I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
His responses are disingenuous at best, clearly demonstrated by the picture Attached is a picture of our "landscaped" back lawn when we took possession of the propertyAs you can see, the bushes were never trimmed, significant weeds are growing by the bushes, significant weeds are growing from the bricks, and when our landscaper could cut the grass some of the tall weeds had to be removed so they would not bind up the lawnmower. From the first time we viewed the house the builder told us it was equipped with humidifiers It wasn't until 4 months (when we turned the heat on) after we purchased the house did we learn it was not equipped with humidifiers As part of our final agreed upon punch list, we asked to be shown how humidifier operates The builder’s assertion that it was as-is, is correct, but he agreed to the punch list at the signing of the contract. As the builder did not show up to the walk through, we asked as part of the punch list that he show is that both the humidifier and fireplace work, among other things It turned out it was in fact a propane fireplace, hooked up to a natural gas line, and wasn't operating properly The builder’s assertion of a universal fireplace is incorrect, because propane and natural gas operate on different pressures they are not in fact interchangeable nor are they universal. The builders comment that we were tedious is also disingenuous The builder, despite having an abundance of time, waited on finishing numerous aspects of the house. His supervision of various subcontractors was lacking, given we have several switches in the house that do not turn on and off any lights, his plumber left the cap off to the sewer line and failed to vent the master bathroom (which the builder came back and remediated and which the town inspector missed) and painted items In addition, the pavers around the driveway are falling off due to the lack of cement in less than a year The builder had the opportunity to perform the final walk-through with us prior to the sale, but he chose not to attend and gave me access to the premises I developed a comprehensive punch list, which he accepted Amounts were kept in escrow in order to ensure that these items were completed, and we also paid out of pocket for items he was obligated to fix. He now refuses to live up to his obligations (i.ethe punch list).

The buyers on this property are highly mistaken, This was not a new construction house it was a renovated house that they had purchased AS -IS In reference to the driveway they were not happy with the way
it came out and drove on the driveway on a record hot summer day with driveway being newly done created a little tire markI reached out to the company I hired to do the driveway and they said he would fix for them as a courtesy not as a necessityThe driveway company was unable to get fixed before the weather changed and winter months came aboutSince then he had shut down his company and went out of businessall of the contact info I have for this company is no longer in service Thus being the case that he can no longer perform the courtesy of fixing the tire markIn reference to the humidifier for the central air conditioning system , I had told the buyer that I believe the system came with a humidifier along with the contract I had from the hvac company and I would check to make sure After I doubled check the agreement with hvac company the humidifier is not a standard item that comes with ac it is a add on so it did not come with the system I told the buyer I checked contract because I wasn't sure and now they demand me to put one in This house was sold as per contract and nothing in the contract states that I have to add a humidifier and or fix driveway since it is something their negligence caused All of the other demands on their punch list that I was not legally required to do I did as a courtesy I went back to house several times to do soThe buyer was very tedious about things and even went to the extreme to put post it sticky on areas of wall that they wanted paint to be touched up that didn't needed to be done but again as a courtesy I did so The fireplace was installed correctly and inspected buy the town of Oster bay building department , so what they claim to be done as incorrectly is a statement whomever they hired to look at the fireplace clearly wanted to charge something and claim they need to convert to gas from propanethe fireplace is a universal system that was in working order at time of inspection and final walk trough The lawn was seeded and landscaped prior to them closing on the purchase of the house They had done several inspections of the house prior to purchasing it as well as had a engineer and appraisal done which gave ample time for them to amend the contract for things they requested to be done The buyer also owes me a balance of $for upgrades of things they wanted done to the house that I was never paid forThey refuse to pay this amount for things they want done that I am not obligated to do as per contract I did everything I was contractually obligated to do and then went above and beyond for them , even doing such things as snow removal for them at their residence in the winter months as a courtesy I am willing to let them keep the $dollars they owe me for upgrades for their inconvenience I feel this is fair compensation for their frustration Again to sum up this complaint these things they request to be done is not part of the contractual agreement and I am not obligated to do such it states in the contract this is an purchase , I feel I went above and beyond for these buyers and offered fair compensation

Review: My wife and I purchased a house in early July of 2013 from MJP Realty Group, Inc., [redacted]. Upon closing there was a detailed punchlist of items that needed to be remediated from the final walkthrough. At the closing table, [redacted] promised they would be complete within 60 days. The day after taking possession of the property, and parking my car on the driveway, we found significant compressions in the macadam. We subsequently consulted 2 driveway professionals who informed us that the driveway was not pitched correctly, rolled correctly, and already showed signs it would not last. After informing [redacted], (subsequent to us purchasing the house) he told us he would have his driveway installer redo the driveway. This was because we were the first house he had sold of the several remodeled houses he had in his inventory, and he acknowledged that we lived next door to another house he was trying to sell and needed to keep us happy. By September/October 2013, [redacted] told us the driveway guy was running out of time and would do it in the Spring. Soon thereafter, [redacted]s empty promises to complete the work stopped and he altogether stopped responding to our correspondences; we engaged an attorney to send a demand letter dated May **. Subsequent to the demand letter, [redacted] told us he could not find the person who had worked on the driveway and had done a poor job at another one of his remodeled houses. I told him to give me the information and I would try to speak with the driveway installer as well. He told me he did not have his information anymore and his sister, who works for his attorney, would provide it to me. [redacted] nor his sister acted in good faith and never provided me the information (as demonstrated in our text message conversations.) Subsequent to the demand letter, several items were repaired on our property from our punch list, including repairing the front door, fence (which was gross negligently done by not putting any screws in it) and repairing the front door; however, he did not fix the driveway nor did he install humidifiers on the heating system that was included in our original punch list (as well as numerous other items which we paid out of pocket for). In addition to the driveway and humidifier, [redacted] installed our fireplace incorrectly, and we required a separate company to install the correct burner (changing it from propane to natural gas) and put insulation so the metal was not touching the wood on the house, which was a fire hazard. We also had to pay out of pocket to have the lawn significantly repaired, seeded and cleaned up, which was also per the final punch list (attached). We are seeking monies (based upon 2 estimates) to redo the driveway and install humidifiers. His errors in reading his contract with his HVAC person and poor oversight on the driveway, which he acknowledged he would redo should not be a valid defense against completing his contractual responsibilities. We have had numerous discussions, with him; however, he is not living up to promises he made.Desired Settlement: Redund of Escrow, and purchase price related to defective items.
