contract until SeptemberThis pushed her back in my scheduleWe were done the tile, coping and plaster in four weeksWeather caused some delaysThe lights were done but the transformer was bad from the factoryI don't rush to people who continually threaten calling attorneysEvery one of my workers that had any contact with her has been disrespected by her with her language and screaming but none ever retaliatedWhen she started with me, I wasn't letting her get away with it anymoreAs always, I have and had no problem taking care of all legitimate warranty issuesAt this point I would like to meet with only her attorney at the site with my plaster representative to remedy these issuesThis way there will be no confusion of the factsThat person can contact us at any time to scheduleI will not be refunding any money Kevin M [redacted] Owner Mitchell Pools

At [redacted] ***’s and my initial meeting which I gave him the proposal, I stated “he needed to give me the approval by the end of that weekend to assure completing the project this year.”I also mentioned I had a large project out of town and other people were also wanting the same kind of work doneI received in the mail the signed document and check the following FridayThree customers jumped into the schedule in those four days.There is a small window for reconstruction of poolsSeptember, when people stop using the pool, to November when the weather is too unpredictable to plasterOnce plastered the water chemistry must be kept in check for the day curing time and brushed dailyThis would mean the pools is open and operating into December[redacted] is correct in that the communication has been poor at bestThis typically is not the norm with our companyThe Office manager, who is my wife, and who handles the construction scheduling and phone calls, has been out sick with Chronic Lyme disease since AugustThis coupled with me being out of town with a major commercial project and her week long stay in the cardiac care hospital has been and still is overwhelmingI do not pay attention to unrecognizable phone #’s on my cell or I would be on the phone with solicitors all day.The product that [redacted] has purchased so far is superior work and I am confident the plaster in the spring will be as well At no time was the pool ever in jeopardy of any damageI had called to inform [redacted] I was filling the pool and he informed me he just had it doneAl though I mentioned to [redacted] I would purchase the water to hold for the winter, I was under no obligation to do so because of his delay in the scheduling from the beginningI agreed to this as a good faith gesture because of the lack of communicationAs long as there are no further actions now or in the future I will send the check for the water but reiterate I am not liable for the money.Inclosing, I will send out the money he paid for the waterI have [redacted] scheduled for plaster before May 5th We will contact [redacted] by 4/to give update of schedule I will not put the money in an escrow account as I feel nothing warrants that procedure The product so far is superior, the schedule was delayed from [redacted] ***’s lack of a timely commitment and I am paying the additional water bill.RegardsKevin M [redacted] OwnerMitchell Pools

Prior to realizing this complaint had be filed hours earlier, I e-mailed Mrs *** on the morning of 7/9/After reading the directions and limitations and following the specifications, I explained that after three times of product failure, we needed to have a
manufactures representative come on siteI have since had a conversation with Mrs*** and because I was going on a weeks vacation on 7/11/15, I would have my tech come out 7/and to look things over and call the supplier to have a representative contact us. We did stop at the site and contacted the supplier but we have yet had any contact with the representativeIt is my intention to press the repthis week to meet us on the site to finally remedy this product issueBecause of the very difficult customization of the cover, it took multiple times to measure and much longer to makeUntil it finally arrived, the pool had frozen and was too cold to install correctly.As for the office person hanging up on Mrs***...I have been on vacation and did not read the full complaint until nowI will talk to Mrs*** this week to understand the full conversation and would assume I will be firing that person.Kevin M***OwnerMitchell Pools

Dear Revdex.com,Mr Mitchell is simply trying to get out of backing up his warranty The text I sent to the TECH did ask if I needed to get an attorney because multiple calls and weeks of calls went un answeredMy pool was ripped out and a week project was going on months with no response from the business I was wondering if they were even still in business. Mr mithchell agreed my flagstone was done wrong and the wrong product was used He was trying to quick fix the project instead of redoing it properly I have estimates stating there is no way throwing sand on top would of lasted more than a few months.I told Sheri I was having my annual volleyball party and wanted my brand new pool ready for this party Its been months Im sorry if she felt she was receiving an invitation and did not I don't normally invite people I don't know As for the neighbor, Im not sure what that has to do with my warranty or what he is talking about but it sounds like he is trying to change the subject. The first tech that worked for mithchell pools told me the brick work was one wrong and there is no way Mitchell pools should of had acid running thru my new *** *** for weeks He was soon fired after that. In viewing my security cameras, I was charged for services such as vacuuming that according my cameras, were never done The guys pushed the dirt down into my filter and called it a day The remainder of the security cameras will remain evidence as well for unethical business suit.I had a perfectly fine working pool the $27,renovations was cosmetic so I not sure money was a problem here I do believe Mitchell cant financially back up his warranty and I knew he was trying to get out of doing the work I am allowing people to come to my house and see his work and the condition he left my pool If this is what he means by defamation then it sounds like he is ashamed of his own work.Mitchell was trying to blame a reputable company for the product My husband and I have good friends there We questioned the tech times to make sure we heard him right Then we contacted the companyMr Mitchell was simply mad he got caught in a lie, there was no Mis spoke! *** ***

We received this e-mail on 7/10/I went on vacation 7/11/and did not return until today 7/19/I just read the complaint and am baffled by all the half truths, misinformed confusion and lies
I will start within the fall, two weeks before I told the ***'s the pool
would be finished, my foreman received a text message from *** *** stating "Do I have to get my attorney involved to get this pool finished." This spring *** texted my foreman and said things that at this time I am not at liberty to post as they are evidence in a potential defamation law suitThe next day when my foreman did not respond she called my office and started screaming at the office assistant and accusing him of deceiving herMy office manager, Shari, called her that afternoon and after *** started to yell at her, Shari stopped her and questioned her on the content she texted my foremanAfter a heated first part of the conversation from both parties, ***, *** eventually invited Shari to play volleyball, discussed the sex life of her neighbor, and hired us to do a biweekly service on their pool. After a few trips my two service techs told me they would not go there anymore because she yelled and screamed at them for something that was not there faultShe also accused my foreman of lying to her when he just misspoke about where the polymeric sand was purchased. Almost every one of us at Mitchell pools, that has had contact with her, has heard the vulgarity come out of her mouth.By the end of the project in 2014, the ***s said they loved the poolAt the beginning of the project they mentioned the floor cleaning system was not working wellI informed them that the water valves for the system were bad and needed to be replacedShe asked if we could do it in the spring because they did not have the money. This is why the pool was dirty.
This spring when we opened the pool there were two warranty issues, calcium scaling on the plaster(whitish markings on a darker plaster finish) and the polymeric sand had softened and pulled away at a few spotsAs for the scaling, I had warned her that this could happen and though it could be remedied with acid, I urged her not to go so darkI also explained it is harder to keep from continually happeningThis acid remedy can be a long tedious processIt also darkens the plaster even moreTo try to please her I changed out the cleaning heads from gray to blackThe collars however cannot be changed as they are imbedded in the plaster. The manufacturer has this year changed its installation process because of these issues
I said that the problem with the polymeric sand "could be that my worker did it wrong, or, that there is a problem with the productWe have had other issues with this product and as it turns out with the other projects it was the product. My foreman was there to repair the warranty problem but she wanted him to tear out and redo the entire product. There was no need for this and told him not to do any of it until I spoke with herThat following Monday she called and told the office assistant that we were not to go on her property anymoreHe told her that was fine with us Later that day she called and I answeredShe said that she received the biweekly bills and asked if I was kidding. I asked her since she hired us to do work why she felt she shouldn't have to pay for services performed. She started to yell againI did yell back but certainly not the quote that she states She would not let us repair the polymeric sand (approx2-3hrs), I don't know what she means by 'filter sleeves, The correct caretaker heads are in, and the plaster as of 7/02/was just fine.
At this time, considering that twice they unfoundedly threatened to sue me, and I have evidence that she unfoundedly defamed my company I have fulfilled my obligations.
