Review: I had several un-filed tax returns. On July, **, I retained the tax services of [redacted] (he introduced himself as such) [redacted]Prepaid Electronic Tax Service . At our first meeting he stated to me and my wife, [redacted], that he was a CPA and a tax preparer. We discussed the case and I left him with the 2008 taxes. On July **, I returned to obtain my completed a 2008 tax return. We reviewed the Tax return and I brought to his attention that he had neglected to sign the return as a paid tax preparer. He Stated to me he was not obligated to sign the returns. Not knowing the regulations, I took the return, gave him additional returns to complete and left. Not satisfied with his statement that he was not obligated to sign the returns, I researched the IRS FAQs about new requirements for Tax returner Preparers, 3/*/2011, which stated that under authority of section 1.6109, "A CPA is required to obtain a PTIN if the CPA prepares, or assists in preparing, all or substantially all of a return or claim for refund". On August **, I return to [redacted], to review the returns. Finding errors, he requested that I return on August **, to pick the revised returns. On August **, I returned, reviewed the tax returns and once again there was an error. As we sat together, he explained to me that the tax computer program stated that there was no additional funds in the amortization of a $25,000 capital improvement made the previous year. I told him that could not be possible and we needed to review the amortization schedule. We immediately reviewed the return and he found that he did not input into the program the original amount of the capital improvement. To which he stated, "I don't know how I missed that". and than apologized for his error. After the revised copies were presented to me he explained where I and my spouse were required to sign. I asked him to please sign the returns. In an agitated tone, raising his voice, he stated, "I told you already that I don't sign the return." I stated to him, I don't understand why you are not required to sign the return. [redacted] stated, "It is our policy not to sign the returns." I then stated that I am paying you and therefore under IRS regulations you are required to sign the return and provide your PTIN." He stated, "If you want the PTIN you will have to come back tomorrow." I replied "This is strange for a person who does tax returns not to know his PTIN" He then stated, "I didn't do the tax return". To which I stated, "that is not what you have told me and if someone else did the returns, what is that persons name." [redacted] could not give me a name. But rather grabbed the tax returns from my hand and stated, "Take your business else where, I'll refund you your money". I told him to return all of my W-2's and any other document that I had provided. He took out a calculator an stated, "Your refund is $1015" To which I responded that the amount which I had paid was $1215. He responded by reading from a receipt, " A processing fee of $50 will be charged for all cancellations and since you cancelled 4 returns that is $200." I then stated that I was not cancelling the the tax returns but rather that he would not sign the tax returns and that he told me to take my business else where. I then asked again if he was a CPA and a registered tax prepare and if he was to provide me with his credentials. At this point he stated "This conversation is over." He refunded $1015 and refused to refund the additional $200 sighting the cancellation fee.Desired Settlement: I would like the $200 refunded. In addition any personal information which he contains in his files are to be returned to me and, with reasonable assurances, all information is purged from his computer files.
