Below is our response to complaint ID ***.We did perform services for the clientThey are claiming that we will not honor a warranty which is correct Per our terms and conditions, which they signed upon agreement of the contract, it states "Plant guarantees are void if
payments for services are not paid in full." The client withheld the final payment for the disputed amount, therefore voiding their warranty.If upon receipt of our response, the client challenges that either they paid in full or had no knowledge that their warranty would be voided, I will be happy to supply all documentation This would include a copy of our terms and conditions that they signed, acknowledging that all warranties are void if services are not paid for in full.Please let me know what else you need to me to provide in order to resolve this complaint.Thank you,Patrick K***M&M Professional Landscaping

I received the signed agreement from *** *** along with his statement. The owner of the company, Trent M***, managed the project at their residence. During this time, *** *** and Trent came to a verbal agreement that additional work was to be performed at an agreed upon price. *** *** was not present at this time. The additional work included plants that were not on the original contract. Substitutions of plant material are often made in the field and this is how we do business. When the project was complete and Trent attempted to collect for the change order that was verbally agreed upon, *** *** refused to pay. It is our opinion that *** *** had knowledge of this change order, but since we had only a verbal agreement with *** ***, *** *** saw an opportunity to take advantage of us. Attached is a change order of work that we performed that was never paid for. Our position remains the same, that we will not honor any warranties because the services for which we performed were not paid in full. You should have in your possession a copy of our Terms and Conditions signed by *** *** where it states this. In addition to refusing to pay for work that we performed, *** *** is attempting to use the Revdex.com and our reputation against us as a way to get even more free work. I am rejecting this response because: I reviewed this response with my wife.  At no time was there a conversation between her and Mr. M[redacted] that included a discussion of additional costs or an agreement on price for additional work.  The contractor's response makes it clear that M&M was not operating in accordance with their contract.  If there was work considered outside the specifications of the contract that involved extra cost, a written change order should have been obtained prior to performing the work. It is also clear that M&M has no intention of honoring the warranty terms of the contract. Review: On June 3, 2014 this lawn company while providing service threw a rock up at one of the front windows of our home causing a chip/crack and splitting of the glass. We are in our second year of service with them. The damage was not there the day before and was noticed that afternoon after arriving home. I attempted immediate contact that evening but did not connect. during the next few days, I also attempted leaving another phone message, tried the contact us through the website, and sent an email to a previous contact. The following week I was able to speak with a human and she took my information. I was told they would get back to me. Many weeks went by and nothing, no phone call, no adjustor for pictures, no nothing. I tried to contact again. I was now told that the insurance company had handled it 3 weeks ago and I received a check. I had seen nor talked with anyone. At that point I continued to call, was now only able to leave messages and no one returned any contact. I tried an email again to our previous contact that had been "out" and he said he would look into the matter. I made more progress and found they had me listed as a different client that had a similar claim. Now we are at 2+ months and was told the insurance company "[redacted]" would be in touch. Kris from Georgia office briefly contacted me about what had happened and events to date on August 21st, but I was on my way out of town on business. He said someone would be out for pics and the local guy Mr D[redacted] would be in touch. As of Sept 16, he was not and never called me at all. I emailed the landscape office people and included him that I had done several estimates for repairs and made a choice to get it fixed as to me no one was bothering to do anything for repairs of damages. I just received a letter, that is horribly typed with many errors and inconsistencies by Mr D[redacted] and insurance co. It states that I am at fault and there are no witnesses that they caused the damage. They closed my claim without pay.Desired Settlement: The company should do the right thing and pay for the repairs which cost $685.00. They are at fault and have insurance to cover damage caused. They paid out another claim for someone else with similar damage. I should not have had to spend such time, effort, and stress to try and fix a problem they caused and then in the end refused to fix. Also, their record should have F status listed as a business. This could happen to anyone who does business with them.
