I installed a pool for [redacted] [redacted] The initial install date was set early spring ; however was delayed due to weather constrains and the ground not being able to support heavy machineryIn speaking with [redacted] agreed to along with a tentative reinstall date, based on weatherAt the time of the install; I was unable to attend due to other installs being delayed as well due to weather, in which my associates that have more than years experience completed itMs[redacted] -- notified me there was a hole in the lining and she was unsatisfied with the latter she had purchased separately and I only placed into the poolI returned to the property in a timely fashion to replace the liner (free of charge) and informed Ms [redacted] could return the latterThe space cut into the decking; I informed Ms[redacted] That the existing deck would need to be modified to fit the pool to receive the desired outcome and also informed her my company was not skilled carpenters/ finishersMs [redacted] told me to make the cuts to make it fit.Ms[redacted] .is requesting a full refund for a service that was agreed upon and a product that was delivered and is being utilized.After receiving this complaint last season; I have made several attempts to contact her to ensure the pool and integrity of the structure that my company installed, since I warranty the work for a seasonHowever, once Ms[redacted] was made aware I was unable to provide a full refund for a pool that she maintains ownership of and was being used she refused to communicate with me or return my calls

For your reference, details of the offer I reviewed appear below.Hi, this is my rebuttal to Michael H*** DBA Under the Sun Aquatics Revdex.com case #***:I never signed a contract for the above ground installAll the communication between Michael and me was via email or phoneHe never mentioned MLH ContractingAlso, Michael never came to Ohio to do a site survey or he would have realized that it entailed more work than he might have anticipatedI would not have hired Michael had I known all this extra stuff had to be doneHe was just going off a couple of photos I sent himWhen his worker finally did come to Ohio he said that dirt would have to be moved around the installation siteNothing was ever discussed about cutting the deck to fit the pool or them not being "skilled carpenters/finishers"I had to pay to rent a bobcat so the installer could move dirtIn the process of doing that part of my yard and landscaping was messed upThe installer did not put down enough sand to prevent rocks from coming through and puncturing the first linerThe liner was replaced but this one has a lot of wrinkles in itAlso, Michael ordered an A-frame ladder which would not fit my deck pool and he knew I needed a deck pool ladderI purchased this on my own and sent the A-frame ladder back to MichaelI was never reimbursed for that eitherThe railing that was put up around the pool (city code requirement) started falling down soon after installationI have since removed that railing and will have to pay someone to put up a more sturdy railingThe installer also left most the trash behind, such as boxes, packing and other things which I had to clean up.I am asking for a 50% refund for all of the work I had to do on my own such as having the old sand filter hauled away, fixing the lawn, renting a bobcat, and having to pay someone to hook up the pool filter(Michael told me himself that his installer should have done that.)Lastly, Michael was going to send me dollars to offset the money I had to pay for the plumbing hookupI sent him a copy of the invoice as he requested but he stopped communicating with meThat is why I don't want to talk to himHe's a liar! If he wants to settle this he can send me a check for no less than dollars(I spent more than dollars to fix things that should have been done initially.)Regards,*** ** ***
