This might be the worst company I've ever worked with in my entire life. Thousands of dollars have been paid yet thousands still owed? Stay far away from this company! Whatever financial situation you're in where you're in the need of cash THIS IS NOT THE COMPANY TO USE, you'll end up on much much worse of place then you were in before. This inquiry related to a loan from Mitig, LLC dba Mitig Capital (the “Company”), which is owned by the Lac du Flambeau Band of Lake Superior Chippewa Indians (“Tribe”). The Company takes these types of inquiries very seriously and would like to provide you with the below information. Nothing in this communication should be construed as a waiver of the Tribe’s or the Company’s sovereign immunity, all of which are expressly preserved. The Company is a wholly-owned and operated subsidiary of LDF Holdings, LLC (“LDF Holdings”). LDF Holdings is a wholly-owned and operated subsidiary of the L.D.F. Business Development Corporation, which is a wholly-owned and operated economic arm and instrumentality of the Tribe. The Tribe is a federally recognized Indian tribe, organized under a Constitution pursuant to the Indian Reorganization Act of 1934, 48 Stat. 984, 25 U.S.C. §§ 476, et seq., as amended, and is identified on the United States Department of Interior’s list of federally acknowledged Indian Tribes. 83 FR 34863-01 (July 23, 2018). The Company is an arm of the Tribe. As an arm of the Tribe, the Company possesses all of the privileges and immunities of the Tribe. The Tribe and the Company are entitled to tribal sovereign immunity and they are not subject to state law. Wells Fargo Bank, N.A. v. Lake of the Torches Econ. Dev. Corp., 677 F. Supp. 2d 1056, 1061 (W.D. Wis. 2010) (holding that entities acting as arms of a tribe are entitled to tribal sovereign immunity). The Company issues loans in accordance with the Tribe’s Tribal Consumer Financial Services Regulatory Code and it is licensed under Tribal law. The customer’s loan agreement provided that it would be governed by the laws of the Tribe, without regard to the laws of any state. The interest and fees applicable to the loan are permitted by Tribal law. They were accurately and clearly reflected in the loan agreement that the customer signed before receiving the loan. The customer also received a TILA disclosure that outlined the amount and date of each payment required under the loan agreement. Due to its immunity, the loan is not subject to state law and the Company is not required to be licensed with any state.

As a courtesy, even though not obligated to do so, the Company will close the subject loan and will consider it paid in full. The customer can call the Company at 1-844-388-0500 if there are further questions or concerns. The Company trusts that the complainant will find this letter of explanation satisfactory. This company is a total scam and ripoff. I took a paydayloan for $750 and these people were trying to charge me a 666.8% interest which was not in the original contract and didnt find out until I paid them well over $950 and they were taking $226.30 every week out my check until I just caught it. The legal percentage in my state where I live is 18% which is the highest depending on your credit.

I have paid MitigCapital $1968.20 for an $800 loan 10 paymentof $196.82. The company trieto hide behind their Tribal lawregarding *camming tho*e who need a quick re*olution and choo*e to u*e a payday loan. We are not *tupid people, we don't have *avingor family memberthat can ju*t loan uthe money. We tru*t the companieto be fair and equitable but they rip uoff and *cam uout of thou*andof dollarbecau*e no one iholding them accountable. I refu*e to pay them another penny and I'm choo*ing to reporting them becau*e even until now the la*t payoff they *aid they would accept iover $900+! I was ***.thae arrangement I had with them for repayment is not what we agreed upon.they prolong the process so that they can add up outrageous interest.they are not even accredited company with the bbq.

This company is a RIP off. I had a loan for 750 and my monthly bill was for 226. Fyi they don't take payments if you have both checking and savings account you can only have checking. So they could not process my payment. I called and tried to pay with my debit card and they don't take card payments wtf. So the mitig rep tells me I need to make another account with just checking for a 750 dollar loan really. On top of that they tell me I have 20 payments of 226 dollars for a 750 dollar loan. They said if I want to pay the whole loan off the amount is 1500 dollars. They know if your barrowing money your desperate and they know most people cant pay the whole loan off at once it's a freakn trap and a RIP off.

This company is scamming people I know their interest is right but even though I have been paid the are adding more money as balance I started as 600 also the mentioned advertising it will monthly payment but is not is biweekly this is scam they are explaining this correct I ask only for 600 already paid 1500 and still I owe 1000 I did not receive or request that amount please help I called them but they refuse to help

I had originally accepted the conditions for a loan of $1000.00. Beginning 6/15/18 my repayment amount would be $301.59 every two-weeks. On 1/11/19 I had taken an additional amount out that increased my two-week payments to $331.87. On 3/8/19 I had taken an additional amount out that changed my two-week payments to $303.50 (as I had made continual payments to get the original amount and loan fees down - the two-week payments decreased slightly). I had again borrowed money on 4/19/19 that increased my two-week payments to $408.16. Due to some family emergencies I was not able to maintain the payments and have not made payments due to an inability to follow through with the ridiculous amount of money I was expected to repay and in total, for less than $2000 borrowed over the course of approximately 10-months I repaid that amount 4.5 times what was borrowed. The total amount repaid by me was over $9000.00 during the aforementioned time frame. Plain and simple, this is extortion and claiming Tribal Law to circumvent U.S. Law and to justify their absurd practices is absolutely deplorable.

This business does not have a way to show how much of your loan is paid off. The website only has a balance of how much I still owe, and when my next pay day will be. I've made eleven payments of 203.58 on a loan of 675.00 and my balance has not gone down at all, in fact the balance keeps getting higher. I wanted to pay of the rest of my loan to get it done but I have to wait for my pay days and by the time those come they have again changed the balance to a higher rate up to past 1000.00 every due date. I know they are doing this so customers like me can not pay it back. How is a business allowed to change how much you owe to a higher rate? I've paid them what I owe and don't want any money back I just want to be done with them and their unfair practices for good.

This company is a scam. I was approved for a 925 dollar loan that I decided not to go further with because I was unaware of any terms or rates. When me and my wife tried to call and talk to someone they reported they can only give general answers about questions regarding how they work they reported only if you have an account. Months later I find out I was being billed there was no email or bill in the mail. To pay a 925 dollar loan off I would end up paying 5500 dollars to something I didnt authorize to go through. In my state it is illgeal to charge in a manner like this. It is beyond ethic. Me and my wife both call to get it resolved with no answers as the bill continues to climb hundreds of dollars a month.

I took a loan out from Miti capital . When I signed the papers online They never told me the loan was going to paid every paycheck for a year. . I did not see any kind of agreement like that. It has put me in such a big hole. Also when you make payments it will say you owe more money than you borrowed. I don’t know what is going on with this company. I believe this is unfair, predatory practices and I’m filing this complaint. They need to investigate.

For your reference, details of the offer I reviewedWhen I first opened up the account back in November of last year for 975.00 . I did not see or would not even think a company could charge you 248 every two weeks for a whole year. This is insane.. I would of never done it. When you pay some money down it does not even go down sometimes it goes higher. I think this company takes advantage of people very badly when they are in need to get bills paid. The payment plan should be something you see. I think it was hidden in the contract.

I contacted this agency in order to pay off my loan via a check that required to be initiated electronically (but would ultimately be mailed), therefore needed a loan number to proceed. The only identifying numbers they would give me is my personal identifying loan number, and wouldn't disclose a number that identifies MitigCapital directly so the check could be printed. How can I find their particular agency, etc. number that would come up as a legitimate company in order for my bank to generate a check for a pay-off?

For your reference, details of the offer I reviewed appear below.I disagree with the company's response indicating that I am upset with the fact they do not accept electronic bank transfers. I never wanted to pay my loan off using an electronic method; I told the representative that I wanted to send them a check in the mail. As a matter of fact, another rep. I spoke to, among a many trying to sort this out, said they take electronic pay offs all the time.The issue is that my bank will not issue a check to send to them until a valid account number is provided that brings up Miticapital within the banking system. For instance, I provided my bank with the account number for 2 other personal loan companies (both of which are just like Mitigcapital), Avant and Opploans. The account number they provided me came right up in the system and a paper check was generated and mailed to them. I am inclined to believe this is somewhat of a tactic so customers cannot use this option to pay their loan off easily and continue to pay the 663% interest rate.Another issue that has come about regarding this company is I received an email from their complaint dept. in response to my Revdex.com complaint and it said this : Dear Ms. Jacoby,

This was my reply:Sounds good, however, they may not be able to explain it either, considering the comment in question came from the complaint processing department not the customer service department. Maybe it can be sorted out. Thanks again!I have not received another response since. I feel I am getting the run around, when all I wanted to do was pay my loan off. I want other customers to be aware of what they may be getting into if they use this company for a personal loan, when there are plenty more out there who handle business in a legitimate manner. Took a $700 loan out from them back in January. I've been passing $226 twice a month since to repay said loan. Payments were supposed to be until November. They had not drawn payment for the last two. Tried looking up account in website. It said it didn't exist. Suddenly today they hit me with the charge and now I'm negative. I've paid the 700 back several times over. This company is a scam. They make several thousands on a very small loan.

I called because customer service because I needed a payoff and one of my payments was skipped meaning it wasn’t submitted to my bank. The customer service representatives stated that it was an error on behalf of their company and my bank. When she quoted me the payoff it she quoted me almost $300 more than the loan amount and told me my account was past due to the payment they made a error on as I don’t control their system. My responsibility is to ensure the payment is made. This is not fair and I want resolution and be done with this company. I feel I have paid my loan amount including interest that I borrowed. I want resolution and be done with this loan. I will not be scammed into paying for an error that was solely the company’s error.

This company opened up a fraudulent loan using for someone using my name and social security number. I did not apply for this loan or contact this company for any services. I would like to know how they can open an account for anyone that gives them anyone’s social. I had to freeze my credit reports and place a fraud alert on my credit reports. Apparently these types of companies do not care about a credit report if they did they would see I have no reason to apply for this type of loan. I can provide a police report and a identy theft report.

I contacted this company by email on Friday August 23rd to notify them I did not apply for this loan. The response I received is included with this email,. They said I needed to contact the bank money was deposited into and request a letter stating I was not the owner of the account. I have no idea what bank they are referring to and they said I had to provide information for a computer IP address. I would not have the computer IP address this person used to apply for a loan. This company would have access to this information. Their letter implies I applied for this loan and should give them money to close this account. Again I have no reason to apply for this type of loan. I have no clue who would be using my social security number. I will be happy to send any proof they need from me to prove this. They have not given me anything to validate this account was opened. I have also contacted Wisconsin consumer affairs and they indicated this is a reservation with their own laws. They sent documents for me have notarized so they can contact this company for information on my behalf. The company also wanted proof of how I found out about this account. Since July 5th I received numerous calls from companies asking to verify information for loans they said I requested. I know I do not have any relationship with any of these companies so I know why they are calling. I obtained copy's of my credit reports and on July 5th there were numerous credit inquires which indicated there was a problem since I haven't applied for any loans in years.This company called my house twice and using their number I did a google search to find out what company was calling and their name showed up with the phone number. Once I had the company the website was for quick loans. Since I have been dealing with this I realize the companies are not calling just to say Hi. Its interesting they can call when the accounts they opened require a payment but they cannot call to confirm a persons identity. The companies who called to verify this were the only ones who did not open any accounts for this person. The other companies I am dealing with are for quick cash loans that did not verify the information. I will send any documentation I can in order to clear this up. I will not pay for a loan I never applied for.

This company did contact me with information they closed the account and are still investigating for fraud. I have offered a police report and any other documentation they need to help with their investigation. I would like to know what information they do find out about the person or who this person is who opened the account. If they need anything I will be happy to provide any information.

I took out a loan 6 months ago with this company snd I've been paying $337 biweekly but my balance continues to rise. The APR also continues to rise and there's no end in sight. I logged into my account to pay off my balance but they ignored this and continued taking out the $337. It seems that they don't want customers to ever pay off the debt. I believe this company has unfair, predatory practices and I'm filing this complaint. They need to be investigate immediately.

Using their ‘sovereign government’ of Lac du Flambeau, Native-American special Tribal Law privileges, they prey on low-income people that need some quick cash for emergencies with insanely high interest rate of 661.54%. I borrowed $550 because I was struggling to pay my rent a month ago, now I’m struggling even harder because they charged me $165.88 right before my payday, while I barely had any money. It was bounced and I was charged a NSF fee of $34 from my bank. And then they went ahead and charged me again the next Monday, which took a chunk out of my rent money. I had to pay a $160 extra late fee because I needed another whole week to come up with the full rent.
I have no control over when I want to pay nor how much I want to pay on their website. They’re just going to charge me an obnoxiously high amount of $165.88 every other Monday regardless of my payday. And they’re going to do this 20 times which is going to total $3,311.26, when I only borrowed $550. This is extremely unreasonable and very sneaky as they make dishonest profit off of desperate people. I admit that I wasn’t thorough enough when reading &!signing the agreement about the outrageous interest rate, but I’m sure they know it’s pretty sneaky of them.

The customer also received the TILA Disclosure, listing the payment amounts and payment dates.

Although not obligated to do so, as a courtesy, the Company will settle this account for the remaining balance of $861.27 to be paid over 12 months. The customer can either (1) call the Company at 1-*** to set up a payment plan or (2) mail a cashier’s check or money order for the sum of $861.27 to the Company’s address below:

I was attempting to secure a loan back in April to help out while my husband was off work. When I applied online I was directed to Mitig Capital. After entering the amount that I was looking for I received an email confirmation that I was approved and the funds were delivered. I have gotten payday loans in the past and thought nothing of it. When filling out the paperwork I do not remember seeing the total owed only what the payments would be. After receiving the funds I logged into the website and reviewed the documents. I am paying 655% interest. I am now struggling worse than before because they are taking over $500 per month from me. I feel scammed and upset. I know that I agreed to the terms, but felt the business was not transparent until after the money had been accepted and deposited.

The interest and fees applicable to the loan are permitted by Tribal law.

They were accurately and clearly reflected in the loan agreement that the customer signed before receiving the loan. The customer also received a TILA disclosure that outlined the amount and date of each payment required under the loan agreement.
