Review: Irented an apartment using the agent Nathan H[redacted] of MNS Realty. I paid a 15% broker's fee of $3,780.00. I signed the lease and paid the security deposit ($2,100.00), first month ($2,100.00), and

broker's fee ($3,780.00) after Mr. H[redacted] had made certain and specific promises about the condition of the apartment and attached outdoor area. He had promised that the apartment would be thorougly cleaned -

the apartment was extremely dirty and not in liveable condition upon viewing - and the backyard would be

cleared of the overgrown weeds that had overtaken the yard and the garbage strewn about it and a missing light fixture in the bathroom would be replaced. Upon move in (August [redacted], 2015), the apartment was in

exactly the same state as it had been previously - filthy. I contacted Mr. H[redacted] about this and he essentially did nothing. I was told the apartment could be cleaned after I had finished moving in - something

that would not have helped at all as to move in the apartment needed to first be cleaned. I scheduled a cleaning service to clean the apartment and forwarded the receipt to Mr. H[redacted] who did nothing but

forward it to the landlord. The backyard was also still in the same exact condition it had been in. The agent

did nothing to uphold his verbal promises - the promises that my signing the lease and paying the agency's

fee hinged upon.

To make matters worse, Mr. H[redacted] made me feel extremely unformfortable. He asked me to go out for a "

celebratory bite or drink," which I took to be an awkward offer. This then spiraled to Mr. H[redacted] texting me

asking me what I was doing and then culminating with him inviting me over to his apartment or inviting

himself over to my former apartment to sign my lease and give him the $7,980.00 in cashier's checks -

something that made me feel extremely uncomfortable on a personal and professional level. I do not feel

it's appropriate to ask a client to your house to complete a lease signing and exchange so much money and

based on his prior advances, I felt extremely uncomfortable.

I did not want to be in the position of deflecting unwanted attention from him, and thereby decided to not ask for a final apartment walk through to save myself the grief of being made more uncomfortable. MNS Realty is an allegedly reputable firm, and I trusted them to do their job - which was ensure that their promises were fulfilled.

On top of this, the day before the lease started I reached out to Mr. H[redacted] to get a copy of the keys to the new apartment. After scheduling this, he sent me text messages asking me if I smoked marijuana and offering me marijuana, which is a misdemeanor in New York State.

In light of Mr. H[redacted]’s failure to come through with his promises, inappropriate advances towards me, and illegal offer of drugs to me, I reached out to his managing broker, Wilson P[redacted], to ask for a refund of my broker’s fee. Mr. P[redacted] was nothing but dismissive and rude. From my interactions with Mr. P[redacted] all he did to rectify the situation was to mistakenly admit to me that Mr. H[redacted] had seen the apartment before the move in date and it’s unlivable condition and do nothing and then tell me that Mr. H[redacted] allegedly received a suspension and write up. He consistently ignored my requests to be recompensed for my terrible experience with his agent and only made excuses as to why none of the promises Mr. H[redacted] made were carried through. If I were to be shopping in a store and the sales associate hit on me, offered me drugs, and then sold me a faulty item, I would be refunded. If I was eating at a restaurant and a server hit on me, offered me drugs, and bungled my order, I would not have been charged. I do not understand how this company can admit to their failure to provide the promised service and the inappropriate behavior of their agent and still not refund me.Desired Settlement: I would like to be refunded the $3,780.00 fee that I paid to MNS Realty due to their failure to deliver services and the agent's inappropriate and illegal behavior towards me.
