The company sold me a product that he knew was damaged and refused to refund after it broke
I purchased a lawn mower from the company it broke in less than a week. I took it back to the company for either a refund or for them to repair it. The company repaired it and in less than a week it broke again. I took it to another repair shop so that they can look at it and was informed that the repairs that were being done was a temporary fix and that the machine will never work properly. The repair company that I took it to automatically knew where I purchased the lawn mower and stated that he has multiple machines in his shop with customers complaining about the same issue. *** is knowingly selling their customers broken lawn mowers that he knows will never work. Its fraud and I would like a full refund and for this crook to stop ripping off hard working residents.

Desired Outcome

I would like *** to issue a full refund and for his business to be looked into so that no one else goes through what I have.

The lawnmower was purchased in Oct 2019 "as is" with the understanding that if there was any issues with the engine gave 30day warranty.
About week or two after Mr. called said that it wouldnt crank so I went to the customers house with my technician and found that someone had left the key switch on which drained the battery due to the headlights being on so I installed a new battery no charge , turned right over ran good tested it and cut yard customer was happy .
*then recieved call again couple weeks later that it wasnt cranking so made another house call and found that the key had broke off in keyswitch. removed key and gave customer a new key at no charge , tested and everything good customer satisfied.
customer called said not cranking and this time was unsuccessful to do repairs at his house so I took mower home and found motor to be locked up so immediately called customer and told him that it was going to have to get new engine so I pulled old engine and replaced with good engine tested and ran good delivered to customer cut yard and customer was satisfied with it. no charge for pick-up/delivery and no charge for engine.
Customer called in january having issue with it and I explained that there would be a charge but would be happy to pick it up and service it and then he said that I was taking advantage of him and would see me in court.
I did everything that I told him that I would do with the "as is" sell of the mower and feel that I went far beyond but I want my customers satisfied with the work that I perform and each complaint that he had was due to customer neglect except for the engine locking up and I replaced the engine .

To whom this does concern which is Revdex.com, first and foremost I would like to thank Revdex.com for looking into my case, and assuring myself and others that have been fooled, and taken advantage of by Moats small engine Repairs.
On Wednesday, 10/9/19 I visited Mr. Moat's establishment on East Hwy 22 P.C. Fl. at 1100am, and I asked *** the owner of moats small engine repairs if he had any used Riding mower for sale , and right away he replied no, and I replied thank you sir . As I proceeded to leave Mr. called me back, and called over one of his workers and asked his worker if they had any mowers in the back of the shop that could be fixed that they could sell, and the worker said yeah that Troy pony that we traded that lady for a swap for their zero turn. Mr. asked his employee to bring it up front for me to see it, and the employee did. Then Mr. told me that he would charge me $5oo.oo for the troy built pony, yet he would need $100.00 down yet I didn't have $100.00, I only had $80.00 which he accepted. He wanted the money before he could sell it mainly for parts that he would need to get it ready for sale by Friday 10/11/19. He also said that he would deliver it for free after it's repaired. Well before I left I explained to Mr. that I didn't want a machine that I would have to keep fixing because I don't walk that well, and I don't have a way of bringing it back and forth to have it fixed, and Mr. replied O.K. On Friday 10/11/19 Mr. said as I stated earlier I will deliver it to your house. On Monday 10/14/19 I went to the bank and withdrew $500.00 to pay Mr. the balance of the $420.00 completing the purchase price for the mower. At that time Mr. explained to me that the machine that they showed me on Wednesday 10/9/19 he would not be able to fix for the price he quoted, and instead he had a better one, yet it would cost another hundred dollars bringing the price to $600.00. I said ok but let me see this other machine so another employee brought it out and it looked like the same machine except for the lights in the front were different so I excepted the one I just viewed and agreed on the $600.00. I didn't give Mr. the $520.00, and I said I'll Pay you in full once you deliver the machine, and Mr. said that's good I'll see you on Friday 10/18/19, yet he never showed up or even called me. I waited almost to end of the business day about 4:45 pm on 10/18/19 and called him. His wife answered the phone so I asked for Mr. and she said that he wasn't in and that's when I asked what happened to Mr. delivering my lawn mower and she said she remember who I was, and that they needed a few days more by Wednesday10/23/19 because someone had given them kitchen cabinet set for when they got their new house that were on their delivery trailer, and they had nowhere else to put them. Well once again being a good person I said alright fine I'll wait another week.
The lawnmower was finally delivered on Thursday 10/24/19. The day of delivery Mr. told me that the battery in the machine was dead, and that he bought a new one with him, yet he was charging $42.00 for it. Well the next words that came out of mouth was that I wanted my money back so Mr. was trying to calm me down by promising me free repairs if needed, and he wouldn't charge me for the battery. Well once again after calming down I said o.k. So I asked Mr. to show my wife how to operate the machine so his employee immediately began showing my wife the function of the machine. When she started going the belt to the blade came off, and once again I stated give me my money back. Mr. instructed his employee to fix the belt and that they didn't tight the belt correctly.
The same day shortly after testing the machine and Mr. had left our home. We could not remove the key from the ignition. We called Mr. and he came back to our house with a new key, took the old key out which was rusted and gave us the new key. I never took the machine to moats small engine repair shop due the fact as I stated earlier in this letter I didn't have transportation for the mower.
Two weeks later when we attempted to cut our grass we removed the lawnmower from our shed and it stalled on us and would not start again. We called Mr. and he and the same employee returned to our house and examined the mower and said that the engine was blown and that it wasn't our fault and that he would put a new engine in at no charge. Two weeks later (November) we received the lawnmower back.
For a third time (after Christmas) we attempted to remove the lawnmower from our shed and when we turned it on it started to spew oil. When we called Mr. he stated that he would not fix it any more for free. I then took the mower to another small engine repair shop and the owner stated that the machine would cost more to fix than the money I paid for it. That it was useless to try to fix it. He then stated that he had several machines at his shop that were brought in from *** Repair shop. None of the things that happened to this mower was due to our neglect. The accounts that Mr. states are completely false and it cost us $600.00.

First and foremost *** Small Engine Repair by no means is taking advantage of Mr. or anyone else for that fact. Mr. purchased the mower knowing that it was not a brand new mower and my business has done everything to make it right as listed in the above answer. Mr. as he stated in his complaint "either a refund or for them to repair it" and that we did it was repaired. As I stated that each complaint/problem I went to his residence and took care of the necessary repair and tested the mower with Mr. present and did not leave until he was satisfied with it.
As to the last complaint in which Mr. called he never said what the problem was but I told him that I would have to charge him $10.00 for a service call and that is when he said he would see me in court and hung up on me. On his complaint he said that he took it out of the shed and cranked it and started to spew oil and after calling us that he took it to another repair shop. I want the name of the repair shop that Mr. took it to and how they arrived at their diagnosis with a dated invoice. As long as no one else has worked on the mower which it sounds like no one has they just condemned it along with my business. We are willing to go pick the mower up and look at it and make a determination as to what to do next. I have high regard for Mr. and I hate that it has come to this but I did not give him a life time warranty. The mower was sold "as is" and he was aware of that. I know as a businessman that if my business is being talked down about another business which is slander that I have the right to confront the accuser.

Good day sirs this is Mr. Sr. once again, and I'm back in order to set things straight about the false accusations that Mr. is stating. First of all no one has slandered his name or integrity. All the statement was my word, and Mr. hasn't met anyone that he is claiming that made false accusations about him. If anything, in the court of law it is considered hearsay.
I have read Mr. rebuttal and Mr. had to come to my house three times on the first day of delivery and it was not on 10/19/19, it was on a week day, Monday the 21st 2019. I remember because my wife just came home from work, we ate dinner and that's when Mr. and one of his employees arrived with my lawn mower. When I went out to greet Mr. he immediately told me that the battery in the mower was dead and he brought a new one with him and it would cost me $42.00 in addition to the balance of what I owed him for the mower. I told him that I paid for a mower that was supposed to work and that it was not fair for me to have to pay for a battery. Mr. noticed that I was not happy about having to pay for the battery and changed his mind about the battery and put it in the lawnmower. That's when I asked Mr. to show my wife how to operate the mower, and immediately his worker asked my wife to hop into the driver's seat and she did. The worker started showing my wife the different gears needed to put the machine into forward, reverse and neutral, etc. As my wife proceeded to cut the grass after about 2 minutes the mower stalled due to the belt of the blades coming off the mower. The same day after the worker put the belt back on, Mr. and his employee left and we had to call Mr. back and we told him we couldn't get the key out of the ignition. So Mr. immediately returned and attempted to remove the key. After many attempts of tugging at the key himself it finally came out and he said that it got rusted from sitting a long time in the weather at this shop. He had to go and get a copy made from Wal-***.
Mr. has made claims that the lawn mower was sold as is, yet please explain to me why he continuously came back numerous times to fix the mower at no charge within the first three weeks of my possession of the mower. Mr. not once told me that the sale was "as is" nor did he ever put it in writing. Yet since the very first time when the belt came off he stated in my presence as well as my wife and daughter that if I had any problems that he would take care of me at no charge. Well that was about the end of the month and I thought well its almost November and winter would be rolling soon so we put the mower into our shed for the winter. November 2 , 2019 My wife, and I, our two daughters, and our son in law went on a cruise to Mexico for a week and when we returned I noticed our grass needed cutting. The very next day my wife wanted to cut the grass. As she opened the shed door she noticed oil was under the mower. She attempted to start the mower and oil started shooting out and it would not start. We had to push it out side in order to clean up the oil then we had to push it back into the shed and called Mr.. Mr. then stated that he would not fix it for free anymore. He never said anything about a ten dollar charge. At that point I called my mechanic. When I told him what was wrong he told me that he was out town until after Christmas, and that he would call me once he arrived back in town which was on Monday, December 30, 2019. My mechanic told me that it would cost me more to fix it than what it was worth. Although I knew that it was not a new mower, I expected a mower that would at least work without problems from the first day. This is the reason for the complaint. I would like a full refund of what I paid for the mower. It is unacceptable because I explained to Mr. at the time of the down payment that I was handicapped and I did not want a machine that had to be fixed constantly and he agreed. I believe that the machine was just fixed up enough to sell it.
