Response: Yes I did call on Monday 2/to cancel the upcoming party we had booked for that Saturday the 22ndThe reason was we had received within a weeks time several snow storms that resulted in about 16-18" of snow accumulationThis has a direct negative impact on my business in regards I cannot safely drive or park this trailer with all this snowThe truck and trailer weigh 17,lbs and is 60' longThe trailer with the staircases extended is 11' wideWith that much snow every driveway becomes too narrow and with 3' snowbanks on the sides makes it immposible to back the trailer intoThe shoulder of the road (if any)are covered with snow banks which makes it difficult if not impossible to park safely on the streetI cannot block the roadIt is my responsibility to keep at least 8' of the roadway free so vehicles can get around meI'm responsible for those children while they're playing inside my trailerIt is a law that if I'm parked in the travel lane of the roadway and a vehicle trying to drive around my trailer strikes it I'm liable for all injuries and damagesEven traveling to and from locations becomes hazardousOn many occasions at an intersection there wouldn't be enough room to turnI have several dents and scrapes on this trailer to prove that point and there is no fun trying to dig out wheels out of snow and slushI had the added benefit also of knowing her exact location in advanceHer road is an older road, narrow at many points with a few turns and located on a hillside where I would have to navigate a 1/mile incline and decline as wellI have been in business for years and have done nearly a parties/eventsIn the beginning I was too eager to please everyone at any costNavigating that large of a vehicle on narrow side streets I was putting at risk myself, my equipment, the family hosting the party, their guests and children as well as everyone else on the roadI learned I had to put profits aside and safety firstThat's why I called to cancel days prior, I knew at that point that even days later it would still be unsafeThis business has only part hours in the summer and a lot less in the winterThis time of year I usually check my voice and email every other dayPeople call leave a message, I return it within hoursThe message I left on 2/for the complaintant and the other parties I had scheduled that upcoming weekend was to the effect that due to the amount of snow there's no way I can get to them and/or park safelyI apologize in the most opologetic tone I canI add for empathy that I too am buried in snow and have my work cut out for me to dig outI then ask if they would like to reschedule or to let me know what they would like to me to doI've never had until now someone misunderstanding that messageMost people come up with a new date and we reschedule, some ask to hold onto their deposit and they get back to me at a later dateA few ask for their deposits refundedThe few that wish to have their deposits returned, their depostis are in the mail ususally within hoursI don't accept credit cardsThey mail their deposit to me by check or money order using the US mailI return their deposits by writing a check for the same exact amount and also use the US mailTwo days later when listening to my voicemail I did have two messages from the complaintantBoth sounded very iritatedThe first left on 2/was to the effect to return her deposit that I cannot keep it, it's in the contract and its not her fault I can't get out of my drivewayThe second meassage left on 2/was to the effect if she doesn't hear from me she's contacting you, the Revdex.com and to involve her husband who is a police detectiveAfter listening to these two messages on 2/I called her to calm her fears down and explain again the reasonses why I canceled the party and to let her know her she doesn't lose her deposit and that it will be in the mail tommorow (2/20)There was no answer, I left that message on her voicemailI have a printout of the canceled check for her returned deposit that she signed and depositedThe date of 2/written on the check and a date of 2/it cleared my bankThis copy I will mail to the Revdex.com so you may have it on fileRegarding cashing her deposit: When deposits are sent to me they are deposited into my bank accountThat's how it's converted into moneyHolding onto the physical paper it's written on doesn't benefit me in any wayRegarding the statement of my competitor covering for me: I frequently get the same calls regarding my competitorsAND because I did cancel in advance as much as I did she was able to find another company to comeThat I am happy for her and her child and reinforces my decisionTo sum it up...the facts as I see them; *Knowing I couldn't guarentee the safety of her children and guests because of the weather I canceled the party giving her as much advance notice as I possibly could(Thus she was able to make other arrangements with another company to come to her party) *After receiving her message (the next day after cancelling) to return her deposit, her deposit was in the mail within hours and I left a message to her of doing just thatIn years of business I have yet to have a party that was dissatisfied with my services or refused payment in any wayOR have had an injury, accident or damage to anyone or their propertyI sometimes, like this instance, lose money to keep it that way [redacted] Owner of Mobile Amusements LLC Sent on: 2/28/11:04:AM

This has a direct negative impact on my business in regards I cannot safely drive or park this trailer with all this snow. The truck and trailer weigh 17,000 lbs and is 60' long. The trailer with the staircases extended is 11' wide. With that much snow every driveway becomes too narrow and with 3' snowbanks on the sides makes it immposible to back the trailer into. The shoulder of the road (if any)are covered with snow banks which makes it difficult if not impossible to park safely on the street. I cannot block the road. It is my responsibility to keep at least 8' of the roadway free so vehicles can get around me. I'm responsible for those children while they're playing inside my trailer.
