Answer to Complaint

Dear Sir/Madam

[redacted] who was in a Bankruptcy process and was in default for filing her 2012 taxes, was asked by the district court trustee to prepare and file her unfiled 2013 tax return in addition to her past due 2012 return.

[redacted] came to our office on or about April/2014 to have her taxes done for the above mentioned two years.

[redacted] was advised that only her current 2013 tax return can be filed electronically, but her past due

2012 tax return can only be mailed to the [redacted] appropriate address.

According to the notes included in her file, [redacted] signed an authorization form for our firm to prepare her 2013 return electronically and was given completed signed copies of her 2012 tax return along with a prepared and addressed  envelope to mail out to the [redacted]. This  way is consistent with the office due course of business, as all customers who cannot file their returns electronically, receive a copy and envelope to mail out to the [redacted].

A few months later, [redacted] called our office, spoke to the office manager and complained that her 2012 tax return was never received by the [redacted].

The office manager promised her to investigate the matter

The next day, [redacted] received a call from the office manager advising her that according to the notes in her file, the 2012 tax return with an addressed  envelope to the [redacted] was given to her to mail out I

[redacted] denied that she was ever given any such envelope!The  office manager advised her that he will conduct further  investigation on this matter

The next day, the office manager called the [redacted] regarding [redacted]'s 2012 tax return, surprisingly, the [redacted] confirmed the they have a 2012 tax return for [redacted] in their record and that a refund check will be issued soon to her.

 

On the next day, the offite manager called [redacted] and told her since the [redacted] confirmed receiving her

2012 tax return, disputing who was responsible for sending the return to them becomes irrelevant.

[redacted] insisted to have a full refund for the $200 she paid to prepare  her 2013 tax return and for her

2012 tax return!

The office manager explained to her that:

1. She only paid a $150 In a personal chetk for both years not $200 as she claimed

2.   There was no problem with her 2013 tax return, as it was filed electronically, on a timely manner, approved  by the [redacted]  and a refund check was issued

3.   She was already one year late for filing the 2012 tax return when she came to our office, The [redacted]

confirmed receiving and approving her 2012 tax return, no penalties or fines were charged because she did owe a balance to the [redacted], and therefore, no cause of action arises to any dispute II

4.    [redacted] advised the office manager that should the office not return  her $150 she paid, she will

continue her call harassments, put online negative comments  on the business and file a complaint with the RevDex.com

5.   The manager responded  that [redacted] ot ghtto  pay for the services she received, the tax returns prepared at our office and contained our firm information were filed and approved  by the [redacted], moreover,  her refund checks for the above tax years were Issued to her, and lastly no fines and penalties were charged against her by the [redacted] for the late filing of 2012 tax return, although, she was already one year late before coming to our office.   No cause of action arises in this situation and we consider [redacted] continuing complaints an attempt to avoid her legal and ethical liability for paying for the services rendered  to her by our firm.

I have been through a fiasco with this business. This began 16 days ago when I contacted my tax representative, Islam, and requested that he do my taxes. He informed me that he had left the company and moved to Ohio. Because he left the company, he signed a document promising to not take any clients with him. In spite of this agreement, he agreed to do my taxes. This should have been a red flag that I was not dealing with ethical people. Over the next three days, I contacted Islam 3 times via email to no avail; he did not respond. After sending a rather direct email demanding information, he then called me to inform me that the file had been transferred to the manager of the tax office with which he was previously employed. Islam stated that he was doing my taxes that night, which happened to be a Saturday. Again, another red flag: why was I not notified of this transfer? I then emailed with the manager of this establishment, Mohammed, who had taken over my taxes. My attempts to reach him spanned 4 days; he did not reply to a single email. I finally obtained his phone number and text him to inquire on the status of my taxes. He replied the next day by text claiming that he had my incorrect phone number in their database and thus could not reach me. Red flag 3: what about my emails I had sent? I confirmed they were sent to the correct address and also confirmed receipt but simply did not respond. Even if he had my wrong phone number, how can he explain having disregarded all of my emails? Mohammed informed me that my taxes had been completed and were ready to be signed/submitted. The taxes were not completed and ready to sign. Mytaxes were incomplete and only included information from 2 of the 6 documents I submitted. As such, I had to come into the office and start from scratch with my tax information. That day, Mohmammed and I had communicated via phone and established that I would be by in the afternoon to see him. I arrived at 1 pm on 2/3/16. He was not there. I waited for a full hour before he arrived. Instead of tending to me immediately, he visited with each tax accountant in the office, all four of them, for up to 15 minutes each. Apparently they needed his guidance in that moment. After waiting for nearly an hour (2 hours in the office by now), he finally called me back into his office to finish my taxes. Immediately after sitting down, he left the office and proceeded to assist other customers once again. I sat waiting for another half hour before leaving the office to retrieve him. I was on my lunch break and could not afford to wait any longer. At this point, I had been in his office for nearly 3 hours. I went to the desk where he was advising another employee and firmly asked that he return to the office and finish my taxes so that I could return to work. He finally returned, finished my taxes in less than 15 minutes, and sent me on my way. Over the past 9 days since I left, I have contacted him numerous times to express my concern as my taxes are not showing as accepted on the website. I would understand if they were accepted but not completed; this would be normal. My friends and family who filed last week, however, have not only been able to track their return, but have received their refunds, too, at this point. I have contacted him by text and email requesting that he confirm my taxes were submitted correctly. I also asked that he verify the dollar amount I have is correct as an error would explain why I am unable to track the refund. He has replied to one text offering nothing more than "the IRS website was down and may be delayed." That rationale is invalid as other who filed after have received their. I do acknowledge that every refund is different. There is, however, no reason I should not be able to track my refund on the IRS website at this point. I have asked Mohammed two simple bits of information: to confirm the dollar amount. In three days, he has not replied to my emails or texts. I have zero faith in this business's ability to execute my return at this point.

This business is run so poorly that I feel I have a moral obligation to warn others. This has been one of the worst experiences I've had with a business in my lifetime. With a matter as important as your refund, you should put your trust in a business better equipped to assist.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.The response given outlines blatant deliberate lies and attempts to disparage me the customer as the wrong doer.  Obviously this company has no intension to be accountable in any way.  

I am gravely concerned about the business standards and wish to warn other potential customers.
