They have Made NO EFFORT to repair what they damaged in the tow to Sacramento nor put the RV in the condition the receipt stated it would beThey are acting extremely fraudulent and if I cannot get a full refund, I will proceed with small claims court

[A default letter is provided here which indicates your acceptance of Arbitration. If you wish, you may update it before sending it.]Revdex.com:I have reviewed the response made by the business in reference to complaint ID .1[redacted]  and find that arbitration is necessary. Sincerely,[redacted]

I am rejecting this response because: First – there was no way for me to know that the RV was leaking until it either had water put into it or until it rained.  Neither of those situations took place while I was on the lot so there was NO WAY for me to cancel the transaction based upon those concerns.  Second – The RV broke down the first time I tried to drive it (the mechanic Jorge was in the RV with me when this happened).  It was supposed to be worked on and repaired.  When I drove it off the lot again, I made it only a few hundred feet before it broke down again.  This is NOT IN RUNNING CONDITION.  Third – M&M Towing has NOT GONE ABOVE AND BEYOND to repair ANY OF THE PROBLEMS with the RV.  I called them multiple times in order to arrange the repairs.  Each time I called, their concern was why I didn’t go to dinner with the mechanic, not on repairing the RV.  They have MADE NO CALLS TO ME in order to set up any sort of arrangement.  Fourth – I am not seeking money I am not entitled to.  I have a receipt stating that the RV would be sold “in running condition with no leaks” and these two contractual requirements have yet to be met.  I simply want a refund for the RV and all costs incurred.  This is not money I am not entitled to.Fifth – Just as I indicated in the last response to the Revdex.com, since M&M seems to have ZERO INTEREST in resolving this manner professional or timely I will continue with Small Claims Court.

Review: I responded to an ad on Craigslist for a used RV. When I arrived to look at the RV, it was at the yard of M&M Towing in Stockton. After looking over the RV, discussing the work that was in progress (& would be included in the price), I agreed to purchase the RV for $1300. I indicated that I would be back in 3 days to pick it up, left a deposit of $60 and was issued a hand written receipt, which listed the all the necessary information (VIN, license, etc.) as well as a line that stated the RV would be sold in running condition with no leaks. I arrived at noon on the day indicated and the yard was closed. It turns out the people I had been communicating with regarding the purchase of the RV were not the owners of the towing company but rather friends he lets use the space and they cut him a deal on any work he needs done. When I went around back and looked for the RV, it was not ready as promised. I was told that it would still be another few days. The owner finally arrived and I demanded to have the situation corrected ASAP! I cannot wait another few days to have the situation corrected. Mo said he was very upset and that he would have Jorge bust his as to get it completed ASAP, hopefully that evening by 6:00 pm. I spent 8+ hours a day for 3 days sitting in the yard, buying additional parts, gasoline, even water for the dogs running around but it wasnt until the following Sunday that I was able to pick it up. It broke down just a few feet out of the yard. The company offered to tow it for me to Sacramento for $250. During the tow the LOST THE DRIVE SHAFT! Its been almost a month, they have yet to replace it, the RV does in fact leak and is not in running condition. I have contacted them several times with no success. They seem more interested in getting me to go on a date with the Meth Mouth Mechanic. Its almost as if they wont repair it until I sleep with that nasty man. I mailed a letter requesting a refund and for them to pick it up. I have not heard a response.Desired Settlement: I want the RV picked up and I want a full refund, including all additional parts and gasoline purchased as well as the towing. The total requested is $1688.

In response to complaint ID [redacted] M&M Towing had a Dodge 1975 on lien sale when it cleared for sale, We placed it on cregslist for $1,800.00 :"As IS". A Young lady responded to the add, She like the RV and place $60.00 deposit on the RV at that time she informed us that she was being evicted from her place of residence and that she had a terminal illness so we worked with her and dropped the price to 1,300.00. she stated she would be living in the RV so I felt obligated to do our best to get it running even though it stated "AS IS" we went out of our way to find someone that could help make the repairs. He placed a new exhaust manifold gasket and rewired the brake light turn signals and the head lights, Yes we do know it took longer that expected but she was never charged for the labor. I run a towing service, when we sale a car we sale it "AS Is" M&M Towing paid the labor out of pocket, meanwhile we provided her with transportation for her personal use on the day of eviction in Pleasenton, Ca just to accommodate her need for two days and without charging her anything for the use of the vehicle in return for the favor she called us and informed us that she got a flat tire and just parked it and needed us to come get the vehicle if we wanted it back in Stockton. when we picked the vehicle up it was actually a blown out tire, which was never charged to her M&M Towing covered the cost. at the time the RV was finished she was informed that it would need the carburetor rebuilt she was fine with that and stated "I will have my mechanic fix it" and took possession of the RV. 1hr later as I was leaving the shop, I seen her broken down on the side of the road. I asked her if she needed help, she then asked for a tow to Sacramento. I gave her a quote for $250.00 she accepted the price while on the tow the drive line was lost.We said we would replace it and would like to resolve this matter as soon as possible. We have done our best to accommodate her every need. At the time of purchase she had plenty of time to stop the transaction and receive a full refund. Thank You for the opportunity to respond to this complaint. Sincerely M&M Towing Management

The owner is incorrect in his statement that they dropped the price because of my "terminal" illness (my illness is not terminal and I never indicated such. Plus the owner was not there when the price was agreed upon. The agreement was made with the mechanic. I did not have ample opportunity to stop the transaction because I was unaware of the leaks until after the transaction took place, also because it broke down as I was driving away. They are also incorrect in their statements regarding not charging for the extra work and labor because I did offer to pay additional money SEVERAL times and was told "no" by **.
