Recently an agent in this firm was involved in a mobile home transaction in the *** community. Kari C was the agent for the sale of unit ***. I have several serious concerns about this agent’s performance and ethics regarding this transaction.
-The agent was performing as a dual agent, not informing the seller of this fact
-offer had previously been extended by Chris (the buyer)so no agent was necessary for sale
-failure on the agent’s part to confirm the costs associated with this sale to the 88 year old owner of the property
-not confirming with the owner, but another party, on the price, costs, etc of the sale
-commission costs far in excess of what would be considered normal or customary

In January of 2020, the buyer of this property, Chris (associated with the *** family) learned that this property was for sale, and made an offer to the owner of $80,000. The owner had an intent to list her home for $97,000. In February, Chris returned to re-iterate the offer, now having Kari C in tow and a commission is involved. The agent listing agreement shows a $3800 commission, scratched out in different places, replaced with $5500. Clearly this alteration to the agreement was important, as the agent initialed it, but failed to clarify with the seller and failed to acquire her initials on the change. We strongly believe the agent was involved as a dual agent on the part of Chris, was more concerned about her own interests than the best interests of her client. The owner had previously made her intent to sell(or list) the property at $97,000, and apparently no effort to negotiate this was made by the agent, and appears most of the negotiating was done through a third party, not the legal owner.
Since the buyer had already made an offer to the seller prior to the involvement of the agent, the agent agreement was an unnecessary and expensive burden on the seller (senior, 88), who may not have been adequately informed of the costs.

The person who made this complaint is a relative of the client. If this client had a buyer for the home, why did they list it with Mobile Home Connection? The contract said If home is sold to *** ( a person who did see the home prior to it being listed with us) commission to be $3,800 otherwise it would remain the agreed upon amount of $5,500. It was only through this agents efforts that an offer was brought to the table. When seller realized that they knew the who the buyer was, they became upset claiming the agent hadn't work hard enough to deserve the full commission. They only wanted to pay her what they agreed to pay if *** purchased it. The agent stood her ground and said No. Seller then agreed to the $5,500 in writing by signing seller papers/ escrow authorization. And for the record the customary commission for mobile homes is 10% of the selling price or no less than $6,000. Seller received a $500 discount at $5,500. The buyer of this home has purchased other homes in the park but never for more than $50,000. It was only because of this agents efforts on the sellers behalf that they received $80,000. We are truly sorry they are unhappy with the results of the sale.

The person who submitted the complaint is not the seller, but the nephew, who is handling some of the sellers affairs. The seller and husband are 88 and 89. The ultimate buyer , part of the *** family, had already submitted an offer. Normally an agent is not required, or required for the paper chase. The listing agreement is so ambiguous, scratched out parts and over-writes, it is hard for a reasonable person, let alone an 89 year old, to clearly know the charges, especially since there are no initial to verify the seller has understood those changes. All parties to this sale understood the seller was not responsible for the March rent on the unit being sold, but the closing papers/check charged the seller for the March rent. A deliberate effort to slip it by and hope it did not get noticed?, or just a fraud waiting to happen? Two weeks after closing and the seller has still not received re-imbursement. Any seniors selling their home, please be sure you have someone knowledgeable present when any papers are signed from Mobile Home Connection, be sure of exactly what your charges are, and initial anything you have questions about. An ethically challenged company.

There was a charge placed by the mobile home park community to the escrow for the March rent which should not have occurred. We brought this to the parks attention and they said they would reimburse the seller for the charge. Escrow closed 15 days ago. We will keep calling the park to make sure this gets done. As far as the seller already having the buyer and not needing an agent, this statement is just not true. If seller already had buyer and was good to go why would they invite an agent to their home, sign a contract, allow a sign to go up, pictures to be taken, flyers placed at home, online advertising, allow potential buyers to view home etc.? The agent they hired facilitated a quick, cash sale for them at an incredible price with no repairs or credits asked for. If only this seller realized what a blessing this agent was for them! I am truly sorry they are not happy.
